APPENDIX C

ORDER

1 In this Order, "annexed land" means the land described in Appendix A and

shown on the sketch in Appendix B.

2 For the purpose of taxation in 2009 and in each subsequent year up to and

including 2024, the annexed land and the assessable improvements to it

(

a) must be assessed by the Town of Blackfalds on the same basis as if they had

remained in Lacombe County, and

(

b) must be taxed by the Town of Blackfalds in respect of each assessment class

that applies to the annexed land and the assessable improvements to it using

the tax rate established by Lacombe County.

3(1) Where in any taxation year, a portion of the annexed land

(

a) becomes a new parcel of land created

(

i) as a result of subdivision,

(ii) as a result of separation of title by registered plan of subdivision, or

(iii) by instrument or any other method that occurs at the request of or on

behalf of the landowner,

(

b) is redesignated at the request of or on behalf of the landowner under the

Town of Blackfalds Land Use Bylaw, or

(

c) is connected to water or sanitary sewer services provided by the Town of

Blackfalds

section 2 ceases to apply at the end of that taxation year in respect of that portion

of the annexed land and the assessable improvements to it.

(2) Notwithstanding subsection 3(1)(a),

section 2 does not cease to apply if the

subdivision is the separation of an existing farmstead from a previously

unsubdivided quarter section.

(3) If under this

section

section 2 ceases to apply to a portion of the annexed land in

a taxation year, that portion of the annexed land and the assessable improvements to it

must be assessed and taxed for the purposes of property taxes in the following year in

the same manner as other property of the same assessment class in the Town of

Blackfalds is assessed and taxed.

APPENDIX C

ORDER

1 In this Order,

(a) "annexation area" means the land described in Appendix A and shown on

the sketch in Appendix B;

(b) "effective date" means the date on which this Order in Council is signed by

the Lieutenant Governor in Council;

(c) "farm property" means

(

i) a farmstead,

(ii) the parcels of land remaining after the separation of a farmstead to

create a farmstead title,

(iii) a parcel of land used for the raising, production and sale of agricultural

products pursuant to

section 1(

i) of the Matters Relating to Assessment

and Taxation Regulation (AR 220/2004) or any successor legislation,

and

(iv) a farm building as defined in the Matters Related to Assessment and

Taxation Regulation (AR 220/2004) or any successor legislation;

(d) "farmstead" means a parcel of land that

(

i) encompasses a habitable dwelling that has existed on the parcel for a

minimum of ten (10) years,

(ii) has a maximum area not exceeding one quarter section, and

(iii) is located on land used for the raising, production and sale of

agricultural products;

(e) "triggering event" means, with respect to a parcel of land, the occurrence, at

the request of or on behalf of the landowner, of any of the following on or

after the effective date:

(

i) the Town of Chestermere Council, pursuant to the Land Use Bylaw in

effect at the time for the Town of Chestermere, approves an application

for redesignation of the parcel to a land use other than agricultural or

urban reserve (or its equivalent), or to a land use other than that

permitted by the land use designation that is in effect for the parcel on

the effective date;

(ii) the parcel of land is subject to a local improvement bylaw providing for

a local improvement project which results in the connection of

improvements on the parcel of land to the Town of Chestermere's water

or sanitary sewer services;

(iii) improvements on the parcel of land are otherwise directly connected to

the Town of Chestermere's water or sanitary sewer services;

(iv) the parcel of land is the subject of a subdivision or separation of title,

whether by registered plan of subdivision, by instrument or by any

other method whereby a new parcel of land (including the residual

parcel) is created, except where the parcel of land contains a farmstead

prior to the subdivision or separation of title.

2 Lands and improvements within the annexation area, other than farm property,

will be assessed by the Town of Chestermere on a market value basis and will be

taxed at the lowest applicable mill rate of either the Municipal District of Rocky View

No. 44 or the Town of Chestermere until the earlier of

(

a) the occurrence of a triggering event, and

(

b) December 31, 2023.

Thereafter, the lands and improvements within the annexation area will be subject to

taxation at the same rate as other land and improvements within the Town of

Chestermere.

