Fair Trading Act

PAYDAY LOANS AMENDMENT REGULATION

on August 24, 2009 pursuant to

section 105(1) of the Fair Trading Act.

1 The Payday Loans Regulation (AR 157/2009) is amended

by this Regulation.

Section 11(1)(

d) is amended by striking out "first day after

the first banking".

Section 14 is amended by adding the following after

subsection (3):

(4) In the case of a payday loan obtained by means of the Internet or

by telephone, the payday lender is deemed to have complied with

subsection (3) if the payday lender delivers instructions to the

payday lender's financial services provider to transfer the amount of

the advance to the borrower on the same day as the day on which the

agreement is entered into by both the borrower and the payday

lender.

(5) For the purposes of subsection (4), "financial services provider"

includes a bank listed in

Schedule I, II or III of the Bank Act

(Canada), a treasury branch, a credit union, a trust corporation or

loan corporation registered under the Loan and Trust Corporations

Act or an organization that provides remote funds transfers,

electronic funds transfers or any similar method of transferring

money.

section 70 of the Animal Health Act.

1 The Production Animal Medicine Regulation

(AR 299/2003) is amended by this Regulation.

Section 26 is amended by striking out "October 31, 2009"

and substituting "October 31, 2010".
