An Act to Amend the Assignments and Preferences Act Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as fol- lows: 1 Subsection 2(4) of the Assignments and Preferences Act,

chapter A-16 of the Revised Statutes, 1973, is re- pealed. 2

Section 3 of the Act is amended (

a) in subsection (1) by striking out “made under the Bankruptcy Act,

chapter B-3 of the Revised Stat- utes of Canada, 1970, or to a sheriff, or to another as- signee resident within the Province with the consent of the creditors, as hereinafter provided, for the pur- pose of paying rateably and proportionately, and without preference or priority, all the creditors of the debtor their just debts” and substituting “made under the Bankruptcy and Insolvency Act (Canada)”; (

b) by repealing subsection (3); (

c) by repealing subsection (4); (

d) by repealing subsection (7); (

e) by repealing subsection (8). PROJET DE LOI 44 Loi modifiant la

chapitre B-3 des Statuts revisés du Canada de 1970, soit à un shérif, soit à un autre cessionnaire résidant dans la province avec le consentement des créanciers, dans les condi- tions prévues ci-après, aux fins de payer au prorata et sans préférence ni priorité les créances reconnues de tous les créanciers du débiteur, » et son remplacement par « faite en vertu de la

Loi sur la faillite et l’insolva- bilité (Canada),;

b) par l’abrogation du paragraphe (3);

c) par l’abrogation du paragraphe (4);

d) par l’abrogation du paragraphe (7);

e) par l’abrogation du paragraphe (8).

Section 13 of the Absconding Debtors Act,

chapter A-2 of the Revised Statutes, 1973, is repealed. Arrest and Examinations Act 5(1) Subsection 32(1) of the Arrest and Examinations Act,

chapter A-12 of the Revised Statutes, 1973, is amended by striking out “or has made an assignment for the benefit of his creditors under the Assignment and Preferences Act, or brought himself, or been brought under the provisions of any other Act of the Legislature” and substituting “or brought himself or herself, or been brought under the provisions of any Act of the Legisla- ture”. 5(2)

Section 45 of the Act is amended (

a) by repealing subsection (4); (

b) by repealing subsection (5). Creditors Relief Act 6(1)

Section 2.1 of the Creditors Relief Act,

chapter C-33 of the Revised Statutes, 1973, is amended in the definition “enforcement proceeding” by striking out “Arrest and Examinations Act, Assignments and Prefer- ences Act” and substituting “Arrest and Examinations Act”. 6(2) Subsection 2.4(1) of the Act is amended (

a) in paragraph (

a) by adding “or” at the end of the paragraph, and (

b) by repealing paragraph (b). 6(3)

Section 2.6 of the Act is amended by striking out “Arrest and Examinations Act, Assignments and Prefer- ences Act” and substituting “Arrest and Examinations Act”. Landlord and Tenant Act 7 Subsection 43(1) of the Landlord and Tenant Act,

Loi sur les débiteurs en fuite 4 L’article 13 de la

Loi sur les débiteurs en fuite, cha- pitre A-2 des Lois révisées de 1973, est abrogé.

Loi sur les arrestations et interrogatoires 5(1) Le paragraphe 32(1) de la

Loi sur les arrestations et interrogatoires,

chapitre A-12 des Lois révisées de 1973, est modifié par la suppression de « ait effectué une cession dans l’intérêt de ses créanciers en vertu de la

Loi sur les cessions et préférences ou se soit ou ait été soumis aux dispositions de toute autre loi de la Législature » et son remplacement par « ou se soit ou ait été soumis aux dispositions de toute loi de la Législature ». 5(2) L’article 45 de la Loi est modifié

a) par l’abrogation du paragraphe (4);

b) par l’abrogation du paragraphe (5).

Loi sur le désintéressement des créanciers 6(1)L’article 2.1 de la

Loi sur le désintéressement des créanciers,

chapitre C-33 des Lois révisées de 1973, est modifié dans la définition « procédure d’exécution » par la suppression de «

Loi sur les arrestations et interroga- toires,

Loi sur les cessions et préférences » et son remplacement par «

Loi sur les arrestations et interroga- toires ». 6(2)

Le paragraphe 2.4(1) de la Loi est modifié

a) à l’alinéa a), par l’adjonction de «o u» à la fin de l’alinéa; et

b) par l’abrogation de l’alinéa b). 6(3) L’article 2.6 de la Loi est modifié par la suppres- sion de «

Loi sur les arrestations et interrogatoires,

Loi sur les cessions et préférences » et son remplacement par «

Loi sur les arrestations et interrogatoires ».

