Section 1 of the French version of the Private Oc ‐ cupational Training Act,

chapter P-16.1 of the Revised Statutes, 1973, is amended in the definition « organ ‐ isme de formation » by striking out “corporation” and substituting “personne morale”. 1 L’article 1 de la version française de la

3.1(2) No training organization shall enrol students or collect tuition fees from students for an occupational training program or any other fees from students unless the training organization is registered under this Act and authorized to provide the occupational training program. 3.1(2) Aucun organisme de formation ne peut inscrire des étudiants ni percevoir d’eux des frais de scolarité pour un programme de formation professionnelle ou tous autres droits à moins d’être enregistré en vertu de la pré ‐ sente loi et autorisé à offrir celui-ci. 3.1(3) No person shall act as an agent, representative or salesperson of a training organization or canvass, re ‐ ceive, take or solicit contracts for the purchase or sale of an occupational training program unless the training or ‐ ganization providing the occupational training program is registered under this Act and is authorized to provide the occupational training program and the agent, repre ‐ sentative or salesperson is authorized to act as an agent, representative or salesperson under subparagraph 6(3)(b)(ii). 3.1(3) Personne ne peut agir à

Section 4 of the Act is repealed and the following is substituted: 7 L’article 4 de la Loi est abrogé et remplacé par ce qui suit : 4(1) A training organization may apply to the Minister to be registered under this Act in the form and the man ‐ ner established by the Minister. 4(1) Tout organisme de formation peut demander au Ministre, sous la forme et de la manière qu’il exige, d’être enregistré en vertu de la présente loi. 4(2) An application under subsection (1) shall include the information prescribed by regulation and shall be ac ‐ companied by a security in a form acceptable to the Min‐ ister. 4(2) La demande présentée en vertu du paragraphe (1) renferme les renseignements prescrits par règlement et est accompagnée d’un cautionnement en la forme que le Ministre juge acceptable. 8 The Act is amended by adding after

6(1) On receipt of an application for registration, the Minister may register a training organization. 6(1)

a) by repealing subsection (1) and substituting the following:

b) realize or negotiate any security provided by the training organization;

b) exiger l’abandon de tout cautionnement fourni ou négocier tout cautionnement fourni par lui; (

c) require that any tuition fees or other fees paid in advance be refunded;

c) exiger le remboursement des frais de scolarité ou tous autres droits qui lui ont été versés à l’avance; (

d) impose conditions on the registration of the training organization; and

d) assujettir son enregistrement à des conditions; (

e) issue a compliance order.

8.1(2) A training organization shall comply with a compliance order. 8.1(2) L’organisme de formation est tenu de se confor ‐ mer à l’ordre reçu. Review of compliance orders Révision des ordres d’observation 8.2(1) A training organization may request a review of a compliance order in accordance with the regulations. 8.2(1) L’organisme de formation peut demander une révision de l’ordre d’observation conformément aux rè ‐ glements. 8.2(2) Subject to the regulations, the Minister shall es ‐ tablish the procedure to be followed with respect to a re ‐ view requested under subsection (1). 8.2(2)

Administrative penalties Pénalités administratives 8.3(1) If a training organization fails to comply with a compliance order, the Minister may impose on the train ‐ ing organization an administrative penalty established by regulation to be paid to the Minister of Finance and Treasury Board within the time prescribed by regulation. 8.3(1) Le Ministre peut infliger à l’organisme de for ‐ mation qui ne se conforme pas à l’ordre d’observation une pénalité administrative établie par règlement, la ‐ quelle est payable au Ministre des Finances et du Con ‐ seil du Trésor dans le délai fixé par règlement. 8.3(2) A training organization referred to in subsection (1) who pays the administrative penalty shall be deemed to have contravened the provision of this Act or the reg ‐ ulations in respect of which the payment was made and shall not be charged with an offence in respect of the same incident that gave rise to the administrative pen ‐ alty. 8.3(2) L’organisme de formation visé au paragra ‐ phe (1) qui paie la pénalité administrative est réputé avoir contrevenu à la disposition de la présente loi ou de ses règlements pour laquelle il l’a payée et ne peut être poursuivi pour infraction concernant l’inobservation qui y a donné lieu. 8.3(3) If a training organization referred to in subsec ‐ tion (1) does not pay the administrative penalty within the time period prescribed by regulation, the training or ‐ ganization may be charged with an offence under this Act or the regulations in respect of the same incident that gave rise to the administrative penalty. 8.3(3) S’il ne paie pas la pénalité administrative dans le délai fixé par règlement, l’organisme de formation vi ‐ sé au paragraphe (1) peut être poursuivi pour infraction à la présente loi ou à ses règlements concernant l’inobser ‐ vation qui a donné lieu à cette pénalité. 8.3(4) Subject to subsection (3), a training organiza ‐ tion charged with an offence under this Act or the regu ‐ lations is not liable to an administrative penalty in re ‐ spect of the same incident that gave rise to the charge. 8.3(4)
