An Act to amend the Statute Law (Assented to , 2004) HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Saskatchewan, enacts as follows:

Short title 1 This Act may be cited as The Statute Law Amendment Act, 2004. S.S. 2000, c.A-5.3 amended 2(1) The Adult Guardianship and Co-decision-making Act is amended in the manner set forth in this section. (2) Clause 5(1)(

b) is amended by striking out “ Minister of Social Services ” and substituting “Minister of Community Resources and Employment”. (3) Clause 7(1)(

c) is amended by striking out “ Minister of Social Services ” and substituting “Minister of Community Resources and Employment”. (4) Clause 31(1)(

c) is amended by striking out “ Minister of Social Services” and substituting “Minister of Community Resources and Employment”. (5) Clause 64(3)(

b) is amended by striking out “ public trustee ” and substituting “public guardian and trustee”.

(6) Section 65 is amended by striking out “ public trustee” and substituting “public guardian and trustee”. (7) Subsection 67(3) is amended by striking out “ public trustee” and substituting “public guardian and trustee”: (

a) in the portion preceding clause (a); and (

b) in clause (c). S.S. 1989-90, c.C-7.2,

section 65 amended 3 Subsection 65(2) of The Child and Family Services Act is amended by striking out “section 89 of The Queen’s Bench Act” and substituting “section 28 of The Queen’s Bench Act, 1998 ”. S.S. 2003, c.19,

section 27 amended 4 The portion of clause 112(l.2) of The Condominium Property Act, 1993 preceding subclause (i), as being enacted by subsection 27(2) of The Condominium Property Amendment Act, 2003, is amended by striking out “subsection 58.1(11)” and substituting “subsection 58.1(9)”.

section 43 amended 5 The portion of subsection 43(1) of The Consumer Protection Act preceding clause (

a) is amended by adding “ product” after “ second-hand consumer”. R.S.S. 1978, c.C-32,

Section 32 of The Controverted Elections Act is amended by striking out “ The Queen’s Bench Act ” wherever it appears and in each case substituting “The Queen’s Bench Act, 1998 ”. S.S. 1999, c.C-38.01 amended 7(1) The Coroners Act, 1999 is amended in the manner set forth in this section. (2) Subsection 8(2) is amended by striking out “ The Young Offenders’ Services Act ” and substituting “The Youth Justice Administration Act ”.

(3) Section 10 is amended by striking out “ Social Services” wherever it appears and in each case substituting “ Community Resources and Employment”. R.S.S. 1978, c.C-46,

Section 46 of The Creditors’ Relief Act is amended by striking out “The Queen’s Bench Act ” and substituting “The Queen’s Bench Act, 1998 ”. S.S. 1999, c.F-23.3,

section 91 amended 9 Subsection 91(5) of The Funeral and Cremation Services Act is amended by striking out “ Minister of Social Services ” and substituting “Minister of Community Resources and Employment”. S.S. 1997, c.H-0.001,

section 15 amended 10 Clause 15(3)(

b) of The Health Care Directives and Substitute Health Care Decision Makers Act is amended by striking out “ Minister of Social Services” and substituting “Minister of Community Resources and Employment”. S.S. 1999, c.H-0.021,

section 56 amended 11 Subclause 56(e)(

i) of The Health Information Protection Act is amended by striking out “ Minister of Social Services ” and substituting “ Minister of Community Resources and Employment”. R.S.S. 1978, c.I-2,

Schedule amended 12 Column 2 of the

Schedule to The Income Tax Act is amended by striking out “The Queen’s Bench Act ” wherever it appears and in each case substituting “The Queen’s Bench Act, 1998 ”. R.S.S. 1978, c.L-1,

section 29.2 amended 13 Subsection 29.2(3) of The Labour Standards Act is amended by striking out “Department of Social Services” and substituting “Department of Community Resources and Employment”. R.S.S. 1978, c.L-9,

Section 2 of The Laws Declaratory Act is amended by striking out “The Queen’s Bench Act” wherever it appears and in each case substituting “The Queen’s Bench Act, 1998 ”.

section 3 amended 15 Clause 3(3)(

f) of The Legal Aid Act is amended by striking out “Department of Social Services appointed by the Minister of Social Services” and substituting “Department of Community Resources and Employment appointed by the Minister of Community Resources and Employment”. S.S. 1995, c.M-9.3,

section 18 amended 16 Clause 18(1)(

d) of The Medical Laboratory Technologists Act is amended by striking out “technologist” and substituting “technology”. S.S. 1993, c.M-11.11,

section 11 amended 17 Subsection 11(4) of The Members’ Conflict of Interest Act is amended by striking out “, as defined in The Securities Act, 1988, ”: (

a) in clause (a); and (

b) in clause (b). R.S.S. 1978, c.M-21,

section 19 amended 18 The portion of

section 19 of The Mortgage Brokers Act following clause (

b) is amended by striking out “ The Queen’s Bench Act ” and substituting “The Queen’s Bench Act, 1998 ”. S.S. 1983, c.N-5.1,

section 264 amended 19 Subsection 264(4) of The Northern Municipalities Act is amended by striking out “ The Queen’s Bench Act ” and substituting “ The Queen’s Bench Act, 1998 ”. R.S.S. 1978, c.O-4,

section 2 amended 20 Clause 2(

b) of The Ombudsman and Children’s Advocate Act is amended by striking out “Young Offenders Act (Canada), The Young Offenders’ Services Act ” and substituting “Youth Criminal Justice Act (Canada), The Youth Justice Administration Act ”.