Loi sur les propriétaires et locataires 7 Le paragraphe 43(1) de la

Loi sur les propriétaires et locataires,

chapitre L-1 des Lois révisées de 1973, est modifié par la suppression de « Lorsqu’une cession est

chapter P-5 of the Revised Stat- utes, 1973, is amended by striking out “an assignee for the general benefit of creditors, a bailiff” and substitut- ing “a bailiff”. Personal Property Security Act 9

Section 1 of the Personal Property Security Act,

chapter P-7.1 of the Acts of New Brunswick, 1993, is amended in the definition “creditor” by striking out “an assignee for the benefit of creditors, an executor” and substituting “an executor”. Workers’ Compensation Act 10 Subsection 72(1) of the Workers’ Compensation Act,

chapter W-13 of the Revised Statutes, 1973, is re- pealed and the following is substituted: 72(1) There shall be included among the debts which under the Winding-up Act and the Trustees Act, are, in the distribution of the property in the case of death or in the distribution of the assets of a company being wound up under those Acts respectively, to be paid in priority to all other debts, the amount of any assessment the liability whereof accrued before the date of the death, or before the date of the commencement of the winding-up, and those Acts shall have effect accordingly.

chapitre P-5 des Lois révisées de 1973, par la sup- pression de « ni à un cessionnaire agissant au profit de la masse des créanciers, ni à un huissier » et son rem- placement par « ni à un huissier ».

Loi sur les sûretés relatives aux biens personnels 9 L’article 1 de la

Loi sur les sûretés relatives aux biens personnels,

chapitre P-7.1 des Lois du Nouveau- Brunswick de 1993, est modifié dans la définition « créancier » par la suppression de « d’un cessionnaire au profit des créanciers, d’un exécuteur testamentaire » et son remplacement par « d’un exécuteur testamentaire ».

Loi sur les accidents du travail 10 Le paragraphe 72(1) de la

Loi sur les accidents du travail,

chapitre W-13 des Lois révisées de 1973, est abrogé et remplacé par ce qui suit : 72(1) Dans les créances qui, en application de la

Loi sur la liquidation des compagnies et de la

Loi sur les fiduciai- res, entrent respectivement dans la répartition des biens en cas de décès ou dans la répartition des actifs d’une com- pagnie en liquidation en application de ces lois, et doivent être payées en priorité sur toutes les autres créances, on doit inclure le montant de toute cotisation constituant une obligation née avant la date du décès ou avant la date du début de la liquidation, et ces lois portent effet en consé- quence. Entrée en vigueur 11 La présente loi entre en vigueur le 1 er septembre 2005.

An Act to Amend the Assignments and Preferences Act Bill 44 EXPLANATORY NOTES

Section 1 This amendment is consequential on the amendments made in para- graphs (2)(

c) and (

d) of this amending Act.

Section 2 (

a) This amendment is consequential on the amendments made in paragraphs (2)(

c) and (

d) of this amending Act. (

b) This amendment is consequential on the amendments made in paragraphs (2)(

c) and (

d) of this amending Act. (

c) The existing provision is as follows: 3(4) Every assignment for the general benefit of creditors, not made under the Bankruptcy Act,

chapter B-3 of the Revised Statutes of Can- ada, 1970, whether the assignment is or is not expressed to be made un- der or in pursuance of this Act, and whether the debtor has or has not included all his real estate and personal estate, vests the estate, whether real or personal, or part real and part personal, thereby assigned, in the assignee therein named for the general benefit of creditors, and such as- signment and the property thereby assigned is subject to all the provi- sions of this Act, and the provisions hereof apply to the assignee named thereunder. (

d) The existing provision is as follows: 3(7) The debtor may, in the first place, with the consent of a majority of his creditors having claims of one hundred dollars and upwards, computed according to the provisions of

section 16, make a general as- signment for the benefit of his creditors to some person other than the sheriff, and residing in this Province. (

e) This amendment is consequential on the amendments made in paragraphs (2)(

c) and (

d) of this amending Act.

c) Texte de la disposition actuelle : 3(4) Toute cession dans l’intérêt général des créanciers, qui n’est pas faite en application de la

Loi sur la faillite,

chapitre B-3 des Statuts re- visés du Canada de 1970, que la cession soit expressément ou non ef- fectuée en application de la présente loi et que le débiteur y ait inclus ou non tous ses biens réels et personnels, met les biens cédés, réels ou personnels, ou en

partie réels et en

partie personnels, en possession du cessionnaire qui y est nommément désigné dans l’intérêt général des créanciers; cette cession et les biens cédés sont soumis à toutes les dis- positions de la présente loi qui s’appliquent également au cessionnaire nommément désigné sous l’autorité de la présente loi.

d) Texte de la disposition actuelle : 3(7) Le débiteur peut, en premier lieu et avec le consentement de la majorité de ses créanciers titulaires de créances de cent dollars et plus, calculées suivant les dispositions de l’article 16, effectuer une cession dans l’intérêt général de ses créanciers à une personne résidant dans la province, autre que le shérif.
