An Act to Amend the Crown Lands and Forests Act Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, en- acts as follows: 1

Section 1 of the Crown Lands and Forests Act,

chapter C-38.1 of the Acts of New Brunswick, 1980, is amended by adding the following defini- tion in alphabetical order: “licence of occupation” means a licence of occu- pation issued under

section 26 of the Act; 2

Section 26 of the Act is repealed and the fol- lowing is substituted: 26(1) Subject to any terms, conditions and reser- vations that the Minister considers advisable, the Minister may issue a licence of occupation to any person authorizing that person to occupy and use Crown Lands for a period not exceeding twenty years. 26(2) Notwithstanding subsection (1), the Minis- ter may issue a licence of occupation to any person authorizing that person to occupy and use Crown Lands for such period of time the Minister considers necessary where the occupancy and use are for the purpose of placement of utility poles and anchors. Loi sur les terres et forêts de la Couronne,

chapitre C-38.1 des Lois du Nouveau- Brunswick de 1980, est modifié par l’adjonction de la définition suivante dans l’ordre alphabétique : « permis d’occupation » désigne un permis d’oc- cupation délivré en vertu de l’article 26 de la Loi; 2 L’article 26 de la Loi est abrogé et remplacé par ce qui suit : 26(1)

Sous réserve des modalités, conditions et restrictions qu’il estime à propos, le Ministre peut délivrer à toute personne un permis d’occupation, l’autorisant à occuper et à utiliser les terres de la Couronne pendant vingt ans ou moins. 26(2)

Malgré le paragraphe (1), le Ministre peut délivrer un permis d’occupation autorisant toute personne à occuper et à utiliser des terres de la Cou- ronne pendant la période qu’il estime nécessaire lorsque cette occupation et cette utilisation ont pour but la pose de poteaux et d’ancrages de services pu- blics.

Loi sur les terres et forêts de la Couronne 26(3) The Minister may renew a licence of occu- pation as many times as the Minister considers nec- essary, but the period for which a licence under sub- section (1) may be renewed shall not exceed twenty years. 3 Paragraph 95(1)(

s) of the Act is repealed and the following is substituted: (

s) prohibiting or regulating access to, entry upon, travel upon or use of Crown Lands, includ- ing the issuing of licences of occupation, the is- suing of permits and the imposition of fees; Transitional 4 Where in any Act, other than this Act, or in any regulation, rule, order, by-law, agreement or other instrument or document, reference is made to an authorization to occupy and use Crown Lands, it shall be read, unless the context otherwise re- quires, as a reference to a licence of occupation. Mining Act 5 Subsection 110(4) of the Mining Act,

chapter M-14.1 of the Acts of New Brunswick, 1985, is amended by striking out “right to occupy and use” and substituting “licence of occupation for”. Protected Natural Areas Act 6(1) Paragraph 19(

c) of the Protected Natural Areas Act,

chapter P-19.01 of the Acts of New Brunswick, 2003, is repealed and the following is substituted: (

c) lease, issue a licence of occupation under the Crown Lands and Forests Act or otherwise encumber Crown Lands within a protected natu- ral area. 6(2)

Section 20 of the Act is amended (

a) by repealing paragraph (

e) and substitut- ing the following: 26(3) Le Ministre peut renouveler un permis d’oc- cupation autant de fois qu’il l’estime nécessaire. Ce- pendant, un renouvellement du permis d’occupation prévu au paragraphe (1) ne peut être pour plus de vingt ans. 3 L’alinéa 95(1)

s) interdisant ou réglementant l’accès aux terres de la Couronne, l’entrée ou la circulation sur celles-ci ou l’utilisation qui en est faite, y compris la délivrance de permis ou de permis d’occupation et l’imposition de droits; Disposition transitoire 4 Dans toute loi, autre que la présente loi, ou dans un règlement, une règle, un arrêté, un règle- ment administratif, une entente ou un autre docu- ment, un renvoi à une autorisation d’occuper et d’utiliser des terres de la Couronne est réputé être un renvoi à un permis d’occupation à moins que le contexte ne le suggère autrement.

