Order in Council 974/2008, approved and ordered December 12, 2008.

On the recommendation of the undersigned, the Lieutenant Governor, by and with the advice and consent of the Executive Council, orders that, effective March 1, 2009,

Section 58 (

f) of the Health Professions Amendment Act, 2003 , S.B.C. 2003, c. 57, is brought into force.

Schedule 2 of the Criminal Records Review Act , R.S.B.C. 1996, c. 86, is amended by deleting item 9.

3 The amendments set out in the attached Appendix are made.

Appendix

Crime Victim Assistance Act

Section 2 of the Crime Victim Assistance (General) Regulation, B.C. Reg. 161/2002, is amended

(

a) by repealing paragraph (c), and

(

b) in paragraph (

g) by adding the following:

(viii.1) optometrist; .

Employment and Assistance Act

Schedule C of the Employment and Assistance Regulation, B.C. Reg. 263/2002, is amended in

section 1 by striking out the definition of "optometrist" and substituting the following:

"optometrist" means an optometrist registered with the College of Optometrists of British Columbia established under the Health Professions Act ; .

Employment and Assistance for Persons with Disabilities Act

Schedule C of the Employment and Assistance for Persons with Disabilities Regulation, B.C. Reg. 265/2002, is amended in

section 1 by striking out the definition of "optometrist" and substituting the following:

"optometrist" means an optometrist registered with the College of Optometrists of British Columbia established under the Health Professions Act ; .

Employment Standards Act

Section 31 of the Employment Standards Regulation, B.C. Reg. 396/95, is amended by repealing paragraph (

k) and substituting the following:

(

k) a registrant of the College of Optometrists of British Columbia established under the Health Professions Act , .

Health Care (Consent) and Care Facility (Admission) Act

Section 3 of the Health Care Consent Regulation, B.C. Reg. 20/2000, is amended by repealing paragraph (g).

Health Professions Act

Section 2 (3) of the Health Professions Designation Regulation, B.C. Reg. 270/2008, is amended by adding the following:

c) optometry; .

Insurance Premium Tax Act

Section 1 (

b) of the Approved Plan Regulation, B.C. Reg. 143/2005, is amended by repealing subparagraph (vi).

Pharmacists, Pharmacy Operations and Drug Scheduling Act

8 The Prescribed Health Care Profession Regulation, B.C. Reg. 277/97, is amended by adding the following:

Optometry

4 Optometry is a prescribed health care profession for the purposes of the definition of "practitioner" in

section 1 of the Pharmacists, Pharmacy Operations and Drug Scheduling Act .

Social Services Tax Act

Section 2.20 of the Social Service Tax Act Regulations, B.C. Reg. 84/58, is amended by striking out "authorized to practise optometry under the provisions of the Optometrists Act " and substituting "who is authorized to practise as an optometrist under the Optometrists Regulation".
