CHAPTER

An Act to amend The Intestate Succession Act (Assented to June 22, 1990) Her Majesty, by and with the advice and consent of the Legislative Assembly of Saskatchewan, enacts as follows:

Short title1 This Act may be cited as The Intestate Succession Amendment Act, 1990 . R.S.S. 1978, c.I-13, new

section 4.2 The following

section is added after

section 4.1 of The Intestate Succession Act : Intestate leaving spouse and issue "4.2(1) If an intestate dies leaving a spouse and issue and the net value of the intestate's estate does not exceed $100,000, the estate shall go to the intestate's spouse. "

(2) If the net value of the intestate's estate exceeds $100,000: (

a) the intestate's spouse is entitled to $100,000 from the estate and shall have a charge on the estate for that sum, with le gal interest from the date of the intestate's death; and (

b) of the residue of the estate: (

i) if the intestate dies leaving a spouse and one child, one-half shall go to the spouse; (ii) if the intestate dies leaving a spouse and children, one-third shall go to the spouse. "

(3) If a child of an intestate has died leaving issue and that issue is alive at the date of the intestate's death, the intes tate's spouse shall take the same share of the estate as if the child had been living at that date. "

(4) This

section applies only to the estates of those persons dying on or after the day this

section comes into force". Coming into force3 This Act comes into force on the day of assent.
