Section of the Education Act concerns the powers of Boards of Education. The Bill adds two subsections to

section 171. The new subsections prohibit a board from entering into a contract with a person in which the board is obliged to expose any student to any advertising or other content presented in any me- dium, as part of an instructional program. If such a term exists in a contract with a Board, it is void. NOTE EXPLICATIVE L’article de la

An Act to amend the Education Act regarding Youth News Network-style contracts to expose students to advertising and other content It is increasingly common for cash-strapped boards of education to enter into contracts with businesses in which the board agrees to expose students to advertisements in the class- room. An example is the Youth News Net- work, which proposes to broadcast news and advertising into schools. Therefore, Her Majesty, by and with the advice and consent of the Legislative Assem- bly of the Province of Ontario, enacts as follows: 1.

section 70, and 1997,

chapter 31,

section 82, is further amended by adding the following subsections:

(6) No board shall enter into a contract with a person in which the board is obliged to ex- pose any student to any advertising or other content presented in any medium, as part of an instructional program or as part of an event in the school day at which attendance is manda- tory.

(7) A term of a contract which conflicts with subsection (6) is void. 2. This Act comes into force on the day it receives Royal Assent. 3. The

Par exemple, le Youth News Network propose de diffuser des nouvelles et des publicités dans les écoles. Pour ces motifs, Sa Majesté, sur l’avis et avec le consentement de l’Assemblée législative de la province de l’Ontario, édicte : 1. L’article de la

Loi sur l’éducation , tel qu’il est modifié par l’article du

chapitre des Lois de l’Ontario de 1991, par l’article du

chapitre des Lois de l’Ontario de 1992, par l’article du

chapitre des Lois de l’Ontario de 1993, par l’article du

chapitre 2, l’article du

chapitre et l’article du

chapitre des Lois de l’Ontario de et par l’article du

chapitre des Lois de l’Ontario de 1997, est modifié de nouveau par adjonction des paragraphes suivants :

(6) Aucun conseil ne doit passer un contrat avec une personne obligeant le conseil à expo- ser un élève à toute publicité ou à tout autre contenu publicitaire présenté sous n’importe quelle forme dans le cadre d’un programme d’enseignement ou d’une activité à laquelle l’élève est tenu de participer durant un jour de classe.

(7) Est nulle la condition d’un contrat qui est incompatible avec le paragraphe (6). 2. La présente loi entre en vigueur le jour où elle reçoit la sanction royale. 3. Le
