EXPLANATORY NOTE NOTE EXPLICATIVE This Explanatory Note was written as a reader’s aid to Bill 175 and does not form part of the law. Bill 175 has been enacted as

Chapter 24 of the Statutes of Ontario, 2009.

The Bill sets ou t a Labour Mobility Code (in

Part II) th at must be complied with by all Ontario regulatory authorities. A regu- latory au thority is an individual or body th at is authorized b y law to grant au thorizing certificates to individ uals for one o r more occupatio ns. An author izing cer tificate is a docum ent, regardless of its form or its na me, that at tests to an ind ividual being qualified to practise an o ccupation and authorizes th e individual to practise the occupation or use a title or designation relating to the occupation.

A d ocument that attests to an ind i- vidual being qualified to practi se an occupatio n but does not authorize the practice of the o ccupation or the use of a ti tle or designation relating to the occupation can also be an authorizing certificate if a regulation is made naming the occupation and the regulatory authority issuing the document.

The Ontario regulatory authorities to which the Labour Mobility Code applies are those listed in Column 3 of Table 1 at th e end of the Bill. They grant authorizing certificates under the statutes set out in Column 2 of Table 1. Table 1 may be amended by regulation from time to time to add or r emove Ontario regula- tory authorities.

The Colleg es of the health pr ofessions gov- erned b y the Regulated Hea lth Professions Act, 1991 are no t listed in Table 1, but are made subject to similar labour mobility rules through amendments mad e to th e Regulated Health Pro- fessions Act, 1991 itself.

The Labour Mobility Code prohibits Ontario regulatory authori- ties from requ iring individuals to reside in Ontario as a condi- tion of certification, if th e applican ts reside in a province o r territory that is a party to the Agreement on Internal Trade.

An Ontario regulatory authority that is a municipality is also prohib- ited from requ iring individuals to reside within the geographic area of th e m unicipality as a condition of eligibility for em- ployment by the municipality, if the individuals reside in a prov- ince or t erritory that is a par ty to the Agreem ent on Intern al Trade.

The Labour Mobility Code also provides that when an individ- ual applies to an Ontario regulatory authority for an authorizing certificate for a regula ted occupation and the in dividual already holds an authorizing certificate for the same o ccupation granted by an out-of-pro vince regulatory authority , the Ontario regula- tory authority shall not require the individual to have, undertake, obtain or undergo any material a dditional training, experience, examinations or assessments as a condition of cer tifying th e individual in Ontario.

An occup ation is defined as a set of jobs which, with som e variation , ar e sim ilar in thei r m ain tasks or duties or in the type of work performed. A regulated occupation is an occup ation for which an Ontario regulator y authority grants a specific authorizing certi ficate under

an Act. An out- of-province regulatory authority is a regulatory authority of any party to the Agreement on Internal Trade other than Ontario.

The Labour Mobility Code contains the following exceptions to the rule ag ainst imposing materi al additional training , exp eri- ence, ex aminations or as sessments.

(1) An Ont ario regu latory authority is not prohibited fro m imposing on the applicant an y requirement that is identifi ed on the website of the Ministr y of Training, Coll eges and Universities as a perm issible cer tifica- Le Code de m obilité de la main-d’oeuvre comprend des ex cep- tions en ce qui concerne l’ imposition d’exigences significatives de formation, d ’expérience, d’examens ou d’évaluations sup- plémentaires à l’auteur de la demande.

tion requir ement for the regulated occupation adopted b y th e Government of Ontario under

Article 708 of th e Agreement on Internal Trade.

(2) An Ontario r egulatory authority is not pro- hibited from requiring th e applicant to d emonstrate proficiency in English or in French if equivalent proficien cy in the language was not a condition of certificati on of the applicant b y the out- of-province r egulatory authority.

(3) An Ontario regu latory authority is not prohibited from requiring the applicant to under- take, obtain or undergo material additional training, experience, examinations or as sessments if the app licant ha s not practis ed the regulated occupation within a period of time fixed b y th e Ontario regulatory authority, before submitting his or her appl i- cation for certification to the Ontario regulatory authority.

The L abour Mo bility Cod e clar ifies th at i t does not prohibi t Ontario regulatory authorities from requiring that the app licant pay an application or processing fee; obtain malpractice or other insurance or similar protection; post a bond; undergo a criminal background check; provide evidence of good character; provide confirmation of good standing from ever y out-of-province regu- latory authority by which the applicant is certified; demonstrate knowledge of matters applicable to the practice of the regulated occupation in Ontario; or meet any other requirement specified by the Ontario regulatory authority that does not involv e mate- rial additional training , exper ience, examinations or as sess- ments.

The Labour Mobility Code also clarifies that an Ontario regula- tory authority may refuse to certify the applicant or may impose terms, condition s or lim itations on the appli cant’s authorizing certificate if, in its opinion, such action is n ecessary to pro tect the public interest as a result of complaints or criminal, discipli- nary or other pr oceedings against the applic ant in any jurisdic- tion relating to his or her competency, conduct or character.

