An Act to Amend the Public Utilities Act Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, en- acts as follows: 1

Section 40.1 of the Public Utilities Act,

chapter P-27 of the Revised Statutes of New Brunswick, 1973, Act is amended (

a) by adding after subsection (1.1) the follow- ing: 40.1(1.2) The New Brunswick Power Corpora- tion shall make an application to the Board for the Board’s approval as to any proposed sale or lease of generating assets, facilities or generating units, be- fore entering into any agreement for the lease or sale of such assets, facilities or generating units. (

b) in subsection (2) by striking out the por- tion preceding paragraph (

a) and substituting the following: 40.1(2) The Board shall, upon receipt of an appli- cation made under subsection (1), (1.1), or (1.2), PROJET DE LOI Loi modifiant la

a) par l’adjonction après le paragraphe (1.1) du paragraphe suivant : 40.1(1.2) La Société d’énergie du Nouveau- Brunswick doit, avant de conclure toute entente vi- sant la location à bail ou la vente de moyens, d’ins- tallations ou d’unités de production, faire une de- mande à la Commission pour obtenir de celle-ci son approbation.

b) au paragraphe (2), par la suppression du passage précédant l’alinéa a) et son remplace- ment par ce qui suit : 40.1(2) La Commission doit, sur réception d’une demande faite en vertu du paragraphe (1), (1.1) ou (1.2), 2 Projet de loi Loi modifiant la
