EXPLANATORY NOTE The Bill provides for the direct election of the chair of The Regional Municipality of Sudbury by a vote of the electors of the area municipalities held concurrently with the regular election in the area municipalities. An Act to amend certain statutes with respect to The Regional Municipality of Sudbury Her Majesty, by and with the advice and con- sent of the Legislative Assembly of the Prov- ince of Ontario, enacts as follows: R EGIONAL MUNICIPALITIES ACT 1. (1) Subsection 6 (4) of the Regional Municipalities Act , as re-enacted by the Stat- utes of Ontario, 1997,

chapter 11,

section 4, is repealed and the following substituted:

(4) This

section does not apply to the regional municipalities of Hamilton-Went- worth, Ottawa-Carleton, Sudbury and Water- loo and subsection (2) does not apply to The Regional Municipality of Niagara. (2) Subsection 9 (11) of the Act, as re- enacted by the Statutes of Ontario, 1997, chap- ter 11,

section 4, is repealed and the following substituted: (11) Subsections (1), (2) and (3) do not apply to the regional municipalities of Hamilton-Wentworth, Ottawa-Carleton, Sud- bury and Waterloo, subsections (6), (7), (8) and (9) do not apply to the regional municipal- ities of Niagara and Ottawa-Carleton and sub- section (10) does not apply to The Regional Municipality of Ottawa-Carleton. R EGIONAL MUNICIPALITY OF SUDBURY ACT 2. The Regional Municipality of Sudbury Act is amended by adding the following section: 5.

(1) The chair of the Regional Council shall be elected by general vote of the electors of the area municipalities to be held concur- rently with the regular election in the area municipalities.

(2) A person is qualified to hold office as chair if, (

a) the person is entitled to be an elector under

Loi sur la municipalité régionale de Sudbury est modifiée par adjonction de l’arti- cle suivant : 5.

(1) Le président du conseil régional est élu au scrutin général par les électeurs des municipalités de secteur, lequel se tient en même temps que l’élection ordinaire dans les municipalités de secteur.

(2) A les qualités requises pour occuper le poste de président la personne qui :

b) the person is not disqualified by this or any other Act from holding the office.

(3) Nominations for the office of chair shall be filed with the clerk of the Regional Corpo- ration who shall send the names of the candi- dates to the clerk of each area municipality by registered mail within 48 hours after the clos- ing of nominations.

(4) The clerk of the Regional Corporation shall be responsible for conducting the elec- tion of the chair except for the recording of the vote in an area municipality which shall be the responsibility of the clerk of each area municipality.

(5) The clerk of each area municipality shall promptly report the vote recorded to the clerk of the Regional Corporation who shall prepare the final

summary and announce the result of the vote.

(6) Despite this Act or the Municipal Elec- tions Act, 1996 , the Minister may by regu- lation provide for those matters that, in the opinion of the Minister, are necessary or expe- dient to conduct the election of the chair.

(7) If there is a conflict between a regu- lation made under subsection (6) and this Act or the Municipal Elections Act, 1996 , the regulation prevails.

(8) If a vacancy occurs in the office of chair, sections 45, 46 and 47 of the Municipal Act apply with necessary modifications to the filling of the vacancy as though that office were the office of mayor.

(9) If a member of the council of an area municipality becomes chair as a result of a vacancy being filled, that person shall be deemed to have resigned as a member of the council and the person’s seat on the council thereby becomes vacant. C OMMENCEMENT AND

SHORT TITLE 3. This Act comes into force on the day it receives Royal Assent. 4. The

short title of this Act is the Regional Municipality of Sudbury Statute Law Amend- ment Act, 1997. lors de l’élection des membres du con- seil d’une municipalité de secteur;

(3) Les déclarations de candidature au poste de président sont déposées auprès du secrétaire de la Municipalité régionale, qui fait parvenir le nom des candidats au secré- taire de chaque municipalité de secteur, par courrier recommandé expédié dans les 48 heures qui suivent la clôture du dépôt des dé- clarations de candidature.

(4) Le secrétaire de la Municipalité régio- nale est chargé de la tenue de l’élection du président, sauf en ce qui a trait à l’enregistre- ment du scrutin dans les municipalités de sec- teur, cette responsabilité relevant du secrétaire de chaque municipalité de secteur.

(5) Le secrétaire de chaque municipalité de secteur fait promptement rapport du scrutin enregistré au secrétaire de la Municipalité ré- gionale, qui prépare la compilation définitive et annonce les résultats du scrutin.

(6) Malgré la présente loi ou la Loi de 1996 sur les élections municipales , le ministre peut, par règlement, prévoir les questions qui, à son avis, sont nécessaires ou utiles à la tenue de l’élection du président.

(7) En cas d’incompatibilité entre un règle- ment pris en application du paragraphe (6) et la présente loi ou la Loi de 1996 sur les élec- tions municipales, le règlement l’emporte.

(8) En cas de vacance du poste de prési- dent, les articles 45, 46 et 47 de la

Loi sur les municipalités s’appliquent, avec les adapta- tions nécessaires, au choix d’un président comme s’il s’agissait du poste de maire.

(9) Si un membre du conseil d’une munici- palité de secteur devient président par suite de la vacance de ce poste, il est réputé avoir démissionné comme membre de ce conseil et son siège au conseil devient alors vacant. E NTRÉE EN VIGUEUR ET

TITRE ABRÉGÉ 3. La présente loi entre en vigueur le jour où elle reçoit la sanction royale. 4. Le
