INDIVIDUAL EXEMPTION REGULATION No. 135

UBC Properties Investments Ltd., Vancouver School of

Theology, St. Andrew's Hall, St. Mark's College and Carey Hall

1 An offer for sale or lease, the sale or lease and any assistance in the selling or leasing of the subdivided land that comprises all or part of the land described as

Lots 1 to 12, 14 to 40, 44 to 46, 49 to 51 and 53, all as shown on the attached Plan Showing Subdivision of:

Lots B, C, D, E, F, G, H, and J, Plan 6147

Lots L, M, N, Plan 14079

Lots 1 and 2, Plan 2278, and

Part of District Lot 3044, Group 1, Except Portions in Plans 6147 and 9301

All Within District Lot 3044, Group 1, New Westminster District,

prepared by Murray and Associates, B.C. Land Surveyors,

by or on behalf of UBC Properties Investments Ltd., Vancouver School of Theology, St. Andrew's Hall, St. Mark's College and Carey Hall, as applicable, is exempt from

Part 2 of the

Real Estate Act on condition that

(

a) at the time of the transfer of title to the purchaser, or in the case of a lease, at the time of the commencement of the term of the lease, the subdivided lot has no buildings intended for residential occupation, except buildings scheduled for demolition,

(

b) UBC Properties Investments Ltd., Vancouver School of Theology, St. Andrew's Hall, St. Mark's College and Carey Hall, as applicable, will keep all purchase monies from purchasers or lessees in the trust account of a solicitor or real estate agent until they have complied with

section 940 of the

Local Government Act ,

(

c) UBC Properties Investments Ltd., Vancouver School of Theology, St. Andrew's Hall, St. Mark's College and Carey Hall, as applicable, will notify all purchasers or lessees at the time of an offer for sale or lease that the offering is exempt from the provisions of

Part 2 of the

Real Estate Act and that they will not receive a prospectus or a disclosure statement receipted under the

Real Estate Act and will not have the benefit of any rights or protections afforded by

Part 2 of that Act, and

(

d) UBC Properties Investments Ltd., Vancouver School of Theology, St. Andrew's Hall, St. Mark's College and Carey Hall, as applicable, will notify all purchasers or lessees at the time of an offer for sale or lease that the purchasers or lessees must comply with

Part 2 of the

Real Estate Act before those purchasers or lessees offer strata lots to be constructed on the subdivided lots for sale or lease to the public.

section 6 of the Regulations Act , I hereby exempt from publication the sketch attached to B.C. Reg. 247/2002.
