B.C. Reg. 309/2010 , deposited October 21, 2010, pursuant to the PORTS PROPERTY TAX ACT [Section 2] and the BUDGET MEASURES IMPLEMENTATION ACT, 2010 [Section 117]. Order in Council 644/2010, approved and ordered October 20, 2010.

On the recommendation of the undersigned, the Lieutenant Governor, by and with the advice and consent of the Executive Council, orders that, retroactive to the extent necessary to apply for the purposes of the 2010 taxation year,

(

a) the Eligible Port Property Designation Regulation, B.C. Reg. 197/2004, is repealed, and

(

b) the attached Eligible Port Property Designation Regulation is made.

1 In this regulation, "Act" means the Ports Property Tax Act .

Interpretation of

Schedule

2 In the Schedule,

(

a) an assessment roll number set out in Column 1 of the

Schedule is the number on the assessment roll prepared by the British Columbia Assessment Authority for the 2010 taxation year, as at December 31, 2009,

(

b) a year set out in Column 2 of the

Schedule opposite an assessment roll number

(

i) is the first year that any property identified by that assessment roll number was designated for the purposes of

section 4 [property tax rate cap on new investment in port facilities] of the Act,

(ii) is listed for ease of reference only, and

(iii) does not affect the effective date of this regulation, and

(

c) the municipality and terminal names set out in Columns 3 and 4 of the

Schedule are listed for ease of reference only and do not affect the designation by assessment roll number.

Designated property

3 The land identified by the assessment roll numbers listed in Column 1 of the Schedule, and the improvements on that land, are designated for the purposes of

(

a) section 3 [property tax rate cap on designated port facilities] of the Act, and

(

b) section 4 [property tax rate cap on new investment in port facilities] of the Act.
