An Act to Amend the Elections Act Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, en- acts as follows: 1 Subsection 5(5) of the Elections Act,

chapter E-3 of the Revised Statutes of New Brunswick, 1973, is amended by striking out “, including revis- ing officers, who shall, however, be appointed by the appropriate ex officio revising officer,”. 2 Subsection 51(1) of the Act is amended by striking out “or under the Controverted Elections Act or the Corrupt Practices Inquiries Act,”. 3 The Act is amended by adding after

section 122 the following: SETTING ASIDE AN ELECTION 122.1(1) Within thirty days after an election writ has been returned under

section 96, the following may apply to a judge of The Court of Queen’s Bench of New Brunswick to have the election of a member set aside: (

Loi sur les manoeuvres frauduleuses, ». 3 La Loi est modifiée par l’adjonction, après l’article 122, de ce qui suit : ANNULATION D’UNE ÉLECTION 122.1(1) Dans les trente jours suivant le rapport du bref d’élection en vertu de l’article 96, les per- sonnes suivantes peuvent demander à un juge de la Cour du Banc de la Reine du Nouveau-Brunswick d’annuler l’élection d’un député :

a) une personne qui avait le droit de voter à l’élection dans la circonscription électorale en question; ou

b) a person who was a candidate for election in the relevant electoral district. 122.1(2) An application under subsection (1) may only be brought on the following grounds: (

a) the member was not eligible to be a candi- date for election to the Legislative Assembly; (

b) the electoral procedures set out in this Act and the regulations were not properly followed in a manner that may have altered the outcome of the election; (

c) the member or someone acting on the mem- ber’s behalf contravened or failed to comply with a provision of this Act that is listed in Column I of

Schedule B in a manner that may have altered the outcome of the election; (

d) the member or someone acting on the mem- ber’s behalf contravened or failed to comply with subsection 121(2) or

section 377 of the Criminal Code (Canada) in a manner that may have altered the outcome of the election; (

e) the member or someone acting on the mem- ber’s behalf contravened or failed to comply with a provision of this Act that is listed in Column I of

Schedule B and, having regard to the nature of the contravention or failure complained of and the degree of the member’s personal involve- ment in or responsibility for it, the contravention or failure is sufficiently serious that the mem- ber’s election ought to be set aside; or (

f) the member or someone acting on the mem- ber’s behalf contravened or failed to comply with subsection 121(2) or

section 377 of the Criminal Code (Canada) and, having regard to the nature of the contravention or failure complained of and the degree of the member’s personal involve- ment in or responsibility for it, the contravention or failure is sufficiently serious that the mem- ber’s election ought to be set aside.

d) le député ou une personne agissant en son nom a enfreint ou a omis de se conformer au pa- ragraphe 121(2) ou à l’article 377 du Code Cri- minel (Canada) de sorte que le résultat de l’élec- tion peut avoir été faussé;

e) le député ou une personne agissant en son nom a enfreint ou a omis de se conformer à une disposition de la présente loi qui figure dans la colonne I de l’annexe B et compte tenu de la na- ture de l’infraction ou de l’omission reprochée et dans quelle mesure le député y a personnellement participé ou sa part de responsabilité, l’infraction ou l’omission est suffisamment grave pour que l’élection du député soit annulée; ou

f) le député ou une personne agissant en son nom a enfreint ou a omis de se conformer au pa- ragraphe 121(2) ou à l’article 377 du Code Cri- minel (Canada) et compte tenu de la nature de l’infraction ou de l’omission reprochée et dans quelle mesure le député y a personnellement par- ticipé ou sa part de responsabilité, l’infraction ou l’omission est suffisamment grave pour que l’élection du député soit annulée.

