Order in Council 164/2025, approved and ordered April 7, 2025.

On the recommendation of the undersigned, the Lieutenant Governor, by and with the advice and consent of the Executive Council, orders that, effective May 1, 2025,

(

a) sections 2, 4, 10, 12 to 14, 16, 18, 19, 22, 24 to 27, 42, 44, 46, 47, 51, 52, 55, 58, 66, 67, 75, 81, 84, 86, 90, 114, 122, 141 to 163, 165 to 169 and 171 to 176 of the Police Amendment Act, 2024 , S.B.C. 2024, c. 16, are brought into force,

(

b) the regulations set out in the attached

Schedule are amended as set out in that Schedule, and

(

c) the Prescribed Police Forces Regulation, B.C. Reg. 70/99, is repealed.

Schedule

Assistance to Shelter Regulation

Section 2 of the Assistance to Shelter Regulation, B.C. Reg. 291/2009, is amended by striking out " the definition of "police force" in

section 1 of the Act " and substituting " the definition of "police service" in

section 1 of the Act ".

2 Sections 5 and 6 are amended by striking out " police forces " wherever it appears and substituting " police services ".

Child Care Licensing Regulation

Section 1 of the Child Care Licensing Regulation, B.C. Reg. 332/2007, is amended in paragraph (b) (ii) of the definition of "criminal record check" by striking out " provincial police force " and substituting " provincial police service ".

Community Charter Bylaw Enforcement Ticket Regulation

Section 3 of the Community Charter Bylaw Enforcement Ticket Regulation, B.C. Reg. 425/2003, is amended

(

a) by repealing paragraph (

a) and substituting the following:

(

a) provincial constables or special provincial constables within the meaning of the Police Act ;

(a.1) municipal constables or special municipal constables within the meaning of the Police Act ;

(a.2) designated constables within the meaning of the Police Act ; , and

(

b) in paragraph (

b) by striking out " members " and substituting " members, other than civilian members, ".

Conservation Officer Service Authority Regulation

5 The Conservation Officer Service Authority Regulation, B.C. Reg. 318/2004, is amended in Column 1 of the Table by striking out " a member of the Provincial police force " and substituting " a member of the provincial police service ".

Designated Policing and Law Enforcement Units Complaints Regulation

Section 2 (2) of the Designated Policing and Law Enforcement Units Complaints Regulation, B.C. Reg. 230/2022, is amended by striking out " force " wherever it appears and substituting " service ".

Disposal of Property in Police Possession Regulation

Section 3 (1) of the Disposal of Property in Police Possession Regulation, B.C. Reg. 366/2003, is amended by striking out " police force or police department " and substituting " police service ".

Emergency Vehicle Driving Regulation

Section 8 of the Emergency Vehicle Driving Regulation, B.C. Reg. 133/98, is amended by striking out " the member has successfully completed training approved for the group by the Director of Police Services in the Ministry of Public Safety and Solicitor General for the purposes of this regulation " and substituting " the member has successfully completed training approved for the group, for the purposes of this regulation, by the director of policing and law enforcement services under the Police Act ".

Information Management Systems (Digital Evidence Management System) Regulation

Section 1 of the Information Management Systems (Digital Evidence Management System) Regulation, B.C. Reg. 309/2021, is amended in paragraph (

a) of the definition of "responsible person" by striking out " provincial police force " and substituting " provincial police service ".

Missing Persons Regulation

Section 1 of the Missing Persons Regulation, B.C. Reg. 111/2015, is amended by repealing the definition of "member" and substituting the following:

"member" , in relation to a police service, means the following:

(

a) in the case of the provincial police service, a provincial constable;

(

b) in the case of a municipal police department, a municipal constable;

(

c) in the case of the Stl’atl’imx Tribal Police Service, a designated constable.

