An Act to Amend the Potato Disease Eradication Act Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, en- acts as follows: 1

Section 1 of the Potato Disease Eradication Act,

chapter P-9.4 of the Acts of New Brunswick, 1979, is amended by repealing the definition “Board”. 2

Section 3 of the Act is repealed. 3

Section 3.1 of the Act is amended by striking out “other than the Board”. 4 Subsection 3.2(1) of the Act is repealed and the following is substituted: 3.2(1) The Regulations Act does not apply to cat- egories or terms and conditions established by a body or person designated by the Minister under

section 3.1. 5

Section 17 of the Act is repealed and the fol- lowing is substituted: 17(1) A person affected by an order, notice or au- thorization of an inspector under this Act may ap- peal to the Minister by delivering or sending by reg- istered mail to the Minister, within fourteen days PROJET DE LOI 21 Loi modifiant la

Loi sur l’éradication des maladies des pommes de terre after receiving the order, notice or authorization of an inspector under this Act, a notice in the form pre- scribed by regulation stating the grounds upon which the person’s appeal is based. 17(2) Within fourteen days after receipt of the no- tice of appeal, the Minister shall arrange for a hear- ing to be held into the matter. 17(3) The Minister shall render a decision within thirty days after the hearing. 17(4) In rendering a decision, the Minister may (

a) declare that an order, notice or authoriza- tion stand, (

b) revoke the order, notice or authorization, or (

Le paragraphe 25.8(6) de la Loi est abrogé et remplacé par ce qui suit : 25.8(6) Nonobstant toute autre disposition de la présente loi, aucun appel ne peut être interjeté auprès du Ministre d’un ordre donné en vertu du pa- ragraphe (1) ou relativement à cet ordre. 7

section 3.1”. 9(1) The Potato Diseases Advisory Board is ter- minated. 9(2) All appointments or designations of persons as Chairman, Vice-Chairman or members of the Potato Diseases Advisory Board are revoked. 9(3) All contracts, agreements and orders relat- ing to the amount of remuneration to be paid to the Chairman, Vice-Chairman or members of the Po- tato Diseases Advisory Board are null and void. 9(4) Notwithstanding the provisions of any con- tract, agreement or order, no remuneration shall be paid to the Chairman, Vice-Chairman or mem- bers of the Potato Diseases Advisory Board. 9(5) No action, application or other proceeding lies or shall be instituted against the Minister of Agriculture, Fisheries and Aquaculture or the Crown in right of the Province as a result of the termination of the Potato Diseases Advisory Board under subsection (1) or the revocation of appoint- ments or designations under subsection (2). 9(6) An appeal made to the Potato Diseases Ad- visory Board before the commencement of this Act shall be dealt with by the Minister in accordance with

section 17 of the Potato Disease Eradication Act, as amended by

section 5 of this amending Act. 9(7) The documentation, information, records and files pertaining to an appeal to be dealt with by the Minister under subsection (6) become the doc- umentation, information, records and files of the Minister on the commencement of this Act. de l’article 3.1» et son remplacement par «sous ré- serve de l’article 3.1». 9(1) La Commission consultative des maladies des pommes de terre cesse d’exister. 9(2) Toutes les nominations ou désignations des personnes à

a) by striking out “POTATO DISEASES AD- VISORY BOARD” and substituting “MINIS- TER OF AGRICULTURE, FISHERIES AND AQUACULTURE”; (

b) by striking out “upon the Chairman of the Potato Diseases Advisory Board” and substitut- ing “upon the Minister of Agriculture, Fisheries and Aquaculture”; (

c) by striking out “before the Potato Diseases Advisory Board” and substituting “before the Minister of Agriculture, Fisheries and Aquacul- ture”; (

d) by striking out “one copy for the Chair- man, Potato Diseases Advisory Board one copy for the appellant” and substituting “one copy for the Minister of Agriculture, Fisheries and Aquaculture and one copy for the appellant”. Consequential amendments to the Plant Health Act 11(1) Paragraph 24(1)(

q) of the Plant Health Act,

Section 1 The existing definition is as follows: “Board” means the Potato Disease Advisory Board ap- pointed under

section 3;

