chapter O-0.2 of the Acts of New Brunswick, 1983, is repealed. 1 Le paragraphe 2(2) de la

Section 8 of the Act is amended 2 L’article 8 de la Loi est modifié (

a) by repealing subsection (1) and substituting the following:

b) by adding after subsection (1) the following:

c) by repealing subsection (2) and substituting the following:

3 The Act is amended by adding after

section 8 the fol- lowing: 3 La Loi est modifiée par l’adjonction de ce qui suit après l’article 8 : 8.1(1) Every employer with 20 or more employees reg- ularly employed in the Province shall establish a written health and safety program, in consultation with the com- mittee or the health and safety representative, that includes provisions with respect to the following matters: 8.1(1) Tout employeur occupant dans la province vingt salariés et plus de façon habituelle établit un programme d’hygiène et de sécurité écrit en consultation avec le co- mité ou le délégué à l’hygiène et à la sécurité, lequel com- prend des dispositions : (

a) the training and supervision of the employees in matters necessary to their health and safety;

a) sur la formation et la supervision des salariés con- cernant les questions nécessaires à leur hygiène et à leur sécurité; (

b) the preparation of written work procedures and codes of practice for the implementation of health and safety work practices, required by this Act, the regula- tions or by any order made in accordance with this Act;

b) sur l’élaboration d’une procédure de travail écrite et de codes de directives pratiques relatives à la mise en oeuvre de pratiques en matière d’hygiène et de sécurité qu’exigent la présente loi et ses règlements ou tout ordre donné en application de la présente loi; (

c) the identification of the types of work for which the work procedures are required at the places of em- ployment of the employer;

d) a hazard identification system that includes

i) evaluation of the place of employment to iden- tify potential hazards, (

i) l’évaluation du lieu de travail afin de déterminer les dangers potentiels, (ii) procedures and schedules for inspections, and (ii) la procédure applicable aux inspections et leur horaire, (iii) procedures for ensuring the reporting of haz- ards, prompt follow-up and control of the hazards; (iii) la procédure applicable au signalement des dangers, au suivi immédiat et à la maîtrise des dan- gers; (

e) a system for the prompt investigation of hazardous occurrences to determine their causes and the actions needed to prevent recurrences;

f) a record management system that includes reports of employee training, accident statistics, work proce- dures and health and safety inspections, maintenance, follow-up and investigations; and

a) the name and contact information of the new em- ployee’s supervisor;

c) the new employee’s rights, liabilities and duties under this Act and the regulations, including reporting requirements and the right to refuse to perform

an act under

section 19;

d) the health and safety procedures and codes of practice related to the new employee’s job tasks;

e) the location of first aid facilities and how to obtain first aid;

f) the procedures related to the reporting of illnesses and injuries;

g) the procedures related to emergencies; and

h) the use of personal protective equipment, if ap- plicable.

section 33 the following: 5 La Loi est modifiée par l’adjonction de ce qui suit après l’article 33 : 33.1(1) If an officer makes an order, the officer may re- quire that the employer submit a written report to him or her outlining the employer’s compliance with the order. 33.1(1) L’agent qui donne un ordre peut exiger que l’employeur lui remette un rapport écrit décrivant la façon dont il se conforme à l’ordre. 33.1(2) The written report shall be made within the time period given by the officer. 33.1(2) Le rapport écrit est établi dans le délai que l’agent imparti. 33.1(3) The written report shall be signed by the em- ployer and a member of the committee or the health and safety representative. 33.1(3) L’employeur et un membre du comité ou un dé- légué à l’hygiène et à la sécurité signent le rapport écrit. 6

a) by repealing subsection (1) and substituting the following:

a) a loss of consciousness,

a) perd connaissance; (

b) an amputation,

b) subit une amputation; (

c) a fracture other than a fracture to fingers or toes,

d) a burn that requires medical attention,

d) subit une brûlure qui nécessite des soins médicaux; (

e) a loss of vision in one or both eyes,

e) perd la vision d’un oeil ou des deux yeux; (

f) a deep laceration,

g) admission to a hospital facility as an in-patient, or

g) est hospitalisé dans un établissement hospitalier; (

h) death.

a) an accidental explosion or an accidental exposure to a biological, chemical or physical agent occurs at a place of employment, whether or not a person is injured, or

b) a catastrophic event or a catastrophic equipment failure occurs at a place of employment that results, or could have resulted, in an injury.
