EXPLANATORY NOTE NOTE EXPLICATIVE Under The Highway Traffic Act , a driver is restricted to driving a motor vehicle equipped with an ignition-interlock device if the person is convicted of certain alcoho l-related offences under the Criminal Code . This Bill makes clear that the police may impound a vehicle being driven in contravention of that restriction. It also clarifie s that a driver may be permitted, when necessary, to drive a vehicle belonging to the driver's employer that is not equipped with an ignition-interlock device.

Sous le régime du Code de la route , les personnes reconnues coupables de certaines infractions au Code criminel liées à l'alcool peuvent conduire seulement un véhicule automobile muni d'un dispositif de verroui llage du système de démarrage. Le présent projet de loi é nonce que les agents de la paix peuvent mettre en fourriè re tout véhicule conduit en contravention de cette restrict ion. Il précise également qu'un conducteur peut se voir permettre, au besoin, de conduire un véhicule qui appartient à son employeur et qui n'est pas muni d'un tel dispositif .

a) by replacing the

section heading with " Offence and penalty — suspended and other prohibited driving "; and (

a) issued for the purpose of subsection (1.2) may permit the licence holder to drive a motor vehicle, in the course of the holder's employment, that is owned, leased or rented by the employer and is not equipped with an approved ignition-interlock device if the registrar is satisfied that permitting the h older to drive it is necessary for him or her to be employed; and (

b) issued for the purpose of subsection (1.3) may permit the licence holder to drive a motor vehicle that is owned, leased or rented by the holder's employer and is not equipped with an approved ignition-interlock device if the appeal board has given the holder that permission. a) drive a motor vehicle contrary to the requirements of the ignition-interlock program; (

b) drive a motor vehicle that is equipped with an approved ignition-interlock device that is not functioning properly or has been tampered with, interfered with or disabled; or (

c) drive a motor vehicle that is not equipped with an approved ignition-interlock device except in such circumstances as the licence permits. Permis restreint — conduite interdite 279.1(5) Le titulaire d'un permis restreint ne peut :

Driving without restricted licence prohibited 279.1(5.1) When subsection (1.2) or (1.3) and the regulations limit the registrar to issuing only a restricted licence to a person, the person must not drive a mot or vehicle unless the person holds a valid restricted licence.

Application of subsection 225(5) to contraventions 279.1(5.2) Subsection 225(5) (offence and penalty) applies to a person who contravenes subsection (5) or (5.1).
