An Act to Amend the Pay Equity Act, 2009 Loi modifiant la Loi de 2009 sur l’équité salariale Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as follows: Sa Majesté, sur l’avis et avec le consentement de l’Assemblée législative du Nouveau-Brunswick, édicte : 1

Section 1 of the Pay Equity Act, 2009,

chapter P-5.05 of the Acts of New Brunswick, 2009, is amended 1 L’article 1 de la Loi de 2009 sur l’équité salariale,

chapitre P-5.05 des Lois du Nouveau-Brunswick de 2009, est modifié (

a) by repealing the definition “employee” and substituting the following:

a) par l’abrogation de la définition d’« employé » et son remplacement par ce qui suit : “employee” means a person employed to do skilled or unskilled manual, clerical, technical or professional work. (employé) « employé » Personne employée pour accomplir un travail manuel spécialisé ou non spécialisé, un travail de bureau ou un travail technique ou professionnel. (em- ployee) (

b) by repealing the definition “employer” and substituting the following:

b) par l’abrogation de la définition d’« em- ployeur » et son remplacement par ce qui suit : “employer” means a person who employs one or more employees. (employeur) « employeur » Personne qui emploie un ou plusieurs employés. (employer) 2

Section 3 of the Act is repealed and the following is substituted: 2 L’article 3 de la Loi est abrogé et remplacé par ce qui suit : 3 The purpose of this Act is to implement pay equity. 3 La présente loi a pour objet la mise en œuvre de l’équité salariale. 3

Section 4 of the Act is amended by adding after subsection (2) the following: 3 L’article 4 de la Loi est modifié par l’adjonction de ce qui suit après le paragraphe (2) : 1

4(3) This Act applies to employees employed outside the Public Service, except for such employees employed by an employer that has less than 10 employees. 4(3) La présente loi s’applique aux employés qui tra- vaillent à l’extérieur des services publics, sauf ceux qui travaillent pour un employeur qui a moins de dix em- ployés. 4

Section 7 of the Act is repealed and the following is substituted: 4 L’article 7 de la Loi est abrogé et remplacé par ce qui suit : 7 An employer shall take such action as may be neces- sary to implement pay equity within each of Parts I, II and III of the Public Service or if the employer is a body corporate listed in

Part IV of the Public Service or an employer outside the Public Service, within its organiza- tion. 7 L’employeur doit prendre toutes les mesures néces- saires pour mettre en œuvre l’équité salariale au sein de chacune des parties I, II ou III des services publics ou, s’il est une entité nommée à la

partie IV des services pu- blics ou un employeur extérieur aux services publics, au sein de son organisation. 5

Section 8 of the Act is amended 5 L’article 8 de la Loi est modifié (

a) by adding after subsection (1) the following:

a) par l’adjonction de ce qui suit après le paragra- phe (1) : 8(1.1) To implement pay equity, comparisons between female-dominated classifications and male-dominated classifications within an organization that is an employer outside the Public Service in terms of pay and in terms of the value of the work performed shall be undertaken. 8(1.1) Afin de mettre en œuvre l’équité salariale, des comparaisons qui portent sur la rémunération et la valeur du travail exécuté entre les classifications à prédomi- nance féminine et les classifications à prédominance masculine sont effectuées au sein de toute organisation constituée d’un employeur extérieur aux services pu- blics. (

b) by repealing subsection (2) and substituting the following:

Section 28 of the Act is amended 7 L’article 28 de la Loi est modifié (

a) by repealing subsection (1) and substituting the following:

28(1) An employer who has commenced or completed the pay equity process with an affected bargaining agent before April 1, 2020, shall, at the request of the Director, deliver a report to the Director by the date specified by the Director, describing the process followed by the em- ployer, comparing it to the requirements of this Act that are imposed on the employer with respect to the imple- mentation of pay equity. 28(1) L’employeur qui a commencé ou terminé un processus de mise en œuvre de l’équité salariale avec un agent de négociation avant le 1 er avril 2020 doit, à la de- mande de la directrice et à la date indiquée, lui remettre un rapport qui décrit le processus qu’il a suivi et qui compare celui-ci aux exigences que lui impose la pré- sente loi en matière de mise en œuvre de l’équité sala- riale. (

b) by repealing subsection (4) and substituting the following:

b) par l’abrogation du paragraphe (4) et son rem- placement par ce qui suit : 28(4) If the Director determines that there has been compliance up to the point in the process reached by the employer by April 1, 2020, the Director shall advise the employer and bargaining agent of that determination, and the employer may then continue with its implemen- tation of the pay equity process. 28(4) Si la directrice conclut que, jusqu’à l’étape où il en est rendu au 1 er avril 2020, l’employeur a respecté les dispositions de la présente loi, elle en avise l’employeur et l’agent de négociation, et dès lors, l’employeur peut poursuivre son processus de mise en œuvre de l’équité salariale. (

c) by repealing subsection (5) and substituting the following:

c) par l’abrogation du paragraphe (5) et son rem- placement par ce qui suit : 28(5) If the Director determines that there has not been compliance up to the point in the process reached by the employer by April 1, 2020, the Director may provide ad- vice to the employer with respect to its achieving com- pliance, and the employer shall ensure that it is in com- pliance with the requirements of this Act before proceeding further with its implementation of the pay equity process. 28(5) Si la directrice conclut que, jusqu’à l’étape où il en est rendu au 1 er avril 2020, l’employeur n’a pas res- pecté les dispositions de la présente loi, elle peut donner des conseils à l’employeur afin de l’aider à corriger cette situation et l’employeur doit s’assurer que les exigences de la présente loi sont remplies avant de poursuivre son processus de mise en œuvre de l’équité salariale. 8 This Act comes into force on April 1, 2020. 8 La présente loi entre en vigueur le 1er avril 2020.
