An Act to Amend the Assessment Act Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as fol- lows: 1

Section 15 of the Assessment Act,

chapter A-14 of the Revised Statutes, 1973, is amended by striking out “15.2” and substituting “15.2, 15.3”. 2 The Act is amended by adding after

section 15.2 the following: 15.3(1) The following

definitions apply in this section. “base year” means the year determined by the Director under subsection (7). (année de base) “heritage property” means real property prescribed by regulation. (bien patrimonial) “Minister” means the Minister responsible for the Cul- ture and Sport Secretariat and includes any person desig- nated by the Minister to act on the Minister’s behalf for the purposes of this section. a) for the first year following the base year, the sum of the real and true value of the heritage property as of January 1 of the base year and the real and true value of improvements, if any, made on the heritage property in the base year but before the commencement of the res- toration project; (

b) for the second year following the base year, the amount calculated as follows: A + 25% (B −

A) where A = the sum referred to in paragraph (a); B = the real and true value of the heritage property as of January 1 of the second year following the base year; (

c) for the third year following the base year, the amount calculated as follows: A + 50% (C −

A) where A = the sum referred to in paragraph (a); C = the real and true value of the heritage property as of January 1 of the third year following the base year; (

d) for the fourth year following the base year, the amount calculated as follows: A + 75% (D −

A) where A = the sum referred to in paragraph (a); D = the real and true value of the heritage property as of January 1 of the fourth year following the base year. 15.3(3) Before commencing a restoration project on a heritage property, the person in whose name the heritage property is assessed may apply to the Minister, on a form provided by the Minister, to determine if the proposed res- toration project meets the criteria prescribed by regula- tion.

A) où A représente la somme visée à l’alinéa a); D représente la valeur réelle et exacte du bien patri- monial au 1 er janvier de la quatrième année suivant l’année de base. 15.3(3) Avant d’entreprendre un projet de restauration sur un bien patrimonial, la personne au nom de laquelle est évalué le bien patrimonial peut, au moyen de la for- mule fournie par le ministre, demander au ministre de dé- terminer si le projet de restauration proposé respecte les critères prescrits par règlement.

An Act to Amend the Assessment Act Bill 47 15.3(4) If the Minister approves an application in re- spect of a heritage property under subsection (5), no appli- cation may be made under subsection (3) in respect of the same heritage property until after December 31 of the fourth year following the base year. 15.3(5) If the Minister determines that a proposed resto- ration project on a heritage property meets the criteria re- ferred to in subsection (3), the Minister shall approve the application and send a copy of the approval to the Direc- tor. 15.3(6) The Director’s decision to approve or to refuse to approve the assessment of a heritage property in accor- dance with subsection (2) shall be made on the basis of the Minister’s approval under subsection (5) and on the basis of such other information as the Director requires. 15.3(7) The Director shall determine the base year for a restoration project. 15.3(8) From the date that the restoration project is completed to and including December 31 of the fourth year following the base year, at least 75% of the finished floor area of the heritage property shall not be eligible for a credit under

section 2 of the Residential Property Tax Relief Act. 15.3(9) For the purposes of subsection (8), the determi- nation of the percentage of the finished floor area of the heritage property that is eligible for a credit under

section 2 of the Residential Property Tax Relief Act is in the sole discretion of the Director. 15.3(10) The person in whose name a heritage property is assessed in accordance with subsection (2) shall, during the restoration process, ensure that the restoration project meets the criteria referred to in subsection (3). 15.3(11) The person in whose name a heritage property is assessed in accordance with subsection (2) shall notify the Minister and the Director immediately if the criteria referred to in subsection (3) are no longer being met or if the criterion referred to in subsection (8) is not being met. 15.3(12) A decision of the Director to approve the as- sessment of a heritage property in accordance with sub- section (2) has effect from January 1 of the first year fol- lowing the base year, and any changes required to be made in the assessment and tax roll as a result of such assess- 15.3(4) Si le ministre approuve une demande relative à un bien patrimonial en vertu du paragraphe (5), une de- mande ne peut être faite en vertu du paragraphe (3) re- lativement au même bien patrimonial qu’après le 31 décembre de la quatrième année suivant l’année de base. 15.3(5) Si le ministre détermine qu’un projet de restau- ration proposé sur un bien patrimonial respecte les critères visés au paragraphe (3), le ministre approuve la demande et envoie une copie de l’approbation au directeur. 15.3(6) La décision du directeur d’approuver ou de re- fuser d’approuver l’évaluation d’un bien patrimonial con- formément au paragraphe (2) est fondée sur l’approbation du ministre en vertu du paragraphe (5) et sur les autres renseignements que le directeur requiert. 15.3(7)