3(1) Farm property within the annexation area

(

a) must be assessed by the Town of Chestermere on the same basis as if the

farm property had remained in the Municipal District of Rocky View No.

44, and

(

b) must be taxed by the Town of Chestermere in respect of each assessment

class that applies to the annexed land and the assessable improvement to it

using the lower of

(

i) the municipal tax rates established by Municipal District of Rocky

View No. 44, and

(ii) the municipal tax rates established by the Town of Chestermere,

for a period of thirty (30) years. At the expiry of the thirty (30) year period,

farm property will be subject to taxation at the same rate as other land and

improvements within the Town of Chestermere.

(2) Notwithstanding subsection (1), any applicable exemption under

section 22 of

the Matters Related to Assessment and Taxation Regulation (AR 220/2004) shall

continue to apply to farm property within the annexation area, as if the farm property

had remained in the Municipal District of Rocky View No. 44, for a period of 30

years. At the expiry of the 30-year period, or at such earlier time as the exemption is

discontinued or becomes inapplicable under the Municipal Government Act or its

regulations, farm property within the annexation area will be subject to taxation at the

same rate as other land and improvements within the Town of Chestermere.

4 The Town of Chestermere shall pay to the Municipal District of Rocky View

No. 44:

SCHEDULE 1

ORDER

1 In this Order,

(a) "former area of the village" means the land in the Village of Thorhild

before dissolution;

(b) "receiving municipality" means The County of Thorhild No. 7;

(c) "village" means the Village of Thorhild.

2(1) On the dissolution of the Village of Thorhild and until changed at the

organizational meeting held subsequent to the 2010 general election of the receiving

municipality,

(

a) the council of the receiving municipality consists of 6 councillors, and

(

b) as a transitional measure, the Minister shall, by order, appoint the

councillor for electoral ward 6 before May 1, 2009.

(2) Until the organizational meeting held subsequent to the 2010 general election,

the former area of the village is established as a ward of the receiving municipality

known as electoral ward 6 and is described in

Schedule 2.

(3) The receiving municipality must, prior to the 2010 general election review the

number of councillors council consists of and must pass a bylaw to specify a higher or

lower odd number of councillors within the time specified under

section 144 of the

Municipal Government Act.

(4) The receiving municipality must, prior to the 2010 general election review the

number of wards and the boundaries of the wards within the receiving municipality

and must pass a bylaw that includes a decision available to the council under

section

148 of the Municipal Government Act to establish the number of wards and establish

the boundaries of those wards within the time specified under

section 149 of the

Municipal Government Act.

3(1) The former area of the village is designated as a hamlet to be known as the

Hamlet of Thorhild until the receiving municipality changes the designation in

accordance with

section 59 of the Municipal Government Act.

(2) The boundaries of the Hamlet of Thorhild are described in

Schedule 2.

4 All liabilities of the village, whether arising under debenture or otherwise, and

all assets, rights, duties, functions and obligations of the village are vested in the

receiving municipality and may be dealt with in the name of the receiving

municipality.

5 Bylaws and resolutions of the village continue to apply in the former area of

the village until the bylaws or resolutions are repealed, amended or replaced by the

council of the receiving municipality.

6 If the liabilities of the village exceed the assets of the village, the receiving

municipality may impose an additional tax under

Part 10 of the Municipal

Government Act on property, including linear property as defined in

section 284(1)(

k) of the Municipal Government Act, located in the former area of the village to pay for

those excess liabilities.

7 A reference to the village in any order, regulation, bylaw, certificate of title,

agreement or any other instrument is deemed to be a reference to the receiving

municipality.

8(1) The receiving municipality shall use

(

a) money received from the village on its dissolution, and

(

b) money received from the sale of any of the assets of the village vested in

the receiving municipality under

section 4 that the receiving municipality

sells before December 31, 2014,

to pay or reduce a liability vested in the receiving municipality on the dissolution of

the village, or for projects in the former area of the village.

(2) Any money referred to under this

section must be accounted for separately by

the receiving municipality.

9(1) The employees of the village at its dissolution are deemed to be employees of

the receiving municipality.