Loi sur les mines 5 Le paragraphe 110(4) de la

Loi sur les mines,

chapitre M-14.1 des Lois du Nouveau-Brunswick de 1985, est modifié par la suppression de « un droit d’occupation et d’utilisation » et son rempla- cement par « un permis d’occupation ».

Loi sur les zones naturelles protégées 6(1)

Le paragraphe 19c) de la

Loi sur les zones naturelles protégées,

chapitre P-19.01 des Lois du Nouveau-Brunswick de 2003, est abrogé et rem- placé par ce qui suit :

c) concéder à bail des terres de la Couronne, délivrer un permis d’occupation en vertu de la

Loi sur les terres et forêts de la Couronne ou les grever autrement. 6(2) L’article 20 de la Loi est modifié

a) par l’abrogation de l’alinéa e) et son rem- placement par ce qui suit :

e) a licence of occupation granted by the Min- ister under the Crown Lands and Forests Act where the approved use of the lands, as specified in the licence of occupation, is the maintenance, management, repair, rehabilitation or operation of infrastructure located within the boundaries of a protected natural area, (

b) by repealing paragraph (

g) and substitut- ing the following: (

g) a licence of occupation authorizing the oc- cupancy and use of Crown Lands within a Class II Protected Natural Area issued by the Minister under the Crown Lands and Forests Act where the approved use of the lands, as specified in the licence of occupation, is a trail for the carrying on of an outdoor recreational activity. 6(3) Paragraph 22(

e) of the Act is repealed and the following is substituted: (

e) a licence of occupation issued under the Crown Lands and Forests Act and in effect im- mediately before the establishment of the pro- tected natural area;

Loi sur les terres et forêts de la Couronne, si l’usage approuvé des terres, tel qu’indiqué sur le permis d’occupation, est un sentier servant à l’exercice d’activités récréatives de plein air. 6(3) L’alinéa 22e) de la Loi est abrogé et rem- placé par ce qui suit :

e) un permis d’occupation délivré en vertu de la

Loi sur les terres et forêts de la Couronne et qui est valide immédiatement avant l’établisse- ment de la zone naturelle protégée;

Section 1 New definition.

Section 2 The existing provision is as follows: 26(1) Subject to subsection (2), the Minister may authorize any person to occupy and use Crown Lands for a period not ex- ceeding ten years, upon such terms and conditions and subject to such reservations as he considers advisable. 26(2) An authorization under subsection (1) and any extension thereof shall not exceed an aggregate period of ten years. 26(3) Notwithstanding subsections (1) and (2), the Minister may (

a) authorize any person to occupy and use Crown Lands for such period of time as the Minister considers necessary, (

b) renew the authorization under paragraph (

a) as many times as the Minister considers necessary, where the occupancy and use are for the purpose of placement of utility poles and anchors.

Section 3 The existing provision is as follows: 95(1) The Lieutenant-Governor in Council may make regula- tions… (

s) prohibiting or regulating access to, entry upon, travel upon or use of Crown Lands, including the issuing of permits and the imposition of fees;

Article 1 Une nouvelle définition est ajoutée.

Article 2 La disposition actuelle se lit comme suit : 26(1)

Sous réserve des modalités, conditions et restrictions qu’il estime à propos et, sous réserve du paragraphe (2), le Mi- nistre peut autoriser toute personne à occuper et utiliser les terres de la Couronne pendant une période maximale de dix ans. 26(2) Une autorisation visée au paragraphe (1) et toute prolon- gation de cette autorisation ne doit pas dépasser une période de dix ans au total. 26(3) Par dérogation aux paragraphes (1) et (2), le Ministre peut

a) autoriser toute personne à occuper et utiliser des terres de la Couronne pendant la période qu’il estime nécessaire,

b) renouveler l’autorisation accordée en vertu de l’alinéa a) autant de fois qu’il l’estime nécessaire, lorsque cette occupation et cette utilisation ont pour but la pose de poteaux et d’ancrages de services publics.
