OIC Text: The Governor in Council on the report and recommendation of the President of the Executive Council dated July 5, 2006, and pursuant to

Section 86 of

Chapter 376 of the Revised Statutes of Nova Scotia, 1989, the Public Service Act,

Section 20 of

Chapter 377 of the Revised Statutes of Nova Scotia, 1989, the Public Service Superannuation Act, and

Section 18 of

Chapter 235 of the Revised Statutes of Nova Scotia, 1989, the

Interpretation Act, and all other authority in him vested, is pleased to, effective June 26, 2006: (

a) revoke the appointment of Heather Foley Melvin as Administrative Assistant and Chief of Staff, Office of the Premier, made by the Governor in Council by Order in Council 2006-131, dated March 13, 2006 and direct that she be entitled to participate in the Province of Nova Scotia Long Term Disability Plan as Chief Administrative Officer of Conserve Nova Scotia; (

b) appoint Robert Chisholm, of Halifax, Halifax Regional Municipality, as Administrative Assistant and Chief of Staff to the Premier, on such terms and conditions as may be approved from time to time by Treasury and Policy Board; (

c) direct that Robert Chisholm shall receive all customary benefits associated with the position of deputy head including participation in the Province of Nova Scotia Long Term Disability Plan; (

d) designate Robert Chisholm to be and to have been an employee for the purposes of the Public Service Superannuation Act; and (

e) order that the Province shall defend, negotiate or settle claims or charges made against Robert Chisholm and indemnify him from personal liability, provided that the Province is satisfied that the claim arises out of his activities in relation to his employment and is not based upon fraud or criminal activity and where the Province so defends him, the Province will be in control of the case.
