Definitions

1 In this regulation,

"Act" means The Health Services Insurance Act ; (« Loi »)

"chiropractor serving northern Manitoba" means a chiropractor who resides in and provides a majority of insured services in that part of Manitoba north of the 53rd parallel of latitude; (« chiropraticien pratiquant dans le Nord du Manitoba »)

"family registrant" means a person who has registered with the minister in his or her own name and on behalf of one or more of his or her resident dependants; (« chef de famille »)

"majority of insured services" means a majority measured in terms of the amount of benefits that a chiropractor is entitled to be paid by the minister in a calendar month. (« majorité des services assurés »)

Act applies to chiropractic services

1.1 For the purpose of

section 71 of the Act, the Act applies to the chiropractic services described in

section 2 when provided by a chiropractor entitled to practice in the place the service is provided.

2 Except as provided in the Excluded Services Regulation , Manitoba Regulation 46/93, the adjustment of the human spinal column, pelvis and extremities are insured chiropractic services whether provided in or outside of Manitoba.

3 The amount of the benefit to be paid in respect of insured chiropractic services is as follows:

(

a) for the first and for each subsequent visit and treatment provided by a chiropractor

(

i) April 1, 2015 to March 31, 2016

(ii) April 1, 2016 to March 31, 2017

(iii) April 1, 2017 to May 31, 2017

(iv) June 1, 2017 to March 31, 2018

Maximum yearly benefit

4 Notwithstanding

section 3, the maximum benefit payable in a calendar year for an insured person shall not exceed the total benefit payable for seven insured chiropractic services, based on the amounts set out in

section 3.

Payment conditional on receipt or account

5(1) It is a condition of payment for insured chiropractic services provided outside Manitoba that within six months from the date on which the services were provided the insured person submit to the minister an itemized receipt or account that shows the services provided and the fees paid or payable.

5(1) S'il veut recevoir des prestations relativement à des services de chiropractie reçus à l'extérieur de la province, l'assuré doit soumettre au ministre, au plus tard six mois après que les services en question lui ont été fournis, un reçu ou un compte détaillé qui fait état de ces services ainsi que des honoraires ou des frais payés ou à payer.

5(2) The minister may extend the time referred to in subsection (1) if in the minister's opinion there are extenuating circumstances that prevented the filing of the claim within the six month period.

5(2) Le ministre peut proroger le délai prévu au paragraphe (1) s'il considère que, en raison de circonstances atténuantes, le dépôt de la demande de règlement n'a pu être fait dans le délai de six mois.

5(3) Rather than making payment directly to an insured person for chiropractic services provided outside Manitoba, the minister may pay the person who provided the services if the insured person has not paid the fees for the services provided.

Payment for a dependant

6 When an insured person is a dependant who is entitled to payment under this regulation, payment may be made to the family registrant.

Coming into force

7 This regulation comes into force on March 31, 1993.