Section 2 is amended

(

a) in subsection (1) by striking out " the definition of "police force" in

section 1 of the Act " and substituting " the definition of "police service" in

section 1 of the Act ", and

(

b) in subsection (2) by striking out " the chief officer of the Stl’atl’imx Tribal Police Service, appointed under

section 4.2 (2) (c) (iv) (

A) of the Police Act , is a prescribed senior official " and substituting " the chief officer of the Stl’atl’imx Tribal Police Service is a prescribed senior official ".

12 Sections 5 and 13 are amended by striking out " police force " wherever it appears and substituting " police service ".

Section 9 (

e) is repealed and the following substituted:

(

e) if the police service preparing the report is the provincial police service referred to in paragraph (

a) of the definition of "police service" in

section 1 of the Act, the location of all detachments of members who made a demand.

14 The

Schedule is amended

(

a) in Form 1 by striking out " police force " wherever it appears and substituting " police service ", and

(

b) in Form 2 by striking out " Police force " and substituting " Police service ".

Motor Vehicle Act Regulations

Section 4.28 (8) of the Motor Vehicle Act Regulations, B.C. Reg. 26/58, is amended

(

a) in paragraph (

a) by striking out " municipal police force " and substituting " municipal police department ", and

(

b) by repealing paragraphs (a.1), (a.2) and (a.3) and substituting the following:

(a.1) a designated constable of any of the following designated policing units established under the Police Act :

(

i) the Organized Crime Agency of British Columbia;

(ii) the South Coast British Columbia Transportation Authority Police Service Designated Policing Unit;

(iii) Stl’atl’imx Tribal Police Service; .

Section 5.05 (1) is amended by striking out " the Provincial police force or the police force of any municipality " and substituting " the provincial police service or the municipal police department of any municipality ".

Section 9.01 is amended by striking out " the nearest Provincial or municipal police office " and substituting " the nearest office of the provincial police service or a municipal police department ".

Section 24.09 is amended

(

a) in subsection (3) (

a) by striking out " a municipal police force, a constable of that force " and substituting " a municipal police department, a constable of that department ", and

(

b) in subsections (4) and (7) (

a) by striking out " a municipal police force " and substituting " a municipal police department ".

Organized Crime Agency of British Columbia Operations Regulation

Section 6 (

b) of the Organized Crime Agency of British Columbia Operations Regulation, B.C. Reg. 229/2002, is amended by striking out " police force " and substituting " police service ".

Passenger Transportation Regulation

Section 12.62 (2) of the Passenger Transportation Regulation, B.C. Reg. 266/2004, is amended by striking out " police force " and substituting " police service ".

Police (Disposal of Property) Regulation

21 Sections 2, 4, 5, 6, 7, 8 and 9 of the Police (Disposal of Property) Regulation, B.C. Reg. 87/91, are amended by striking out " provincial police force " wherever it appears and substituting " provincial police service ".

Police Officer Commissions Regulation

Section 1 (1) of the Police Officer Commissions Regulation, B.C. Reg. 78/2015, is amended

(

a) by repealing the definition of "director of police services" , and

(

b) by adding the following definition:

"director of policing and law enforcement services" has the same meaning as "director" in

section 1 of the Police Act ; .

Section 2 (3) is amended by striking out " director of police services " and substituting " director of policing and law enforcement services ".

Police (Uniforms) Regulations

24 The Police (Uniforms) Regulations, B.C. Reg. 564/76, are amended by repealing the title and substituting the following:

POLICE (UNIFORMS) REGULATION .

25 Sections 2 and 10 are amended by striking out " municipal forces " wherever it appears and substituting " municipal police departments ".

Section 7 (4) is amended by striking out " municipal force " and substituting " municipal police department ".

Representative for Children and Youth Regulation

Section 6 (1) (b) (iv) of the Representative for Children and Youth Regulation, B.C. Reg. 103/2007, is amended by striking out " municipal police force " and substituting " municipal police department ".

