Section 1 of the Marshland Infrastructure Mainte ‐ nance Act,

chapter 35 of the Acts of New Brunswick, 2013, is amended by adding the following definition in alphabetical order: 1 L’article 1 de la

Compensation for damages Indemnisation pour dommages subis 14.11(1) The Minister shall compensate a person for damages suffered by virtue of anything done under this Act. 14.11(1) Le ministre indemnise toute personne des dommages subis par suite de tout acte accompli en vertu de la présente loi. 14.11(2) A person claiming compensation under this Act shall deliver to the Minister a written claim setting out full particulars of the claim and the person’s right and title to the compensation. 14.11(2) Quiconque réclame une indemnisation en vertu de la présente loi remet au ministre une demande écrite établissant le détail des dommages qu’il a subis et justifiant son droit et son

titre à cette indemnisation.

Arbitration Arbitrage 14.2(1) If the Minister does not agree with the com ‐ pensation claimed under subsection 14.11(2), the Minis ‐ ter shall offer, within 120 days after receiving the claim, the amount that the Minister considers to be reasonable compensation and, at the same time, give notice to the person claiming compensation that the matter of com ‐ pensation will be submitted to arbitration if the amount of the offer is not accepted within 120 days after the date the person receives the offer. 14.2(1) S’il s’oppose à l’indemnisation qu’une per ‐ sonne réclame en application du paragraphe 14.11(2), le ministre lui offre, dans les cent vingt jours de la récep ‐ tion de sa demande, une indemnité qu’il juge raisonnable tout en l’avisant que, si elle n’accepte pas l’offre dans les cent vingt jours de sa réception, la question de l’indem ‐ nisation sera soumise à l’arbitrage.

14.2(2) In determining what is reasonable compensa ‐ tion referred to in subsection (1), the Minister shall con ‐ sider, among other things, the value of the land having regard to its present use. 14.2(2) Lorsqu’il détermine, au

The Court of Queen’s Bench may extend time limit Prorogation de délai par la Cour du Banc de la Reine 14.21 On an application by the Minister or a person claiming compensation, The Court of Queen’s Bench of New Brunswick may extend the time limit under subsec ‐ tion 14.2(1), either before or after the expiry of the time limit. 14.21 Sur demande du ministre ou de la personne ré ‐ clamant une indemnisation, la Cour du Banc de la Reine du Nouveau-Brunswick peut proroger le délai imparti au paragraphe 14.2(1), soit avant, soit après son expiration. Loi sur l’arbitrage 14.3 The Arbitration Act applies to an arbitration un ‐ der this Act, but, if there is a conflict between a provi ‐ sion of this Act and a provision of the Arbitration Act, the provision of this Act prevails. 14.3 La

Exclusive jurisdiction of arbitral tribunal Compétence exclusive du tribunal d’arbitrage 14.4(1) An arbitral tribunal has exclusive jurisdiction to hear and determine all matters of compensation under this Act, and no court shall intervene in the matter of compensation, except 14.4(1) Le tribunal d’arbitrage a compétence exclusive pour trancher les questions d’indemnisation que prévoit la présente loi, et aucun tribunal judiciaire ne peut inter ‐ venir quant à ces questions, sauf afin : (

a) to assist the arbitration process,

Appointment of arbitral tribunal Nomination d’un tribunal d’arbitrage 14.5(1) Within ten days after the date on which the Minister submits a matter to arbitration, the Minister and the person claiming compensation shall appoint a sole arbitrator. 14.5(1) Dans les dix jours suivant la date à laquelle le ministre soumet la question à l’arbitrage, lui et la per ‐ sonne réclamant une indemnisation nomment un arbitre unique.

