Wildlife Act

WILDLIFE AMENDMENT REGULATION

Filed: November 5, 1997

Made by the Lieutenant Governor in Council (O.C. 496/97) and the Minister

of Environmental Protection (M.O. 43/97) pursuant to sections 96 and 97 of

the Wildlife Act and sections 1(

b) and 2 of the Wildlife Regulation (AR

143/97).

1 The Wildlife Regulation (AR 143/97) is amended by this Regulation.

Schedule 1 is amended

(

a) in

section 4(1)(

f) and (

g) by striking out ", unless the spouse

holds a fur dealer permit";

(

b) in

section 12,

(

i) in subsection (1)

(

A) by striking out "521,";

(

B) by adding "in that portion of WMU 521

that is described in subsection (2.1)," after "subsection (2),";

(ii) by adding the following after subsection (2):

(2.1) The portion of WMU 521 that is referred to

in subsection (1) is all of WMU 521 except the portion within the following

boundary:

Commencing at the intersection of highway 34 and

the west boundary of WMU 521; thence easterly along highway 34 to the east

boundary of the Sturgeon Lake Indian Reserve; thence southerly, westerly

and southerly along the Sturgeon Lake Indian Reserve boundary to the west

boundary of the Valleyview Grazing Reserve; thence southerly along the west

boundary of the Valleyview Grazing Reserve until it crosses the WMU 521

boundary; thence westerly and northwesterly along the WMU 521 boundary to

the point of commencement.

3 This Regulation, except

section 2(a), comes into force on July 1, 1998.

Oil and Gas Conservation Act

OIL AND GAS CONSERVATION AMENDMENT REGULATION

Filed: November 5, 1997

Made by the Alberta Energy and Utilities Board pursuant to

section 10 of

the Oil and Gas Conservation Act.

1 The Oil and Gas Conservation Regulations (AR 151/71) are amended by

this Regulation.

Section 16.081 is repealed and the following is substituted:

16.081 For the 1997/98 fiscal year of the Board, an annual

adjustment factor of

(a) 0.67 shall be applied to the administration fees in

section 16.070, and

(b) 1.55 shall be applied to the administration fees in

section 16.080.

Section 16.100 is repealed and the following is substituted:

16.100 For the purpose of

Part 11 of the Act, the prescribed date

for the 1997/98 fiscal year of the Board is January 1,

Section 16.540 is repealed and the following is substituted:

16.540 For the 1997/98 fiscal year of the Board, the abandonment

fund levy is $70 for each inactive well in each class.

DESIGNATION AND TRANSFER OF RESPONSIBILITY

AMENDMENT REGULATION

Made by the Lieutenant Governor in Council (O.C. 519/97) pursuant to

sections 16, 17 and 18 of the Government Organization Act.

1 The Designation and Transfer of Responsibility (AR 398/94) is amended

by this Regulation.

Section 1(8) is amended by striking out "Federal and Intergovernmental"

and substituting "Intergovernmental and Aboriginal".

Section 11 is repealed and the following is substituted:

11 The responsibility for the following enactments is transferred

to the Minister of Intergovernmental and Aboriginal Affairs:

Constitution of Alberta Amendment Act, 1990

Constitutional Referendum Act

International Trade and Investment Agreements

Implementation Act

Metis Settlements Act

Metis Settlements Accord Implementation Act

Metis Settlements Land Protection Act

Senatorial Selection Act

4 The responsibility for the Intergovernmental Affairs Program and the

Aboriginal Affairs Program and that part of the public service under the

administration of the Minister of Federal and Intergovernmental Affairs

including that part employed in the administration of

section 11 and

Schedule 6 of the Government Organization Act and the enactments referred

to in

section 3 is transferred to the Minister of Intergovernmental and

Aboriginal Affairs.

5 The responsibility for the administration of the unexpended balance of

the operating expense supply vote for the 1996-97 Government appropriation

for Federal and Intergovernmental Affairs is transferred to the Minister of

Intergovernmental and Aboriginal Affairs.

6 The Agent-General Administrative Transfer Order (AR 24/93) is repealed.

Wildlife Act

WILDLIFE AMENDMENT REGULATION

Made by the Minister of Environmental Protection (M.O. 44/97) pursuant to

sections 15, 25 and 96 of the Wildlife Act.

1 The Wildlife Regulation (AR 143/97) is amended by this Regulation.

Section 72 is amended

(

a) in subsection (1) by striking out ", subject to subsection

(2),";

(

b) by repealing subsection (2).

Section 99 is amended by adding the following after subsection (2):

(2.1) A person who holds a registered fur management licence for a

registered fur management area, or a person holding a

section 4(1)(d), (e),

(f), (g), (

h) or (

i) exemption with authority to hunt in that area may, if

a portion of the registered fur management area falls within a corridor

wildlife sanctuary,

(

a) trap fur-bearing animals, and

(

b) kill a fur-bearing animal that is caught in a trap,

with or without the use of a firearm,

in the portion of the registered fur management area that falls

within that sanctuary.

Section 121(1) is amended

(

a) in subsection (1)(a), by adding "subject to subsection (1.1),"

before "discharge";

(

b) by adding the following after subsection (1):

(1.1) Subsection (1) does not apply to a person killing a

fur-bearing animal with a firearm pursuant to

section 99(2.1).

Section 152(4) is amended by striking out "1988" and substituting

"1998".