Residential Tenancy Regulation

Section 39 (

c) of the Residential Tenancy Regulation, B.C. Reg. 477/2003, is repealed and the following substituted:

(

c) a person who is any of the following within the meaning of the Police Act :

(

i) a provincial constable or special provincial constable;

(ii) a municipal constable or special municipal constable;

(iii) a designated constable; .

Security Services Regulation

Section 9 of the Security Services Regulation, B.C. Reg. 207/2008, is amended

(

a) in subsection (1) (

b) by striking out " police force " and substituting " police service ", and

(

b) in subsection (2) (

a) by striking out " used by police officers " and substituting " used by a police service ".

South Coast British Columbia Transportation Authority

Police Service Operations Regulation

Section 2 (

b) of the South Coast British Columbia Transportation Authority Police Service Operations Regulation, B.C. Reg. 484/2004, is amended by striking out " police force " and substituting " police service ".

Special Provincial Constable Complaints and Discipline Regulation

Section 1 of the Special Provincial Constable Complaints and Discipline Regulation, B.C. Reg. 206/98, is amended in the definition of "constabulary duty" by striking out " a power or duty referred to in

section 9 (3) [special provincial constables] of the Act " and substituting " a power or duty referred to in

section 10 (1) (a) [jurisdiction of police constables] of the Act ".

Section 2 (1) (

b) is amended by striking out " a member of a police force described in

section 1.1 [police forces in British Columbia] of the Act " and substituting " a member of a police service described in

section 1.1 [police services in British Columbia] of the Act ".

Stl’atl’imx Tribal Police Service Operations Regulation

Section 2 (

b) of the Stl’atl’imx Tribal Police Service Operations Regulation, B.C. Reg. 385/99, is amended by striking out " police force " and substituting " police service ".

Vancouver Charter By-Law Enforcement Ticket Regulation

Section 3 (

a) of the Vancouver Charter By-Law Enforcement Ticket Regulation, B.C. Reg. 189/2007, is repealed and the following substituted:

(

a) provincial constables or special provincial constables within the meaning of the Police Act ;

(a.1) municipal constables or special municipal constables within the meaning of the Police Act ;

(a.2) designated constables within the meaning of the Police Act ;

(a.3) members, other than civilian members, of the Royal Canadian Mounted Police; .

Violation Ticket Administration and Fines Regulation

Section 1 of the Violation Ticket Administration and Fines Regulation, B.C. Reg. 89/97, is amended in the definition of "police officer"

(

a) by repealing paragraph (

a) and substituting the following:

(

a) except in

section 2 (3),

(

i) any of the following constables within the meaning of the Police Act :

(

A) a provincial constable or special provincial constable;

(

B) a municipal constable or special municipal constable;

(

C) a designated constable, and

(ii) a member, other than a civilian member, of the Royal Canadian Mounted Police, and ,

(

b) by repealing paragraph (b) (

i) and substituting the following:

(

i) a member, other than a civilian member, of the Royal Canadian Mounted Police,

(i.1) an officer or constable in a police service in Canada, and , and

(

c) in paragraph (b) (ii) by striking out " described in subparagraph (i) " and substituting " described in subparagraph (

i) or (i.1) ".

Vital Statistics Act Regulation

36 The Vital Statistics Act Regulation, B.C. Reg. 69/82, is amended in

section 2 of

Schedule A

(

a) by repealing paragraph (

a) and substituting the following:

(

a) the commissioner of the provincial police service under the Police Act , ,

(

b) by repealing paragraph (b),

(

c) by repealing paragraph (

c) and substituting the following:

(

c) the chief constable of a municipal police department established under the Police Act , ,

(

d) by adding the following paragraphs:

(d.1) the chief officer of a designated policing unit established under the Police Act ,

(d.2) the chief civilian director of the independent investigations office established under the Police Act , or , and

(

e) in paragraph (

e) by striking out " of any provincial or municipal police force established under the laws of any province " and substituting " of any police service established under the laws of another province ".