14.5(2) If the Minister and the person claiming com ‐ pensation are unable to agree on the appointment of a sole arbitrator within the time period referred to in sub ‐ section (1), an arbitral tribunal consisting of three arbi ‐ trators shall be appointed as follows: 14.5(2) Si le ministre et la personne réclamant une in ‐ demnisation ne peuvent s’entendre sur la nomination d’un arbitre unique dans le délai imparti au paragra ‐ phe (1), trois arbitres sont ainsi nommés pour former un tribunal d’arbitrage : (

a) one by the Minister;

a) and (

b) are unable to agree on the appointment of the chair within 20 days after the appointment of the sec‐ ond arbitrator, The Court of Queen’s Bench of New Brunswick shall appoint the chair on their behalf. 14.5(5) Si les arbitres nommés en application des ali ‐ néas (2)

Fees and expenses of arbitral tribunal Honoraires et frais du tribunal d’arbitrage 14.6(1) If an arbitral tribunal consists of a sole arbitra ‐ tor, the Minister is responsible for the fees and expenses of the arbitral tribunal and any other expenses related to the arbitration. 14.6(1) Si le tribunal d’arbitrage consiste en un arbitre unique, le ministre prend à sa charge ses honoraires et ses frais ainsi que l’intégralité des autres frais connexes. 14.6(2) If an arbitral tribunal consists of three arbitra ‐ tors, 14.6(2) Si le tribunal d’arbitrage se compose de trois arbitres : (

a) the Minister is responsible for

i) the fees and expenses of the chair, (

Decision of arbitral tribunal Décision du tribunal d’arbitrage 14.7 An arbitral tribunal shall make a decision on the matter of compensation within one year after the date on which the Minister submits a matter of compensation to arbitration. 14.7 Le tribunal d’arbitrage rend sa décision dans l’an ‐ née qui suit la date à laquelle le ministre a soumis à l’ar ‐ bitrage la question de l’indemnisation.

Arbitral tribunal may extend the time for making a decision Prorogation du délai par le tribunal d’arbitrage 14.8 An arbitral tribunal may extend the time for mak ‐ ing a decision referred to in

section 14.7 before the ex ‐ piry of the time by giving notice of the extension with reasons to the Minister and to the person claiming com ‐ pensation. 14.8 Le tribunal d’arbitrage peut proroger le délai im ‐ parti à l’article 14.7 avant son expiration en donnant un avis motivé au ministre et à la personne réclamant une indemnisation. Vesting of land; sale or lease of land Dévolution de terrains : vente ou location de terrains 14.9 All land that is owned by the Department of Transportation and Infrastructure and was acquired for the purposes of a marshland infrastructure is vested in the Crown in right of the Province and, despite

section 55 of the Financial Administration Act and any other Act, when the land is no longer required, the Minister, with the approval of the Lieutenant-Governor in Coun ‐ cil, may enter into an agreement for the sale or lease of the land and may convey the land by a deed of convey ‐ ance, lease or other instrument under the Great Seal of the Province and signed by the Minister, and the pro ‐ ceeds of the sale or leasing shall be accounted for as public money or, on the direction of the Lieutenant- Governor in Council, deposited to the credit of the Land Management Fund established under the Public Works Act. 14.9 Tous les terrains appartenant au ministère des Transports et de l’Infrastructure qui ont été acquis pour les besoins d’une infrastructure pour terrain marécageux sont dévolus à la Couronne du chef de la province et, malgré ce que prévoient l’article 55 de la

Loi sur l’admi‐ nistration financière et toute autre loi, lorsqu’un terrain n’est plus nécessaire, le ministre, avec l’approbation du lieutenant-gouverneur en conseil, peut conclure un con ‐ trat pour qu’il soit vendu ou loué à bail et peut le céder par acte de cession, bail ou autre instrument revêtu du grand sceau de la province et de la signature du ministre, le produit de cette vente ou de cette location à bail étant dès lors considéré comme fonds publics ou, sur l’ordre du lieutenant-gouverneur en conseil, porté au crédit du Fonds pour l’aménagement des terres créé par la

Loi sur les travaux publics.
