BRUCE FITCH M. BRUCE FITCH BILL Gift Card Expiry Act Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as fol- lows: 1 The following

definitions apply in this Act. “gift card” means a voucher in any form, including an electronic credit or written certificate, that is issued by a supplier under a gift card agreement and that the holder is entitled to apply towards purchasing goods or services covered by the voucher. (carte-cadeau) “gift card agreement” means a future performance agreement under which the supplier issues a gift card to the consumer and in respect of which the consumer makes payment in full when entering into the agreement. ( con- vention de carte-cadeau) “supplier” means a person who is in the business of selling, leasing or trading in goods or services or is other- wise in the business of supplying goods or services, and includes an agent of a supplier and a person who holds him- or herself out to be a supplier or an agent of a sup- plier. (fournisseur) 2(1) No supplier shall enter into a gift card agreement that has an expiry date on the future performance of the agreement.

(gift card) « convention de carte-cadeau »

Convention à exécu- tion différée prévoyant la remise d’une carte-cadeau par le fournisseur au consommateur contre paiement intégral immédiat par ce dernier. (gift card agreement) « fournisseur » Personne qui exerce le métier de four- nir des marchandises ou des services, notamment par vente, location ou échange commercial. Sont visés égale- ment les mandataires du fournisseur et quiconque se fait passer pour un fournisseur ou un mandataire de fournis- seur. (supplier) 2(1) Nul fournisseur ne doit conclure une convention de carte-cadeau dont l’exécution différée comporte une date d’expiration. 2 Projet de loi

Loi sur l’expiration des cartes-cadeaux 2(2) A gift card agreement with an expiry date on its fu- ture performance shall be effective as if it had no expiry date if the agreement is otherwise valid. 3(1) No supplier under a gift card agreement shall (

a) issue a gift card for less than the value of the pay- ment made by the consumer for entering into the agree- ment or hold out that the supplier can provide such a gift card, or (

b) charge a fee to the holder of a gift card for any- thing in relation to the card, other than a fee for replac- ing a lost or stolen gift card or a fee to customize a gift card. 3(2) If a supplier has charged a fee in contravention of paragraph (1)(b), the holder of the gift card who paid the fee may demand a refund within one year after making the payment. 3(3) A supplier who receives a valid demand under sub- section (2) shall provide the refund within 15 days of re- ceiving the demand. 4 A gift card agreement shall set out the following infor- mation: (

a) the fees that the supplier may charge under para- graph 3(1)(b); (

b) all restrictions, limitations and conditions that the supplier imposes on the use of the gift card. 5 This Act does not apply to a gift card that a supplier issues for a charitable purpose or a gift card agreement un- der which a gift card is issued for a charitable purpose. 6 This Act applies to every gift card agreement entered into on or after the day this Act comes into force and to ev- ery gift card issued under that agreement. 7 This Act comes into force on a day to be fixed by proclamation. 2(2) Si elle est par ailleurs valide, toute convention de carte-cadeau dont l’exécution différée comporte une date d’expiration a les mêmes effets que si elle n’en avait pas. 3(1) Il est défendu à un fournisseur lié par une conven- tion de carte-cadeau :

a) de délivrer une carte-cadeau de valeur inférieure à la somme que le consommateur a payée en contrepar- tie, ou de laisser croire qu’il peut délivrer une telle carte-cadeau;

b) de faire payer des frais au porteur de la carte- cadeau, sauf pour remplacer une carte-cadeau perdue ou volée ou la personnaliser. 3(2) Si un fournisseur a fait payer des frais en violation de l’alinéa (1)b), le porteur qui les a payés peut en récla- mer le remboursement dans les douze mois qui suivent le paiement. 3(3) Le fournisseur a quinze jours, sur réception d’une réclamation valide formée en vertu du paragraphe (2), pour s’exécuter. 4 La convention de carte-cadeau comporte les rensei- gnements suivants :

a) les frais que le fournisseur peut faire payer en vertu de l’alinéa 3(1)b);

b) les restrictions, limitations et conditions aux- quelles le fournisseur assujettit l’usage de la carte- cadeau. 5 La présente loi ne s’applique pas à une carte-cadeau délivrée par un fournisseur à des fins caritatives ni à la convention de carte-cadeau la régissant. 6 La présente loi s’applique à toute convention de carte- cadeau conclue à partir de l’entrée en vigueur de la pré- sente loi ainsi qu’aux cartes-cadeaux délivrées dans le ca- dre de ces conventions. 7 La présente loi entre en vigueur à la date fixée par proclamation.