(2) All employment records related to the employees referred to in subsection

(1) are transferred to the receiving municipality.

(3) All associated liabilities related to the employees referred to in subsection

(1) are transferred to the receiving municipality.

10(1) For the period January 1, 2009 up to and including March 31, 2009, sections

276, 277 and 278 of the Municipal Government Act, do not apply to the village and

the receiving municipality shall appoint an auditor to complete a review engagement

of all financial transactions of the village for the period January 1, 2009 up to and

including March 31, 2009.

(2) The scope of the review engagement shall be determined in accordance with

the generally accepted auditing standards for municipal governments.

11 Pursuant to

section 14(1)(

e) of the Foreign Ownership of Land Regulations,

the land within the boundaries of the Hamlet of Thorhild is exempt from the operation

of the Regulations.

12 The Minister may decide any other matter relating to the rights, obligations,

liabilities, assets or any other thing in respect of the village resulting from the

dissolution of the village.

Notice is hereby given that sixty days from the date of service of this Notice and its

publication in Alberta Gazette, the Minister of Culture and Community Spirit intends

to make an Order that the site known as the:

Merchant Bank of Canada, together with the land legally described as:

Plan 3825P, Block 2, Lots 20 and 21

and municipally located at 4813 - 37 Street in Sedgewick, Alberta be designated as a

Provincial Historic Resource under

Section 20 of the Historical Resources Act, RSA

2000 cH-9.

The reasons for the designation are as follows: The heritage value of Sedgewick's

Merchants Bank of Canada lies in its identity as an early and excellent example of

cast stone concrete block construction, atypical of small town Alberta bank branch

buildings.

Banks built in Alberta's smaller communities prior to the First World War were

typically wood frame structures with flat roofs based on a three-bay plan. The

Merchants Bank of Canada building in Sedgewick, built in 1910, differs markedly

being a wood clad building, the Sedgewick bank distinctively features a cast stone

concrete block superstructure. This heavy use of concrete is unusual for small-town

construction for this period. Concrete construction, both block and poured, was rare in

Alberta prior to the twentieth century. After 1900, concrete was used with greater

frequency, particularly after the establishment of concrete manufacturers in Calgary,

in 1908, and at Exshaw, in 1910. However, while concrete was highly valued for its

durability and fireproofing qualities, it was rarely used in such large quantities due to

the relative difficulty of transporting this heavy material and the wider availability of

wood and brick. Consequently, concrete was used most frequently for basements and

foundations, but not for other structural components. Sedgewick's Merchants Bank of

Canada building is significant in that it is an early example of concrete being used as

the predominant structural material. The cast stone concrete blocks used to build the

Sedgewick Merchants Bank of Canada building were produced by a local company

with sand from nearby Lake Sedgewick. Following common practices used elsewhere

in Canada, the blocks were moulded to resemble rusticated stone. These moulded

blocks cover the majority of the building's four exterior walls, giving the building a

uniform gray colour. These blocks were also used as the base of a fence that enclosed

a rear garden plot and ran along the north side of the lot. Variation in the building's

facades is provided through the use of smooth faced concrete blocks to create belt

courses at the lintel level of the first and second storey windows and at the sill level of

the second storey windows.

Other than the use of concrete as a major construction material, the bank demonstrates

features typical of many small town Alberta banks. It is two-storey structure based on

a three-bay design. The first floor housed the bank while the upper floor contained an

apartment for the bank manager. A doorway to the second floor staircase is located on

the north edge of the front facade, throwing off the otherwise highly symmetrical

design of the building. Although the building is sparsely ornamented, it does

demonstrate some classical detailing, including columns, pilasters, cornices,

pediments, parapets and moulded ornamentation. These features are commonly found

in bank design of this period and were integrated to communicate a sense of stability

and permanence. The building operated as a Merchants Bank of Canada branch until

1921, at which time the parent bank amalgamated with the Bank of Montreal. In

1976, the Bank of Montreal moved its Sedgewick branch into a modern building.

It is therefore considered that the preservation and protection of the resource is in the

public interest.
