Section 1 of the Public Health Act,

chapter P-22.4 of the Acts of New Brunswick, 1998, is amended 1 L’article 1 de la

a) by repealing the following

definitions:

a) a holding tank with sewage flows of less than 20,000 litres per day that is not connected to a collec- tion system with a lift station, (

b) a septic tank and subsurface disposal field, in- cluding contour systems, with sewage flows of less than 20,000 litres per day that is not connected to a collection system with a lift station, (

c) a sewage treatment system with a subsurface disposal field with sewage flows of less than 5,460 li- tres per day that is not connected to a collection sys- tem with a lift station, (

d) a sewage management system with a subsurface disposal field with sewage flows of less than 5,460 li- tres per day that is not connected to a collection sys- tem with a lift station, or (

e) a pit privy; ( système autonome d’évacuation et d’épuration des eaux usées) “public safety inspector” means a public safety in- spector appointed under

section 62; (inspecteur de la sé- curité publique)

c) soit d’un système d’épuration des eaux usées pourvu d’un champ d’épandage souterrain permettant un débit quotidien inférieur à 5 460 litres qui n’est pas branché à un réseau collecteur pourvu d’une station de relèvement;

d) soit d’un système de gestion des eaux usées pour- vu d’un champ d’épandage souterrain permettant un débit quotidien inférieur à 5 460 litres qui n’est pas branché à un réseau collecteur pourvu d’une station de relèvement;

section 24. 24.02(1) Tout médecin-hygiéniste, tout inspecteur de la santé publique ou tout inspecteur de la sécurité publi- que peut ordonner par écrit au propriétaire d’un système autonome d’évacuation et d’épuration des eaux usées de procéder au découvrement de tout ou

partie du système pour en permettre l’inspection afin de déterminer si ont été respectés soit la présente loi et ses règlements, soit l’approbation donnée en vertu de l’article 24. 24.02(2) Subject to subsection (6), if a medical officer of health, a public health inspector or a public safety in- spector determines that an on-site sewage disposal sys- tem does not comply with this Act or the regulations or does not comply with an approval given under

section 24, he or she may issue a written order to the owner of the on-site sewage disposal system or to the person who holds a licence under subsection 23(1) requiring that per- son to take any action necessary to comply with this Act and the regulations or the approval, as the case may be, including the removal, installation, construction, repair or replacement of the on-site sewage disposal system. 24.02(2)
