1 Bill 203 Mr. Dyck BILL 203 2023 FOREIGN CREDENTIAL ADVISORY COMMITTEE ACT (Assented to , 2023) HIS MAJESTY, by and with the advice and consent of the Legislative Assembly of Alberta, enacts as follows:

Definitions 1 In this Act, (a) “Committee” means the Foreign Credential Advisory Committee established under

section 2; (b) “foreign credential” means a diploma, degree or other designation granted to an individual by an educational institution located outside of Canada with respect to a specific academic or vocational field of study; (c) “Minister” means the Minister of Immigration and Multiculturalism; (d) “professional regulatory organization” means an organization incorporated in Alberta by Act to regulate a profession. Advisory committee 2 The Foreign Credential Advisory Committee is established. Mandate 3 The mandate of the Committee is to facilitate the recognition of foreign credentials in Alberta by doing the following: (

a) reviewing legislation and other rules, including those established by professional regulatory organizations, that govern the recognition of foreign credentials in Alberta;

b) evaluating the process in place in other jurisdictions in Canada to advance the recognition of foreign credentials and identifying areas of success; (

c) making recommendations to the Minister in accordance with

section 7 that, in the opinion of the Committee, would make Alberta more prosperous by (

i) improving the process for recognizing foreign credentials in Alberta, and (ii) facilitating the recognition of foreign credentials in specific professions with current and anticipated labour shortages. Rules 4 The Committee may make rules governing the conduct and administration of its affairs. Appointment of members 5(1) Subject to subsection (2), the Lieutenant Governor in Council must appoint no more than 13 members to the Committee in accordance with the following recommendations: (

a) the Minister must recommend at least 1 member, but no more than 4 members; (

b) the Minister of Advanced Education may recommend up to 4 members; (

c) the Minister of Jobs, Economy and Trade may recommend up to 1 member; (

d) the Minister of Health may recommend up to 3 members; (

e) the Minister of Technology and Innovation may recommend up to 1 member.

(2) An individual is eligible to be appointed as a member of the Committee only if they are, at the time of appointment, a resident of Alberta.

(3) The Lieutenant Governor in Council must designate 1 member recommended by the Minister under subsection (1)(

a) as the Chair of the Committee.

(4) The Chair designated under subsection (3) is responsible for ensuring the Committee fulfills its mandate under this Act.

(5) The Minister must provide secretarial support to the Committee for the purpose of fulfilling its mandate under this Act. Remuneration and expense 6 The Lieutenant Governor in Council must set out each of the following in a member’s appointment to the Committee: (

a) the amount of remuneration that may be paid to the member, if any; (

b) each type of expense for which the member may be reimbursed. Report 7(1) The Committee must submit a report to the Minister with its recommendations within 1 year after the day this Act comes into force.

(2) On receiving the report under subsection (1), the Minister must lay a copy of the report before the Assembly as soon as possible if it is then sitting or, if it is not then sitting, within 15 days after the commencement of the next sitting. Coming into force and repeal 8(1) This Act comes into force 3 months after the day on which this Act receives Royal Assent.

(2) This Act is repealed 2 years after the day on which this Act receives Royal Assent.
