Oil and Gas Conservation Act

OIL AND GAS CONSERVATION RULES AMENDMENT REGULATION

section 10(1)(g), (h), (i), (k), (o), (gg), (hh), (ii) and (aaa) of the Oil and

Gas Conservation Act.

1 The Oil and Gas Conservation Rules (AR 151/71) are

amended by this Regulation.

2 The following is added before

section 11.110:

11.104 Notwithstanding sections 3.050, 3.051, 3.060, 4.021,

4.030, 4.040, 7.025, 10.060, 11.010, 11.102 and 11.145, if the

Regulator is satisfied that it is appropriate to do so, the Regulator

may, on its own motion, issue a subsurface order that

(

a) designates a zone in a specific geographic area, and

(

b) prescribes requirements pertaining to spacing, target areas,

multi-zone wells, allowables, production rates and other

subsurface matters within that zone,

in which case if there is a conflict or inconsistency between the

subsurface order and any of the sections referred to above, the

subsurface order prevails to the extent of the conflict or

inconsistency.

1 The Potato Growers of Alberta Commission Regulation

(AR 277/98) is amended by this Regulation.

Section 8 is amended

a) in subsection (1)(

a) by striking out "$0.06" and

substituting "$0.07";

(

b) in subsection (1.1)

(

i) in clause (

a) by striking out "$22.00" and

substituting "$25.00";

(ii) in clause (

b) by striking out "$30.00" and

substituting "$35.00".

3 This Regulation comes into force on August 1, 2015.

Environmental Monitoring Program constitutes a fee charged in

respect of a right to explore for or exploit an oil sands mineral

deposit.

clause (d.05) and Item 9.05 respectively into

Part 2 of

Schedule 2 to the regulations being amended, are deemed

to have come into force on January 1, 2015.

Family Law Act

CHILD SUPPORT RECALCULATION PROGRAM (MANDATORY

CLAUSES) AMENDMENT REGULATION

1 The Child Support Recalculation Program Regulation

(AR 287/2009) is amended by this Regulation.

Section 1(b)(

i) is amended by striking out "section 5(5)"

and substituting "section 5(4)".

3 The following is added after

section 1:

Child support orders - mandatory clauses

1.1(1) For the purposes of

section 55.12 of the Act, the court shall

include one of the following mandatory clauses in every child

support order:

(

a) This Order may be recalculated by the Alberta Child Support

Recalculation Program ("the Recalculation Program") based

on its anniversary date if eligible for recalculation and if the

Recalculation Program determines recalculation is

permissible and appropriate pursuant to the Family Law Act

and regulations. Either party may apply to register with the

Recalculation Program at 8th Floor, 10365-97 Street,

Edmonton, Alberta T5J 3W7, telephone 780-401-1111,

(website: www.recalculation.alberta.ca). Should either party

fail to comply with the income disclosure requirements of the

Recalculation Program, then the income of that party may be

automatically deemed to have increased as set out in

section

55.51 of the Family Law Act.

(

b) This Order shall not be recalculated by the Alberta Child

Support Recalculation Program.

(2) If an order made after March 1, 2015 fails to include one of the

mandatory clauses set out in subsection (1), the order is deemed to

include subsection (1)(a).

Section 5 is amended

(

a) in subsection (2)

(

i) by adding "and

section 1.1(2)" after

"Notwithstanding subsection (1)";

(ii) by repealing clause (

b) and substituting the

following:

(

b) the child support order was made on a basis that is

stated to be "without prejudice" or "predisclosure"

and the order does not state that the recalculation

program may recalculate the child support,

(iii) by repealing clause (

d) and substituting the

following:

(

d) the recalculation of the amount of child support

specified in the child support order shall be based

on income information not included in

section 11.

(

b) by repealing subsections (4) and (5) and

substituting the following:

(4) Where a child support order made before January 1, 2010

and registered with the recalculation program before March 1,

2015 specifies a date for the annual recalculation of the amount

of child support, or a date by which the parties must exchange

income information for the purposes of recalculation, the

anniversary date of the order for the purposes of this

Regulation is

(

a) in the case of a date specified for the purpose of annual

recalculation of the amount of child support set in the

order, the date specified in the order, or

(

b) in the case of a date specified by which the parties must

exchange income information for the purpose of

recalculation, 60 days after the date specified in the

order.

Section 20 is amended by striking out "January 1, 2019"

and substituting "January 1, 2020".

Alberta Regulation 17/2015

Safety Codes Act

PERMIT AMENDMENT REGULATION

section 65 of the Safety Codes Act.

1 The Permit Regulation (AR 204/2007) is amended by this

Regulation.

Section 1(1) is amended by adding the following after

clause (s):

(s.1) "sheet metal worker" means a person who holds a trade

certificate or equivalency in the sheet metal worker trade

acceptable under the Apprenticeship and Industry Training

Act;

Section 2(

b) is amended by striking out "Elevating Devices,

Passenger Ropeways and Amusement Rides Permit Regulation

(AR 286/2002)" and substituting "Elevating Devices, Passenger

Ropeways and Amusement Rides Permit Regulation (AR 28/2012)".

Section 13(1) is amended by adding the following after

clause (f):

(

g) a certified journeyperson sheet metal worker if the permit is

for the replacement of a furnace in a single family residential

dwelling including, if applicable, the replacement of the gas

piping downstream of the shut-off valves for the furnace.

Section 19 is repealed and the following is substituted:

Permit information

19(1) A permit issuer shall, on request, provide an Administrator or

the Council with permit information for use in an information

system.

(2) The Administrator or the Council may disclose the permit

information in accordance with

section 63 of the Act.

Section 20 is amended by adding "and any information

required to be included with the application" after "An application for

a permit".

Section 23 is amended by striking out "perform minor

repairs" and substituting "effect minor repairs".

Section 24(

e) is amended by striking out ", or otherwise

identified," and substituting "or readily available".

Section 29 is amended by striking out "January 31, 2015"

and substituting "January 31, 2017".

10 The following provisions are amended by adding "or

intends to reside" after "resides":

section 7(2)(b);

section 9(1)(d);

section 13(1)(b);

section 15(1)(b);

section 17(1)(c).
