Railway (Alberta) Act

RAILWAY AMENDMENT REGULATION

For information only: Made by the Minister of Transportation (M.O. 29/22) on July

13, 2022 pursuant to sections 30 and 31 of the Railway (Alberta) Act.

1 The Railway Regulation (AR 177/2002) is amended by

this Regulation.

Section 13(2) is repealed and the following is

substituted:

(2) The date on or before which the operator of a railway that erects

snow fences under

section 22 of the Act shall remove those snow

fences is April 1 each year.

Section 16 is repealed and the following is substituted:

Prevention and Control of Fires

on Line Works Regulations

16(1) The Prevention and Control of Fires on Line Works

Regulations (SOR/2016-317) under the Railway Safety Act (Canada)

are declared in force with the variations or modifications prescribed

in this section.

(2) Section 1 is amended by adding the following after the

definition of "fire service":

"local railway company" and "railway company" mean a

person to whom

section 2 of the Railway (Alberta) Act

applies.

(3) Section 25 is struck out and the following is

substituted:

25 A railway company must, at the Railway Administrator

(Alberta)'s request, provide the Railway Administrator (Alberta)

with a copy of any document referred to in

section 24.

(4) Section 32 is struck out and the following is

substituted:

32 A local railway company must, at the Railway Administrator

(Alberta)'s request, provide the Railway Administrator (Alberta)

with a copy of any document referred to in

section 31.

Section 18(3)(

a) is repealed and the following is

substituted:

(

a) by striking out clause 3.13 and substituting the

following:

3.13 "Department" means the Railway Administrator

(Alberta);

Section 23(3)(

a) is repealed and the following is

substituted:

(

a) by striking out clause 3.15 and substituting the

following:

3.15 "Department" and "Department's regional office

concerned" mean the Railway Administrator (Alberta);

Section 26 is amended

(

a) in subsection (1) by striking out "System" and

substituting "Systems";

(

b) in subsection (3)(

a) by striking out "clause 2.5.1"

and substituting "clause 2.5".

Section 27 is repealed and the following is substituted:

Grade Crossings Regulations

27(1) The Grade Crossings Regulations (SOR/2014-275) under the

Railway Safety Act (Canada) are declared in force with the variations

or modifications prescribed in this section.

(2) Section 1(1) is amended by adding the following after

the definition of "public grade crossing":

"railway company" means a person to whom

section 2 of the

Railway (Alberta) Act applies;

(3) Section 3 is amended

(

a) in subsection (1) by striking out "an order of the

Agency or in an agreement filed with the Agency under

subsection 101(1) of the Canada Transportation Act" and

substituting the following:

"an exemption granted by the Railway Administrator

(Alberta)";

(

b) in subsection (2) by striking out "an order of the

Agency under

section 103 of the Canada Transportation

Act" and substituting the following:

"an exemption granted by the Railway Administrator

(Alberta)";

(4) Section 98(2) and (4) are amended by striking out

"Minister" and substituting "Railway Administrator (Alberta)".

Section 42(1)(

b) is amended by striking out "railway

legislation, operating rule" and substituting "railway legislation,

heritage railway rule, operating rule".

Section 45 is amended by striking out "August 31, 2022"

and substituting "August 31, 2027".

10 Sections 2 to 8 come into force on the coming into

force of

section 13 of the Red Tape Reduction

Implementation Act, 2022.

Gaming, Liquor and Cannabis Act

CANNABIS (PRESCRIBED THINGS) REGULATION

Cannabis Commission on July 14, 2022 pursuant to sections 130(

d) and (

e) of the

Gaming, Liquor and Cannabis Act.

Prescribed things

1 The following are prescribed things for the purposes of

section

90.09(1)(

b) of the Act that a cannabis licensee may sell:

(

a) licensee-branded or premises-branded apparel;

(

b) licensee-branded items, including but not limited to water

bottles, insulated mugs or candles;

(

c) cannabis-themed publications, including but not limited to

magazines, books or recipes;

(

d) things used in the personal growing of cannabis, including

but not limited to lights, soil, plant pots and handheld

gardening tools.

Maximum annual sales

2 In addition to selling cannabis, a cannabis licensee may sell

cannabis accessories and prescribed things referred to in

section 1 up

to a maximum of 15% of the total annual dollar value of all sales by

the licensee at the location to which the licensee's cannabis licence

relates.

Coming into force

3 This Regulation comes into force on September 1, 2022.

Teachers' Pension Plans Act

TEACHERS' AND PRIVATE SCHOOL TEACHERS'

PENSION PLANS AMENDMENT REGULATION

July 6, 2022 pursuant to

section 16(2) of the Teachers' Pension Plans Act and

section

12(4) of the Teachers' Pension Plans (Legislative Provisions) Regulation.

1 The Teachers' and Private School Teachers' Pension

Plans (AR 203/95) are amended by this Regulation.

Schedule 1 is amended

(

a) in

section 10(2)

(

i) in clause (

a) by striking out "8.07%" and

substituting "8.34%";

(ii) in clause (

b) by striking out "12.25%" and

substituting "12.20%";

(

b) in

section 11 by striking out "1.69%" and

substituting "0.66%";

(

c) in

section 13

(

i) in clause (

a) by striking out "9.28%" and

substituting "9.27%";

(ii) in clause (

b) by striking out "1.59%" and

substituting "0.62%".

Schedule 2 is amended in

section 10

(

a) in clause (

a) by striking out "8.07%" and substituting

"8.34%";

(

b) in clause (

b) by striking out "12.25%" and

substituting "12.20%".
