Bill 24 (Legislature 9, Session 2)

L9 S2 7760

Alberta — Bills

Bill No. 24 of 1942. A BILL TO AMEND THE DOWER ACT. NOTE.

Section of The Dower Act declares a disposition of the home by a married man without the consent of his wife null and void. The Courts have interpreted this to mean that it is only null and void as against the wife's life estate which becomes effective only on the husband's death. This means that the husband may dispose of the home subject to this estate. The purpose of the amendment is to make the

section mean what was intended, that is to make any such disposition null and void for all purposes. W. S. GRAY, Acting Legislative Counsel. (This note does not form any part of the Bill but is offered in explanation of its provisions.) BILL No. 24 of 1942.