An Act to Amend the Elections Act Bill 7 122.1(3) A person who brings an application un- der this

section shall notify the Chief Electoral Of- ficer in writing as soon as practicable that he or she has done so. 122.1(4) After hearing an application under this section, the judge may (

a) dismiss the application, or (

b) grant the application and make an order set- ting aside the member’s election and declaring the member’s seat vacant. 122.1(5) A judge shall dispose of an application under this

section within six months after the elec- tion writ has been returned under

section 96 or as soon as practicable after that six month period. 122.1(6) An order under paragraph (4)(

b) shall come into effect when the period prescribed by law for appealing the order has expired without the or- der having been appealed. 122.1(7) If an order under paragraph (4)(

b) is ap- pealed within the period prescribed by law for ap- pealing the order, the appeal stays the operation of the order pending the outcome of the appeal. 122.1(8) If the Court of Appeal dismisses an ap- peal of an order under paragraph (4)(

b) or makes such an order in the first instance, the decision of the Court of Appeal shall come into effect when the pe- riod prescribed by law for appealing the decision has expired without the decision having been ap- pealed. 122.1(9) If a decision of the Court of Appeal re- ferred to in subsection (8) is appealed within the pe- riod prescribed by law for appealing the decision, the appeal stays the operation of the decision pend- ing the outcome of the appeal. 122.1(10) An application under this

section or the appeal of a decision of a judge under this

section shall be conducted in accordance with the rules pre- scribed by regulation. 122.1(3) Une personne qui présente une demande en vertu du présent

(4) b) est interjeté dans le délai d’appel pres- crit par la loi, l’appel suspend les effets de l’ordon- nance jusqu’à ce que l’appel soit tranché. 122.1(8) Si la Cour d’appel rejette l’appel d’une ordonnance en vertu de l’alinéa

(4) b) ou si elle rend elle-même une telle ordonnance, la décision de la Cour d’appel entre en vigueur à l’expiration du délai d’appel prescrit par la loi sans qu’un appel de la dé- cision n’ait été interjeté. 122.1(9) Si un appel d’une décision de la Cour d’appel visée au paragraphe (8) est interjeté dans le délai d’appel prescrit par la loi, l’appel suspend les effets de la décision jusqu’à ce que l’appel soit tran- ché. 122.1(10) Une demande en vertu du présent arti- cle ou un appel de la décision d’un juge en vertu du présent

article se fait conformément aux règles pres- crites par règlement.

4 Projet de loi 7 Loi modifiant la Loi électorale 4 The Act is amended by adding the following heading preceding

section 128.1: REGULATIONS 5

Section 128.1 of the Act is amended by adding after paragraph (

a) the following: (a.1) prescribing rules with respect to an appli- cation or an appeal under

section 122.1, Consequential amendments 6(1) The Controverted Elections Act,

chapter C-21 of the Revised Statutes of New Brunswick, 1973, is repealed. 6(2) New Brunswick Regulation 83-2 under the Controverted Elections Act is repealed. 7(1) The Corrupt Practices Inquiries Act, chap- ter C-27 of the Revised Statutes of New Brunswick, 1973, is repealed. 7(2) New Brunswick Regulation 82-149 under the Corrupt Practices Inquiries Act is repealed.

Commencement 8 This Act or any provision of it comes into force on a day or days to be fixed by proclamation. 4 La Loi est modifiée par l’adjonction de la ru- brique suivante avant l’article 128.1 : RÈGLEMENTS 5 L’article 128.1 de la Loi est modifié par l’ad- jonction, après l’alinéa a), de ce qui suit : a.1) prescrivant des règles à l’égard d’une de- mande ou un appel en vertu de l’article 122.1; Modifications corrélatives 6(1) La

chapitre C-27 des Lois ré- visées de 1973 est abrogée. 7(2) Le Règlement du Nouveau-Brunswick 82-149 établi en vertu de la Loi relative aux enquê- tes sur les manoeuvres frauduleuses est abrogé. Entrée en vigueur 8 La présente loi ou l’une quelconque de ses dis- positions entre en vigueur à la date ou aux dates fixées par proclamation.