Section 2 The existing provision is as follows: 3(1) There is hereby established a board to be known as the Potato Diseases Advisory Board consisting of not fewer than ten members to be appointed by the Lieutenant-Governor in Coun- cil to hold office during pleasure. 3(2) Without limiting the discretion of the Lieutenant-Gover- nor in Council to appoint members of the Board, the Lieutenant- Governor in Council shall make every reasonable effort to ap- point to the Board at least (

a) two representatives of the New Brunswick Seed Potato Growers Association Inc.; (

b) one person who is a potato dealer; (

c) one representative from each Potato Agency estab- lished under the Natural Products Act; (

d) three representatives from the Department of Agricul- ture (Canada); and (

e) three representatives of the Department of Agriculture, Fisheries and Aquaculture. 3(3) The Lieutenant-Governor in Council shall designate one member of the Board to be the Chairman thereof and another member to be the Vice-Chairman thereof. 3(4) The Chairman of the Board shall preside at meetings of the Board, but in the absence or incapacity of the Chairman, or if the office of Chairman is vacant, the Vice-Chairman shall act as Chairman for the time being. 3(5) The duties of the Board are (

a) to advise the Minister respecting the control of potato diseases; (

b) to educate dealers and producers respecting the control of potato diseases; (b.1) unless the Minister has by Order in Council desig- nated a different body or person to do so, to establish the cat- egories of approved seed potatoes in respect of which per- NOTES EXPLICATIVES

(

c) to hear appeals under this Act and the regulations; (

d) generally, to promote and publicize practices required for the control of potato diseases. 3(6) The Board may make by-laws (

a) respecting the calling of meetings of the Board; (

b) respecting the conduct of business at meetings of the Board; (

c) respecting the establishment of committees of the Board; (

d) delegating any duty of the Board to a committee of the Board; (

e) respecting the fixing of quorums for meetings of the Board and any committee of the Board; and (

f) generally for the conduct and management of the affairs of the Board.

Section 3 The amendment is consequential on the amendment made in

section 2 of this amending Act.

The existing provision is as fol- lows: 3.1 The Minister may designate by Order in Council a body or person other than the Board to establish the categories of ap- proved seed potatoes in respect of which permits to plant seed potatoes are required and the terms and conditions that are to be met respecting the application for and the issuance, holding, sus- pension, cancellation, reinstatement and renewal of those per- mits, including varying the terms and conditions on the basis of different purposes for which the seed potatoes are to be used, different origins of the seed potatoes, different areas in which the seed potatoes are to be planted or any other factor. approuvées à l’égard desquelles des permis pour planter des pommes de terre de semence sont requis et les modalités et conditions à satisfaire concernant la demande et la déli- vrance, la possession, la suspension, l’annulation, le rétablis- sement et le renouvellement de ces permis, y compris le changement des modalités et conditions dépendant des diffé- rents buts auxquels les pommes de terre de semence sont destinées à être utilisées, des différentes sources des pommes de terre de semence, des différents secteurs où les pommes de terre de semence sont destinées à être plantées et de tout autre facteur.

a) concernant la convocation des réunions de la Commis- sion;

b) concernant la conduite des affaires lors des réunions de la Commission;

c) concernant la création de comités au sein de la Commis- sion;

d) déléguant toute fonction de la Commission à un comité de celle-ci;

e) concernant l’établissement du quorum lors des réunions de la Commission et de tout comité de celle-ci; et

f) d’une façon générale, pour la conduite et la direction des affaires de la Commission.

Article 3 La modification est corrélative à la modification faite à l’ar- ticle 2 de la présente loi modificative.

