An Act to Amend the Municipal Elections Act Loi modifiant la

Section 1 of the Municipal Elections Act,

chapter M-21.01 of the Acts of New Brunswick, 1979, is amended 1 L’article 1 de la

a) by repealing the definition “election officer” and substituting the following:

a) by repealing subsection (1) and substituting the following:

5.1(1) The Municipal Electoral Officer may issue in- structions to any election officer with respect to the con- duct of the election and the procedures to be followed, and shall ensure that instructions relating to the nomination procedure for candidates, voting procedures and the count- ing of ballot papers are published on the website of Elec- tions New Brunswick at least sixty days before the quadrennial elections are held, and at least thirty days be- fore a by-election is held. 5.1(1)

Section 6 of the Act is amended 5 L’article 6 de la Loi est modifié (

11(3) The Municipal Electoral Officer shall, at least five days before the first advance polls, send to all persons on a preliminary list a notice, in the form prescribed by the Municipal Electoral Officer, advising all persons of the polling division and polling station at which they are listed as entitled to vote. 11(3)

15 Paragraph 18(2)(

An Act to Amend the Municipal Elections Act Bill 21 31

EXPLANATORY NOTES NOTES EXPLICATIVES Sections 1 to 67 This amending Act provides the Municipal Electoral Officer with greater flexibility in conducting municipal elections and plebiscites, updates the list and duties of election officers, makes the nomination procedure for candidates simpler and less onerous, provides for a revised procedure for mobile polling stations and special ballots, amends the process for recounts, allows the Municipal Electoral Officer to set aside an election where an administrative error affects the outcome, provides for penalties relating to interference with voters lists and vote tabulation machines, amends or repeals various regulation-making authorities and makes various consequential amendments.

Articles 1 à 67 Les modifications dans la présente loi offrent une plus grande fle- xibilité au directeur des élections municipales dans la conduite d’élections municipales et de plébiscites, mettent à jour la liste des membres du personnel électoral impliqués dans le déroulement d’une élection municipale ainsi que leurs responsabilités, simpli- fient le processus de mise en candidature, modifient les procédures rattachées aux bureaux de vote mobiles, aux bulletins de vote spé- ciaux et aux nouveaux dépouillements du scrutin, permettent au directeur des élections municipales de mettre de côté les résultats d’une élection lorsqu’une erreur administrative a modifié le résultat, prévoient des peines concernant la manipulation des machines à compilation et des listes électorales, modifient ou abrogent divers pouvoirs réglementaires et prévoient diverses modifications corré- latives.
