Section 7.1 of the Provincial Court Act,

chapter P-21 of the Revised Statutes, 1973, is amended 1 L’article 7.1 de la

a) by repealing subsection (1) and substituting the following:

a) par l’abrogation du paragraphe (1) et son rem ‐ placement par ce qui suit : 7.1(1) The Lieutenant-Governor in Council shall es ‐ tablish a panel consisting of the names of judges who have retired or resigned under this Act, who have given to the chief judge notice of their desire to perform judi ‐ cial duties and who have not reached the age of 80 years. 7.1(1) Le lieutenant-gouverneur en conseil établit un tableau dans lequel sont nommés les juges qui ont pris leur retraite ou donné leur démission sous le régime de la présente loi, qui ont avisé le juge en chef de leur désir d’assumer des fonctions judiciaires et qui n’ont pas en ‐ core atteint l’âge de 80 ans. b) by adding after subsection (1) the following:

Section 7.2 of the Act is amended 3 L’article 7.2 de la Loi est modifié (

a) in subsection (1)

i) in the portion preceding paragraph (

a) by striking out “a person” and substituting “the name of a person”; (

Section 10 of the Act is amended 4 L’article 10 de la Loi est modifié (

a) by repealing subsection (2) and substituting the following:

Section 13 of the Act is amended 5 L’article 13 de la Loi est modifié (

a) in subsection (1) by striking out “and a person who is on the panel established under subsection 7.1(1)”;

SAVING PROVISIONS AND COMMENCEMENT DISPOSITIONS DE SAUVEGARDE ET ENTRÉE EN VIGUEUR Person deemed to be selected by chief judge Personne réputée être une personne choisie par le juge en chef 7 Any person who, from April 11, 2003, to the date of the enactment of this section, both dates inclusive, per ‐ formed judicial duties after having retired or resigned and given notice to the chief judge of their desire to perform judicial duties and before having reached the age of 75 years is deemed to have been selected by the chief judge under subsection 7.1(2) of the Provincial Court Act. 7 Est réputée être une personne choisie par le juge en chef en vertu du paragraphe 7.1(2) de la

section 7 of this Act in the exercise or performance or intended exercise or performance of any right, power, duty, function, re ‐ sponsibility or authority related to their judicial duties 8(1) Tout acte accompli ou toute mesure prise entre le 11 avril 2003 et la date d’entrée en vigueur du pré ‐ sent article, inclusivement, par la personne visée à l’ar ‐ ticle 7 de la présente loi dans l’exercice ou l’exécution effectif ou censé tel d’un droit, d’un pouvoir, d’une obligation, d’une fonction, d’une responsabilité ou d’une autorité ayant trait à ses fonctions judiciaires : (

a) is deemed to have been done by a person val ‐ idly selected to exercise or perform the right, power, duty, function, responsibility or authority,
