B.C. Reg. 129/2008 , deposited June 6, 2008, pursuant to the CORPORATION CAPITAL TAX ACT [Section 48], and the MISCELLANEOUS REGISTRATIONS ACT, 1992 [Section 9]. Order in Council 389/2008, approved and ordered June 6, 2008.

On the recommendation of the undersigned, the Administrator, by and with the advice and consent of the Executive Council, orders the following, effective April 1, 2010:

1 The Corporation Capital Tax Regulation, B.C. Reg. 199/2002, is amended as set out in the Schedule.

Section 7 (

a) of the Miscellaneous Registrations Regulation, B.C. Reg. 81/2004, is amended by striking out " Corporation Capital Tax Act " and substituting " Financial Institutions Minimum Tax Act ".

Schedule

1 The title of the Corporation Capital Tax Regulation, B.C. Reg. 199/2002, is repealed and the following substituted:

FINANCIAL INSTITUTIONS MINIMUM TAX REGULATION.

Section 1 (1) is amended by repealing the definition of "Act" and substituting the following:

"Act" means the Financial Institutions Minimum Tax Act ; .

3 Sections 1 (2) (b), 2 (1) and (2), 3 (2) (b), 5 (1) in the definition of "fee" , and 7 (1) are amended by striking out "financial corporation" wherever it appears and substituting "financial institution".

Section 2 (1) (

a) is amended by striking out "financial corporation's" and substituting "financial institution's".

Section 3 (2) (

a) is amended by striking out "financial corporations" and substituting "financial institutions".

6 The following

section is added:

Prescribed amount for minimum tax

3.1 For the purposes of

section 3.6 (1) of the Act, the amount prescribed is $1 billion.