In addition, if the authorizing certificate granted to the applicant by the out-of- province regu latory authority is subjec t to a t erm, condition or limitation , the O ntario r egulatory authority may impose an equivalen t term, condition or limitation on the au- thorizing certificate it grants to t he applicant or, if the Ontar io regulatory authority does not impose an equivalent term, condi- tion or limitatio n on its authorizing cer tificate for that occupa- tion, it may refuse to certify the applicant.

The right of Ontario r egulatory authorities to impose the above requirements and measures on applicants who a re already certi- fied by an out-of-province regulatory authority is subject to the following conditions.

(1) The requirement or measure must not be a disguised restric tion on lab our mobility.

(2) The requir e- ment or m easure must not prev ent the expeditious certification of the individu al.

(3) Any requirement or measure imposed b y the Ontario r egulatory authority on applicants who are certif ied by an out-of-province regulatory authority must be the same as, or substantially similar to but n o more onerous than, th e re- quirement or measure imposed by the Ontario regulatory author- ity on applicants who are not certified b y an out-of-province regulatory authority. However, imposing a higher fee or othe r cost on applicants who are certif ied by an out-of-province regu- latory authority is permitted if that reflects the actual cost differ- ential to the Ontario regulatory authority.

The Labour Mobility Code appl ies to applications for certifica- tion made to an Ontario regulatory authority on or after the day the Bill comes into force and also to appli cations for cert ifica- tion made to an Ontario regulatory authority before the d ay the Bill comes into force if the application has not b een finally de- cided before that day.

The Bill encourages Ontario regulatory authorities, when estab- lishing occupational standards for an occup ation, to make those standards consistent with such common interprovincial or in ter- Le projet de loi encourage toute autorité de réglementation onta- rienne à fair e en sorte que le s normes professionnelles qu’elle établit pour un métier ou une profession soient compatibles avec ii

national occupational standards as may have been developed for the occupation. This does not prevent a r egulatory au thority from establishin g occup ational standards th at it considers ap- propriate to protect the public if its authorizing statute permits it to do so.

In ad dition, every Ontario regulatory authority is re- quired to notify its counterparts in the other provinces and terri- tories of Canada of any new or amended occupational standards that it proposes to adopt and afford them an opportunity to comment on the development of those standards. les normes inter provinciales ou internationales c ommunes qui ont été élaborées pour ce métier ou cette profession.

The Bill provides that the Labou r Mobility Code prevails in the case of a conflict with an Ont ario regulatory authority’s author- izing statute or an instrument of a legislative nature made under that statute.

Ins truments of a legislative nature include but are not limited to regulations, by-laws, rules, directives, guidelines and orders of a legislative nature. The Bill also requires every Ontario regu latory authority, other than a m unicipality, to take such steps as are within its power to amend the instruments of a legislative natur e under i ts auth orizing st atute, if necessar y, so that they conform with the Labour Mobilit y Code, wi thin 12 months after the Bill comes into force.

Table 1 d ivides Ontario regulatory authorities into four catego- ries: (1) non-governmental regu latory authorities operating un- der private A cts, (2) non-governmental r egulatory authorities operating under public Acts, (3) municipal governmental regula- tory authorities, and (4) pr ovincial governmental regu latory authorities. Th e reason for the categorization is that th ere are some differenc es in the enfor cement m echanisms that the Bill provides for the different categories of regulatory authorities.

Every non-governmental regulatory authority will have a moni- tor. Th e monitor for a non-go vernmental regu latory authority operating under a public Act is the Minister who is responsible for the administration of that Act or such oth er person as is des- ignated b y r egulation. The m onitor for a no n-governmental regulatory authority operating under a privat e Act is to be des- ignated b y regul ation. Monitors are a uthorized by th e Bi ll to review th e certification pr actices of their non -governmental regulatory autho rities in ord er t o assess their c ompliance wi th the Labour Mo bility Cod e.

Monitors are al so authorized to request th eir n on-governmental regulatory authorities to do things that th e monitor considers necessar y or advisable fo r implementing, o r carr ying out th e intent and p urposes of, the Labour Mobility Code or a decision of a presiding bod y under the Agreement on Internal Trade.

If a non-govern mental regu latory au thority is requested b y its monitor to take such steps as are within its power to am end an instrument of a legislative nature under its authorizing statute so that it conforms with the Labour Mobility Code, and the regula- tory authority does not com ply with the requ est, the Li eutenant Governor in Co uncil is authorized to amend the instrument in question for th e purpose of ensuring that it conforms with the Labour Mobility Code.

Administrative penalties may be imposed on no n-governmental regulatory au thorities that do no t com ply with a ny r equest b y the monitor relating to the Labo ur Mobility Code or to a deci- sion of a presiding body under the Agreement on Internal Trade. The monitor is required to g ive the regulator y authority notice of the in tent to issue an order imposing an administrative pen - alty and is required to afford the regulatory authority an oppor- tunity to make written submissions with respect to the pro posed order.

In addition, the regulatory authority has a right to require that the Minister of Training, Colleges and Universities or his or her designate review the order imposing the administrative p en- alty.
