HIS MAJESTY, by and with the advice and consent of the Legislative Assembly of the Province of British Columbia, enacts as follows:

Definitions

1 In this Act:

"commercial vehicle" has the same meaning means a commercial vehicle as defined in the Commercial Transport Act that has a gross vehicle weight of more than 8 200 kg ;

"commercial vehicle" means a commercial vehicle as defined in the Commercial Transport Act that has a gross vehicle weight rating of more than 11 793 kg;

"dashboard camera" means a recording device that is capable of continuously recording the view of the road in front of a commercial vehicle through the commercial vehicle's front windshield at all times when the commercial vehicle is operating , and meets the following criteria:

(

a) retains at least 72 hours of recording;

(

b) records at a minimum video format of high-definition video at a resolution of 1080p;

(

c) has night vision capability;

(

d) records at the manufacturer's default settings on the device's local storage; .

"gross vehicle weight" means gross vehicle weight as defined in the Commercial Transport Act .

"gross vehicle weight rating" means gross vehicle weight rating as defined in the Motor Vehicle Act .

Installation and maintenance

(1) An owner of a commercial vehicle must install and maintain a dashboard camera in the commercial vehicle.

(2) If a commercial vehicle is a leased commercial vehicle, the lessee, instead of the owner, must comply with subsection (1).

Operation

3 An operator of a commercial vehicle must ensure that the dashboard camera in the commercial vehicle

(

a) is recording at all times the commercial vehicle is operated, subject to any regulations, and

(

b) is not obstructed or prevented from recording.

Privacy

3.1 Any recording made by a dashboard camera must be collected, used, disclosed, retained and destroyed in accordance with all applicable privacy and security requirements, including the Personal Information Protection Act .

Regulations

4 The Lieutenant Governor in Council may make regulations referred to in

section 41 of the

Interpretation Act .

Commencement

5 This Act comes into force on the date that is six months after the date of Royal Assent by regulation of the Lieutenant Governor in Council .
