Ben Eoin Provincial Park Designation

made under

Section 8 of the

Provincial Parks Act

R.S.N.S. 1989, c. 367

O.I.C. 75-167 (February 11, 1975), N.S. Reg. 31/75

The Governor in Council on the report and recommendation of the Minister of Lands and

Forests dated the 20th day of January, A.D., 1975, pursuant to the provisions of

Section 2 of

Chapter 244 of the Revised Statutes of Nova Scotia, 1967, the Provincial Parks Act , is pleased

to:

(

a) constitute all that area of land including land covered with water owned by Her

Majesty in right of the Province of Nova Scotia and situate at or near Ben

Eoin, in the County of Cape Breton, Province of Nova Scotia, to be a

Provincial Park, said area of land being included within the boundaries of the

lands described in

Schedule “A” and shown outlined on the Plan of Survey

marked

Schedule “B”, both Schedules attached to and forming part of the

report and recommendation; and

(

b) declare the name by which the park shall be known as “Ben Eoin Provincial

Park”.

Ben Eoin Provincial Park

All that certain lot, piece or parcel of land situate, lying and being at or near Ben Eoin, County

of Cape Breton, Province of Nova Scotia as is shown on Plan E-5-40, recorded in the Crown

Land Registry office, Halifax, being more particularly described as follows:

Beginning at a Crown Land Wood Post (C.L.W.P.) marked C.B. 1767 set on the southern

boundary of Highway No. 4 and the most northeasterly corner of lands now or formerly owned

by the Overseers of the Poor District No. 8;

Thence easterly along the southern boundary of said Highway No. 4 to a C.L.W.P. marked

C.B. 1762, said C.L.W.P. marked C.B. 1762 being north sixty-six degrees three minutes east

(N 66° 03'

E) distant two thousand fourteen decimal ninety-eight (2014.98) feet from the

immediate above mentioned C.L.W.P. marked C.B. 1767 being the Place of Beginning;

Thence south ten degrees thirty minutes east (S 10° 30'

E) along the western boundary of lands

now or formerly owned by Eddy MacDonald distant five thousand one hundred thirty-two

decimal sixteen (5132.16) feet to a C.L.W.P. marked C.B. 1763;

Thence south seventy-four degrees forty minutes west (S 74° 40'

W) along the northern

boundary of lands owned by the Crown distant one thousand nine hundred seventy-three

decimal forty (1973.40) feet to a C.L.W.P. marked C.B. 1766;

Thence north ten degrees twenty-five minutes west (N 10° 25'

W) along the eastern boundary

of said lands now or formerly owned by the Overseers of the Poor District No. 8 distant four

thousand eight hundred twenty-nine decimal eighty-eight (4829.88) feet to the place of

beginning.

The above bearings are magnetic of the year 1966. The above described lands containing an

area of two hundred twenty-four (224) acres more or less.