Loi sur l’évaluation ment shall be made as soon as possible after the decision is made. 15.3(13) A decision of the Director to approve the as- sessment of a heritage property in accordance with sub- section (2) has effect until and including December 31 of the earliest of the following years: (

a) the fourth year following the base year; (

b) the year in which the criteria referred to in subsec- tion (3) are no longer being met; and (

c) the year in which the criterion referred to in sub- section (8) is not being met. 15.3(14) The Minister’s decision to approve or to refuse to approve an application under subsection (3) is final and may not be questioned or reviewed in any court. 15.3(15) The Director’s decision to approve or to refuse to approve the assessment of a heritage property in accor- dance with subsection (2) is final and may not be ques- tioned or reviewed in any court. 15.3(16) The Director’s determination of the base year for a restoration project is final and may not be questioned or reviewed in any court. 15.3(17) The Director’s determination of the percentage of the finished floor area of a heritage property that is eli- gible for a credit under

section 2 of the Residential Prop- erty Tax Relief Act is final and may not be questioned or reviewed in any court. 15.3(18) Sections 25, 27, 28 and 37 do not apply to (

a) the Director’s decision to approve or to refuse to approve the assessment of a heritage property in accor- dance with subsection (2), (

b) the Director’s determination of the base year for a restoration project, or (

c) the Director’s determination of the percentage of the finished floor area of a heritage property that is eli- gible for a credit under

An Act to Amend the Assessment Act Bill 47 15.3(19) Sections 25, 27, 28 and 37 apply with the nec- essary modifications to the real and true values referred to in subsection (2). 15.3(20) A person who fails to notify the Minister or the Director under subsection (11) commits an offence pun- ishable under

Part II of the Provincial Offences Procedure Act as a category F offence. 3 Subsection 40(1) of the Act is amended by adding af- ter paragraph (e.8) the following: (e.81) prescribing real property as heritage property for the purposes of

section 15.3; (e.82) prescribing criteria for the purposes of subsec- tion 15.3(3); (e.83) defining any term or expression used in

section 15.3, but not defined in this Act, for the purposes of

section 15.3, the regulations made for the purposes of

section 15.3 or both; 15.3(19) Les articles 25, 27, 28 et 37 s’appliquent, avec les adaptations nécessaires, aux valeurs réelles et exactes visées au paragraphe (2). 15.3(20) Toute personne qui omet d’aviser le ministre ou le directeur tel que le prévoit le paragraphe (11) com- met une infraction punissable en vertu de la

An Act to Amend the Assessment Act Bill 47 EXPLANATORY NOTES

Section 1 The amendment is consequential on the amendment made in sec- tion 2 of this amending Act. The existing provision reads as follows: 15 Notwithstanding any other public or private Act or any tax agree- ment, but subject to sections 15.1, 15.2, 16, 17 and 17.1, all real prop- erty shall be assessed at its real and true value as of January 1 of the year for which the assessment is made.

Section 2 New provisions.

Section 3 The amendment is consequential on the amendment made in sec- tion 2 of this amending Act. New regulation-making authority is added. NOTES EXPLICATIVES

Article 1 Modification corrélative à la modification faite à l’article 2 de la présente loi modificative. La disposition actuelle se lit comme suit : 15 Nonobstant toute autre loi d'intérêt général ou privé ou toute con- vention fiscale, mais sous réserve des articles 15.1, 15.2, 16, 17 et 17.1, tous les biens réels sont évalués à leur valeur réelle et exacte au 1er jan- vier de l'année pour laquelle l'évaluation est faite.