La disposition actuelle se lit comme suit : 3.1 Le Ministre peut désigner par décret en conseil un orga- nisme ou une personne autre que la Commission pour établir les catégories de pommes de terre de semence approuvées à l’égard desquelles des permis pour planter des pommes de terre de se- mence sont requis et les modalités et conditions à satisfaire con- cernant la demande et la délivrance, la possession, la suspen- sion, l’annulation, le rétablissement et le renouvellement de ces permis, y compris le changement des modalités et conditions dé- pendant des différents buts auxquels les pommes de terre de se- mence sont destinées, les différentes sources des pommes de terre de semence, les différents secteurs où les pommes de terre de semence sont destinées à être plantées ou de tout autre fac- teur.

Section 4 The amendment is consequential on the amendment made in

section 2 of this amending Act. The existing provision is as fol- lows: 3.2(1) The Regulations Act does not apply to categories or terms and conditions established by the Board under paragraph 3(5)(b.1) or by a body or person designated by the Minister un- der

section 3.1.

The existing provision is as fol- lows: 17(1) A person affected by an order, notice or authorization of an inspector under this Act may appeal to the Board by deliver- ing or sending by registered mail to the Board, within five days after receiving the order, notice or authorization of an inspector under this Act, a notice in the form prescribed by regulation stat- ing the grounds upon which his appeal is based. 17(2) Within five days after receipt of the notice of appeal, the Chairman of the Board shall arrange for a hearing to be held into the matter. 17(3) The Board shall review all evidence presented at the hearing and all representations made and shall within forty-eight hours after the hearing submit a recommendation to the Minister that the order, notice or authorization stand, be revoked or be varied. 17(4) After considering the recommendation of the Board, the Minister may declare that an order, notice or authorization stand, may revoke the order, notice or authorization or may vary the or- der, notice or authorization in any way he considers appropriate.

Section 6 The amendment is consequential on the amendment made in

section 2 of this amending Act. The existing provision is as fol- lows: 25.8(6) Notwithstanding any other provision of this Act, no appeal lies to the Board or to the Minister from or in relation to an order made under subsection (1).

Section 7 The amendment is consequential on the amendment made in

section 2 of this amending Act. The existing provision is as fol- lows: 25.801(7) Notwithstanding any other provision of this Act, no appeal lies to the Board or to the Minister from or in relation to

Section 8 The amendment is consequential on the amendment made in

section 2 of this amending Act. The existing provision is as fol- lows: 26(1) The Lieutenant-Governor in Council may make regula- tions (c.2) subject to paragraph 3(5)(b.1) and

section 3.1, re- specting the application for and the issuance, holding, sus- pension, cancellation, reinstatement and renewal of permits to plant seed potatoes;

Section 9 Transitional provisions.

Section 10 The amendments to Form 1 of New Brunswick Regulation 82-70 under the Potato Disease Eradication Act are consequen- tial on the amendments made in

section 2 of this amending Act.

Section 11 (1) The amendment is consequential on the amendment made in

section 2 of this amending Act. The existing provision is as follows: 24(1) The Lieutenant-Governor in Council may make regula- tions (

q) providing for the termination of the Potato Disease Ad- visory Board as established under the Potato Disease Erad- ication Act , including providing for the revocation of ap- pointments or designations, the nullification of all contracts, agreements and orders in relation to the appointment of any members of the Board or between the Board and others, the prohibition of proceedings arising in relation to the termina- tion, the transfer of documentation, other information and materials, proceedings and other matters from the Potato Disease Advisory Board to the body, bodies, person or per- sons established or designated under paragraph (r), the com- pletion of proceedings being held by the Potato Disease Ad- visory Board and any other matter or thing arising from the termination; sion ni auprès du Ministre d’une décision prise en vertu du para- graphe (2) ou d’un ordre donné en vertu du paragraphe (4) ou re- lativement à cette décision ou à cet ordre.

(2) The existing provision is as follows: 25(3) The Potato Disease Eradication Act,

chapter P-9.4 of the Acts of New Brunswick, 1979, is repealed.
