Section 1 of the Clean Environment Act,

chapter C-6 of the Revised Statutes, 1973, is amended by add ‐ ing the following

definitions in alphabetical order: 1 L’article 1 de la

a) the person who is the owner of or who is in pos ‐ session or control of or has responsibility for a con ‐ taminant found at the site;

b) the person who has released a contaminant on the site or has contributed to its release;

Contaminated sites – designation Lieux contaminés – désignation 4.31(1) If the Minister determines that an area in the Province has concentrations of a contaminant that ex ‐ ceed the limits prescribed in a protocol, standard, policy, guideline or procedure developed or adopted by the Min‐ ister under

4.41(4)

Section 44 of the Registry Act and

section 55 of the Land Titles Act do not apply to the registration of a designation referred to in subsection (2). 4.41(4) Ni l’article 44 de la

section 4.7 have been met, the Minister shall, within 30 days of the determination, register a cer ‐ tificate established by the Minister under

Contaminated sites – potentially responsible persons Lieux contaminés – personnes potentiellement responsables 4.5(1) Subject to subsections (2) and (3) and

section 4.8, the following persons may be held responsible for remediation of a contaminated site: 4.5(1)

e) any person who, at any other time, was the owner, occupier or operator of the site, knowing that the site was contaminated;

4.5(2) A person referred to in paragraph (1)(

g) or (

a) the person directly or indirectly through their employee or by exercising control over or imposing requirements on another person, contaminated the site, and

b) in so doing, failed to exercise due diligence with respect to the site or its contaminants.

Contaminated sites – declaration of responsible parties Lieux contaminés – déclaration des parties responsables 4.6(1) The Minister may, having considered all rele ‐ vant factors, including those prescribed by regulation, declare one or more of the persons referred to in

section 4.5 as the party or parties responsible for remediation of the contaminated site. 4.6(1) Le Ministre peut, après avoir pris en compte tous les éléments pertinents, notamment ceux prescrits par règlement, déclarer une ou plusieurs des personnes visées à l’article 4.5 comme

Contaminated sites – remediation measures Lieux contaminés – mesures d’assainissement 4.7(1) Responsible parties are jointly and severally lia ‐ ble to remediate the contaminated site and any other area that the Minister considers to be impacted by the release and to take any other actions that the Minister considers appropriate, which may include the following: 4.7(1) Les parties responsables sont solidairement res ‐ ponsables de l’assainissement du lieu contaminé et de tout autre endroit que le Ministre estime touché par le déversement et sont tenues de prendre toutes autres me ‐ sures qu’il estime indiquées, notamment : (

a) an investigation of site contamination;

b) site assessment;

c) site monitoring;

c) la surveillance des lieux; (

d) presentation of reports;

d) la présentation de rapports; (

e) site rehabilitation; or

e) la remise en état des lieux; (

f) any other assessment or remedial action required by the Minister or prescribed by regulation.

4.7(2) The remediation and the other measures refer ‐ red to in subsection (1) shall be completed within the time and in the manner prescribed by the protocols, standards, policies, guidelines or procedures developed or adopted by the Minister under

Contaminated sites – agreements respecting limitation of liability Lieux contaminés – accords portant limitation de responsabilité 4.8 If a person who would not normally be responsible for the remediation of a contaminated site under

section 4.5 proposes to become the owner or occupier of the site or to take any other action that may render the person re ‐ sponsible, the Minister may, subject to the conditions as the Minister considers appropriate, enter into an agree ‐ ment with the person limiting the person’s liability for remediation that may reasonably be related to any re ‐ lease that occurred before the person became the owner or occupier of the site or took the action in question. 4.8 Si une personne qui ne serait pas normalement te ‐ nue pour responsable de l’assainissement d’un lieu con ‐ taminé au

Contaminated sites – ministerial protocols, standards, policies, guidelines and procedures Lieux contaminés – normes, politiques, lignes directrices, procédures et protocoles ministériels 4.9(1) The Minister may develop or adopt protocols, standards, policies, guidelines or procedures with respect to contaminated sites, which may address 4.9(1) Le Ministre peut adopter ou élaborer des normes, politiques, lignes directrices, procédures ou pro ‐ tocoles portant sur les lieux contaminés, lesquels peuvent traiter : (

a) criteria for designation and classification of con ‐ taminated sites,

b) the time within which and the manner in which remediation or management of contaminated sites shall be done,

c) the establishment of programs respecting the re ‐ mediation or management of contaminated sites or to prevent site contamination,

d) risk-based assessment, remediation and manage‐ ment of contaminated sites,

e) reports, notices and certificates to be prepared, including their form, content and method of submis ‐ sion,

f) forms to be used, and

g) any other matter that the Minister considers ap ‐ propriate.

section and is, in relation to a dif ‐ ferent set of facts, later charged with an offence under this Act or the regulations, the completed and signed ad ‐ ministrative penalty admission of responsibility form shall, without limiting its admissibility, be admissible in court in relation to sentencing. 32.2(11) Lorsqu’une personne paie une pénalité admi ‐ nistrative conformément au présent