R.S.S. 1978, c.P-1 amended 21(1) The Parents’ Maintenance Act is amended in the manner set forth in this section. (2) Subsection 3(1) is amended by striking out “ Minister of Social Services” and substituting “Minister of Community Resources and Employment”. (3) Subsection 4(1) is amended by striking out “ Minister of Social Services” and substituting “Minister of Community Resources and Employment”. (4) Subsection 7(2) is amended by striking out “ Minister of Social Services” and substituting “Minister of Community Resources and Employment”.

R.S.S. 1978, c.P-27 amended 22(1) The Proceedings against the Crown Act is amended in the manner set forth in this section.

(2) Section 9 is amended by striking out “ The Queen’s Bench Act ” and substituting “The Queen’s Bench Act, 1998 ”.

(3) Section 16 is amended by striking out “ The Queen’s Bench Act ” and substituting “The Queen’s Bench Act, 1998 ”.

section 5 amended 23 Clause 5(4)(

b) of The Provincial Court Act, 1998 is repealed and the following substituted: “(

b) a judge of the youth justice court for Saskatchewan pursuant to the Youth Criminal Justice Act (Canada)”. R.S.S. 1978, c-P-31,

Section 60 of The Provincial Lands Act is amended by striking out “tranfer” and substituting “transfer”. R.S.S. 1978, c.P-34.1,

section 8 amended 25 Subsection 8(3) of The Provincial Sales Tax Act is amended by striking out “person” and substituting “personal”. S.S. 1996, c.P-36.1,

section 4 amended 26 Subsection 4(2) of The Public Disclosure Act is amended by striking out “Young Offenders Act ” and substituting “Youth Criminal Justice Act ”. R.S.S. 1978, c.P-46,

section 2 amended 27 Subsection 2(2) of The Public Works Act is amended by striking out “Department of Social Services ” and substituting “ Department of Community Resources and Employment”. R.S.S. 1978, c.R-17 amended 28(1) The Rehabilitation Act is amended in the manner set forth in this section.

(2) Clause 2(

d) is amended by striking out “ Minister of Social Services” and substituting “member of the Executive Council to whom for the time being the administration of this Act is assigned”. (3) Subsection 10(2) is amended by striking out “ Department of Social Services ” and substituting “ Department of Community Resources and Employment”. R.S.S. 1978, c.R-22 amended 29(1) The Residential Tenancies Act is amended in the manner set forth in this section. (2) Subsection 35(3) is amended by striking out “ Minister of Social Services” and substituting “Minister of Community Resources and Employment”.

(3) Section 35.04 is amended by striking out “ Minister of Social Services ” and substituting “Minister of Community Resources and Employment”: (

a) in subsection (1); and (

b) in subsection (2).

Section 2 of The Saskatchewan Assistance Act is amended: (

a) in clause (

b) by striking out “ Department of Social Services ” and substituting “Department of Community Resources and Employment”; and (

b) in clause (

d) by striking out “ Minister of Social Services ” and substituting “member of the Executive Council to whom for the time being the administration of this Act is assigned”. S.S. 1988-89, c.S-42.2 amended 31(1) The Securities Act, 1988 is amended in the manner set forth in this section.

(2) Subclause 39(1)(a)(iv) is amended by striking out “ The Queen’s Bench Act ” and substituting “The Queen’s Bench Act, 1998 ”.

(3) Subclause 81(1)(a.1)(iii) is amended by striking out “ The Queen’s Bench Act ” and substituting “The Queen’s Bench Act, 1998 ”.

(4) Paragraph 135.4(3)(b)(ii)(

C) is repealed and the following substituted: “(

C) The Queen’s Bench Act, 1998 ”. R.S.S. 1978, c.S-65,

section 88 amended 32 Subsection 88(4) of The Surface Rights Acquisition and Compensation Act is amended by striking out “Sections 95 and 97 of The Queen’s Bench Act ” and substituting “Sections 23 and 24 of The Queen’s Bench Act, 1998 ”. R.S.S. 1978, c.T-2,

section 25 amended 33 The portion of subsection 25(1) of The Tax Enforcement Act following clause (

b) is amended by striking out “ appointed pursuant to The Surrogate Court Act or The Queen’s Bench Act for the judicial centre that is nearest the land affected by the notice or document”. S.S. 1997, c.T-22.2,

section 72 amended 34 Subclause 72(2)(d)(

v) of The Trust and Loan Corporations Act, 1997 is repealed and the following substituted: “(

v) The Queen’s Bench Act, 1998 ”. S.S. 1983-84, c.U-11,

section 316 amended 35 Subsection 316(4) of The Urban Municipality Act, 1984 is amended by striking out “ The Queen’s Bench Act ” and substituting “ The Queen’s Bench Act, 1998 ”. S.S. 1986, c.V-2.1,

section 23 amended 36 Subsection 23(1.3) of The Vehicle Administration Act is amended by striking out “disposition pursuant to the Young Offenders Act” and substituting “youth sentence pursuant to the Youth Criminal Justice Act”. S.S. 1979, c.W-17.1,

section 104 amended 37 Clause 104(2)(

d) of The Workers’ Compensation Act, 1979 is repealed and the following substituted: “(

d) a place of open custody, a place of secure custody or a place of temporary detention as defined in The Youth Justice Administration Act ”. Coming into force 38 This Act comes into force on assent.
