B.C. Reg. 275/2003, deposited July 15, 2003, pursuant to the FOREST PRACTICES CODE OF BRITISH COLUMBIA ACT [Sections 198, 208 and 217.1]. Order in Council 691/2003, approved and ordered July 14, 2003.

On the recommendation of the undersigned, the Lieutenant Governor, by and with the advice and consent of the Executive Council, orders that

(

a) the Operational and Site Planning Regulation, B.C. Reg. 107/98, is amended as set out in the attached Schedule, and

(

b) the four month period referred to in

section 10 (1) (d) (ii) of the

Forest Practices Code of British Columbia Act does not apply for the purposes of paragraph (a). — M. de JONG, Minister of Forests; S. HAGEN, Presiding Member of the Executive Council.

Schedule

Section 1 (1) of the Operational and Site Planning Regulation, B.C. Reg. 107/98, is amended by repealing the definition of "forest ecosystem network" and substituting the following:

"forest ecosystem network" means an area

(

a) established under a higher level plan as a forest ecosystem network for the purpose of maintaining or restoring the natural connectivity within the area, or

(

b) established as a forest ecosystem network under

section 71.1; .

2 The title of

Part 10 is repealed and the following substituted:

Part 10 — Green-up

3 The following heading is added before

section 69:

Part 10.1 — Ungulate Winter Range,

Identified Wildlife and Forest Ecosystem Network

4 The following

section is added to

Part 10.1:

Forest ecosystem network

71.1

(1) An area is established as a forest ecosystem network if, before June 15, 1995, the area was approved as a forest ecosystem network by

(

a) the district manager, and

(

b) an employee of the Ministry of Environment, Lands and Parks.

(2) Any portion of an area that is established as a forest ecosystem network under subsection (1) ceases to be a forest ecosystem network if

(

a) the portion of the area is within a landscape unit, and

(

b) an old growth management area is established within the landscape unit.
