Upper Clements Provincial Park Designation

made under

Section 8 of the

Provincial Parks Act

The Governor in Council on the report and recommendation of the Minister of Lands and

Forests dated the 14th day of March, A.D., 1979, and pursuant to

Section 2 of

Chapter 244 of

the Revised Statutes of Nova Scotia, 1967, the Provincial Parks Act , is pleased to:

(

a) constitute all that area of land situate at Upper Clements, in the County of Annapolis,

Province of Nova Scotia, owned by Her Majesty the Queen in right of the Province

of Nova Scotia, to be a Provincial Park, the said area of land being described in

Schedule “A” and shown on

Schedule “B”, both Schedules attached to and forming

part of the said report and recommendation;

(

b) declare the name by which the park shall be known to be “Upper Clements

Provincial Park”.

Schedule “A”

All that certain lot, piece or parcel of land situate, lying and being at Upper Clements, in the

County of Annapolis, Province of Nova Scotia, as shown on Plan No. E-11-5, filed in the

Crown Land Records Office, Department of Lands and Forests, Halifax and being more

particularly described as follows:

Beginning at Iron Post I situate on the northern boundary of Highway No. 1 passing from

Annapolis Royal to Digby and marking the southwestern corner of lands now or formerly of

Mrs. Reginald Taylor;

From thence (by astronomic bearings) north twenty-nine degrees four minutes west along the

western boundary of the lands now or formerly of Mrs. Reginald Taylor, one hundred fifty

decimal seventy feet to Iron Post No. 5 marking the northwestern corner of the said Taylor

lands;

Thence north forty-nine degrees thirty-three minutes east along the northern boundary of the

Taylor lands, sixty-seven decimal fifty-one feet to Iron Post No. 6 marking a southwesterly

corner of Crown Lands;

Thence north eighteen degrees thirty-seven minutes west along the westerly boundary of Crown

Lands, nine hundred nineteen decimal twenty-four feet to a point situate on the southeastern

boundary of the Dominion Atlantic Railway right-of-way;

Thence north eighteen degrees forty-nine minutes west, a distance of four hundred eighty-nine

decimal zero four feet to Iron Post No. 7;

Thence continuing north eighteen degrees forty-nine minutes west, a distance of one hundred

twenty feet, more or less, to the mean high water mark of the Annapolis River;

Thence in a southerly and westerly direction along the mean high water mark of the Annapolis

River, a distance of one thousand seven hundred seventy feet, more or less, to a point;

Thence south eighteen degrees forty-six minutes east, a distance of sixty feet, more or less, to

Iron Post No. 1;

Thence south eighteen degrees forty-six minutes east, a distance of one hundred eighteen

decimal eighty feet to Hub “A”;

Thence south twenty degrees six minutes east along the eastern boundary of lands now or

formerly of Arnold Emerson, one hundred fifty-seven decimal zero eight feet to Hub “B”;

Thence south eighteen degrees forty-nine minutes east continuing along the easterly boundary

of the Emerson lands, four hundred sixty-six decimal sixty-two feet to Hub “C”;

Thence south nineteen degrees thirty-seven minutes east continuing along the easterly boundary

of the Emerson lands, three hundred eighty-nine decimal forty feet to Iron Post “D” situate on

the northern boundary of the aforesaid Highway No. 1 and marking the southeastern corner of

the Emerson lands;

Thence south nineteen degrees thirty-six minutes east along the eastern boundary of lands now

or formerly of Victor Haight, two hundred twenty-eight decimal zero three feet to Hub “E”;

Thence south eighteen degrees fifty-three minutes east continuing along the easterly boundary

of the Haight lands, one hundred forty-three decimal ninety-five feet to Iron Post No. 2 marking

the northwestern corner of lands now or formerly of Bessie Potter;

Thence north seventy-five degrees thirty-two minutes east along the northerly boundary of the

Potter lands, nine hundred eighty-two decimal zero eight feet to Iron Post No. 3 situate on the

western boundary of the Guinea Road and marking the northeasterly corner of the Potter lands;

Thence north nineteen degrees two minutes west along the western boundary of the Guinea

Road, seven hundred seventy-nine decimal forty-six feet to Iron Post No. 4;

Thence north forty-seven degrees twenty-four minutes west, a distance of sixty-nine decimal

sixty-five feet to the place of beginning.

The above described lands containing 31 acres, more or less.

Saving and reserving from the above described lands all public highways or any part thereof

as defined in

Chapter 248 of the Revised Statutes of Nova Scotia 1967, the Public Highways

Act and amendments thereto.

Also saving and reserving that portion of the one hundred foot wide Dominion Atlantic

Railway right-of-way which passes through the above described lands.

The Governor in Council on the report and recommendation of the Minister of Natural

Resources dated February 15, 2007, and pursuant to

Section 8 of

Chapter 367 of the Revised

Statutes of Nova Scotia, 1989, the Provincial Parks Act , is pleased to decrease the size of

Upper Clements Provincial Park, so designated by Order in Council 79-346, by approving the

withdrawal from the park of approximately 3.661 hectares of land as shown outlined in red on

the plan marked

Schedule “A” attached to and form[ing] part of the report and

recommendation, and to authorize the Minister of Natural Resources to execute such documents

as may be necessary to achieve the purposes of this Order.

Resources dated February 24, 2011, is pleased to:

Section 8 of

Chapter 367 of the Revised Statutes of Nova Scotia, 1989,

was approved by Order in Council 79-346 dated March 27, 1979, [N.S. Reg. 41/79]

by terminating the status, as a provincial park of approximately 4.5 hectares of land

shown as Lot 2 and outlined in bold on the plan marked

Schedule “A” attached to

and forming part of the report and recommendation; and

(d) [Clause (

d) not filed as a regulation.]
