Loi sur les relations industrielles Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as follows: Sa Majesté, sur l’avis et avec le consentement de l’Assemblée législative du Nouveau-Brunswick, édicte : 1 Subsection 3(4) of the Industrial Relations Act,

chapter I-4 of the Revised Statutes, 1973, is amended by adding after paragraph (

b) the following: 1 Le paragraphe 3(4) de la

section 104 the following: 2 La Loi est modifiée par l’adjonction de ce qui suit après l’article 104 : Replacement workers Travailleurs de remplacement 104.1(1) For the purposes of this section, sections 106 and 110.1 and subsection 128(2), the term “em- ployer” includes any employers’ organization, and every person acting on behalf of an employer or employers’ or- ganization. 104.1(1) Pour l’application du présent article, des arti- cles 106 et 110.1 et du paragraphe 128(2), « employeur » s’entend également d’une organisation d’employeurs et de toute personne agissant pour le compte d’un em- ployeur ou d’une organisation d’employeurs. 104.1(2) During a lock-out or strike authorized by this Act, an employer shall not use the services of a person, whether paid or not, 104.1(2) Pendant un lock-out ou une grève autorisé par la présente loi, il est interdit à un employeur de re- courir aux services d’une personne, rémunérée ou non : (

a) who is hired or engaged after the earlier of the date on which the notice to commence collective bar- gaining is given and the date on which bargaining be- gins,

b) who ordinarily works at another of the em- ployer’s places of operations,

c) who is transferred to a place of operations in re- spect of which the strike or lock-out is taking place, if he or she was transferred after the earlier of the date on which the notice to commence bargaining is given and the date on which bargaining begins, or

d) who is employed, engaged or supplied to the employer by another person to perform

Section 106 of the Act is amended 3 L’article 106 de la Loi est modifié (

section 104.1 Infractions à l’article 104.1 110.1(1) Every person, employer or employers’ organ- ization that violates
