B.C. Reg. 239/2020 , deposited September 20, 2020, under the CARBON TAX ACT [section 84 (3)], the MOTOR FUEL TAX ACT [section 71 (2)] and the PETROLEUM AND NATURAL GAS ACT [section 73]. Order in Council 529/2020, approved and ordered September 20, 2020.
On the recommendation of the undersigned, the Lieutenant Governor, by and with
the advice and consent of the Executive Council, orders that
(
a) the Carbon Tax Regulation, B.C. Reg. 125/2008, is amended as set out in the attached
Schedule 1,
(
b) the Motor Fuel Tax Regulation, B.C. Reg. 414/85, is amended as set out in
the attached
Schedule 2,
(
c) the Net Profit Royalty Regulation, B.C. Reg. 98/2008, is amended as set out
in the attached
Schedule 3, and
(
d) the Petroleum and Natural Gas Royalty and Freehold Production Tax Regulation,
B.C. Reg. 495/92, is amended as set out in the attached
Schedule 4.

Schedule 1
Section 41.8 of the Carbon Tax Regulation, B.C. Reg. 125/2008, is amended by
adding the following subsections:
(4.1) The minister may, in writing, delegate any of the minister's powers or duties
under this section.
(4.2) A delegation under subsection (4.1) may be to a named person or to a class
of persons.
Schedule 2
Section 51.92 of the Motor Fuel Tax Regulation, B.C. Reg. 414/85, is amended
by adding the following subsections:
(4.1) The minister may, in writing, delegate any of the minister's powers or duties
under this section.
(4.2) A delegation under subsection (4.1) may be to a named person or to a class
of persons.
Schedule 3
Section 19 of the Net Profit Royalty Regulation, B.C. Reg. 98/2008, is amended
by adding the following subsections:
(5) The Minister of Finance may
(
a) delegate, in writing, the exercise of any power or performance of any duty
conferred or imposed on the Minister of Finance under this
section to an employee
of the ministry of the Minister of Finance, and
(
b) provide, in making a delegation, directions that are binding on the delegate
respecting the exercise of the power or the performance of the duty.
(6) A delegation under subsection (5) may be made by name or by designation of
the office.
Schedule 4
Section 12 of the Petroleum and Natural Gas Royalty and Freehold Production Tax
Regulation, B.C. Reg. 495/92, is amended by adding the following subsections:
(5) The Minister of Finance may
(
a) delegate, in writing, the exercise of any power or performance of any duty
conferred or imposed on the Minister of Finance under this
section to an employee
of the ministry of the Minister of Finance, and
(
b) provide, in making a delegation, directions that are binding on the delegate
respecting the exercise of the power or the performance of the duty.
(6) A delegation under subsection (5) may be made by name or by designation of
the office.
