B.C. Reg. 116/2003, deposited March 28, 2003, pursuant to the EMPLOYMENT AND ASSISTANCE FOR PERSONS WITH DISABILITIES ACT [Sections 26 (2) (

n) and (3) (a)] and the EMPLOYMENT AND ASSISTANCE ACT [Sections 13 and 36]. Order in Council 306/2003, approved and ordered March 28, 2003.

On the recommendation of the undersigned, the Lieutenant Governor, by and with the advice and consent of the Executive Council, orders that effective April 1, 2003,

(

a) the Employment and Assistance Regulation, B.C. Reg. 263/2002, is amended as set out in the attached

Schedule 1, and

(

b) the Employment and Assistance for Persons with Disabilities Regulation, B.C. Reg. 265/2002, is amended as set out in the attached

Schedule 2. — M. COELL, Minister of Human Resources; G. CAMPBELL, Presiding Member of the Executive Council.

Schedule 1

Section 27 of the Employment and Assistance Regulation, B.C. Reg 263/2002, is amended

(

a) by repealing subsection (2) (a) (iii) and substituting the following:

(iii) are receiving accommodation and care in a special care facility or a private hospital, other than an alcohol or drug treatment centre, or who are admitted to a hospital because they require extended care; ,

(

b) by adding the following subsection:

(2.1) If a family unit is subject to a reduction or becomes ineligible under subsection (1), the portion of the reduction or ineligibility that is attributable to the circumstances of one of the recipients ends when that recipient reaches 65 years of age. ,

(

c) in subsection (3) (

a) by striking out "section 29 (4)" and substituting "section 29 (4) (

b) to (

g) and (i)",

(

d) in subsection (3) by adding the following paragraph:

(a.1) during which the recipient, regardless of the status of other recipients in the family unit, is a person described in

section 29 (4) (h) (

i) to (iii), (

v) and (vi); ,

(

e) in subsection (3) by repealing paragraph (

b) and substituting the following:

(

b) during which the recipient participates in the following portions of a training for jobs program approved by the minister:

(

i) acceptance into the program,

(ii) training,

(iii) job placement; , and

(

f) in subsection (3) (

e) by striking out "19 year" and substituting "19 years".

Section 29 (4) is amended

(

a) by repealing paragraph (a), and

(

b) in paragraph (

h) by adding the following subparagraph:

(vi) persons who have reached 65 years of age; .

Schedule 2

Section 25 (4) of the Employment and Assistance for Persons with Disabilities Regulation, B.C. Reg 265/2002, is amended

(

a) by repealing paragraph (a), and

(

b) in paragraph (

g) by adding the following subparagraph:

(

v) persons who have reached 65 years of age.
