Section 16 of

Chapter 21 of the Acts of 2021, the Housing in the Halifax Regional Municipality Act

Whereas the Bedford West 10 Special Planning Area Order, N.S. Reg. 56/2022, was made on March 24, 2022, and designated the Bedford West 10 Special Planning Area;

Whereas the Executive Panel on Housing in the Halifax Regional Municipality has recommended amendments to the Municipal Planning Strategy for Halifax and Bedford and to the Halifax Mainland Land Use By-law; And

whereas I am satisfied that the recommended amendments are necessary to advance the purpose of the Housing in the Halifax Regional Municipality Act; Therefore, I order the following: 1. Municipal Planning Strategy for Halifax is hereby further amended as follows: 1. Within

Section XV, Bedford West Secondary Planning Strategy, Sub-section 7 amend Policy BW-21K by deleting the text in strikeout and adding the text in bold below: Policy BW-21K 3. Limit density within each neighbourhood district as follows (notwithstanding Policy BW-16(c)): (a) 28.4 persons per acre in Sub Area 10B[;] (b) 53.3 48.67 persons per acre in Sub Area 10C; and (c) 28.4 persons per acre in Sub Area 10D. 2. Within

Section XV, Bedford West Secondary Planning Strategy, Sub-section 7 amend Policy BW- 21H(1) by deleting the text in strikeout and adding the text in bold below: Policy BW-21H(1)

Schedule BW-7A shall form the framework for land use planning within Sub-Area 10.

Schedule BW-7A shall administratively divide Sub Area 10 into four distinct neighbourhood districts as follows: Sub Area 10A which will encompass the properties southwest of Sub Area 9 that contains existing development; Sub Area 10B which shall encompass undeveloped lands southeast of Sub Area 9 and northwest of the former quarry lands; Sub Area 10C which shall encompass the quarry lands as well as the existing pumping station located at 243 Kearney Lake Road the abutting parcel to the northwest; and, Sub Area 10D which shall encompass lands to the southeast of the quarry lands containing primarily undeveloped lands and one property, 189 Kearney Lake Road, currently developed with an existing dwelling. 679

Section XV, the Bedford West Secondary Planning Strategy, Sub-section 7 amend Policy BW- 21L(1) by adding the text in bold below: Policy BW-21L(1) In addition to the development rights conferred by the policies of this SPS, utility uses shall be permitted on lands in the ownership of Nova Scotia Power and Halifax Water through the Land Use Bylaw. 4.

Section 127 of the Gaming Control Act The Governor in Council on the report and recommendation of the Minister of Service Nova Scotia and the Minister responsible for

Part II of the Gaming Control Act dated October 20, 2023, and pursuant to

Section 127 of

Chapter 4 of the Acts of 1994-95, the Gaming Control Act, is pleased, effective on and after November 28, 2023, to amend the Casino Regulations, N.S. Reg. 40/1995, made by the Governor in Council by Order in Council 95-259 dated April 4, 1995, to require the staff of the Gaming Division of the Department of Finance and Treasury Board to obtain a security clearance and to make other administrative amendments, in the manner set forth in

Schedule “A”, attached to and forming part of the report and recommendation.

Schedule “A” Amendment to the Casino Regulations made by the Governor in Council under

Section 127 of

Chapter 4 of the Acts of 1994-95, the Gaming Control Act 1

(1) The Casino Regulations, N.S. Reg. 40/1995, made by the Governor in Council by Order in Council 95-259 dated April 4, 1995, are amended by adding the heading “Definitions” immediately before

Section 2.

(2) Section 2 of the regulations is amended by adding the following definition where it belongs in alphabetical order: “Gaming Division employee” means an employee of the Gaming Division of the Department who supports the operations of the Corporation in accordance with

Section 18 of the Act; 2 Clause 20(1)(

d) of the regulations is repealed and the following clause substituted: (

d) Gaming Division employees or employees of the Department as designated by the Executive Director; 3 (1) Clause 24(1)(

a) of the regulations is repealed. (2) Clause 24(1)(

b) of the regulations is repealed and the following clause substituted: (

b) each Gaming Division employee; (3) Subsection 24(3) of the regulations is repealed and the following subsection substituted:

(3) A former employee of the Corporation who was deemed to be an employee of the Province effective December 1, 2022, under

Section 19 of the Act is not subject to a security clearance requirement if they have previously obtained a security clearance from the Executive Director. 4 (1) Subsection 25(1) of the regulations is amended by striking out “Each member and employee of the 691

(2) Subsection 25(2) of the regulations is repealed and the following subsection substituted:

(2) An oath or affirmation taken and subscribed to under subsection (1) shall be taken before a justice of the peace, commissioner of oaths or barrister and solicitor of the Supreme Court of Nova Scotia and shall be returned to the Executive Director and recorded in any manner that the Executive Director determines. 5 (1) Subsection 26(1) of the regulations is amended by (

a) striking out “the Corporation or”; and (

b) adding “or employed as a Gaming Division employee” immediately after “Department”. (2) Clause 26(2)(

a) of the regulations is amended by striking out “the Chair and members of the Board of Directors of the Corporation” and substituting “a Gaming Division employee who is an Executive Director”. (3) Clause 26(2)(

b) of the regulations is repealed. (4) Clause 26(2)(

d) of the regulations is amended by (

a) striking out “an employee of the Corporation” and substituting “a Gaming Division employee”; and (

b) striking out “the Chief Executive Officer of the Corporation” and substituting “a Gaming Division employee who is an Executive Director”. (5) Subsection 26(3) of the regulations is amended by striking out “or voting”. Part II - Regulations Vol. 47, No. 25 Livestock Insurance Act, is pleased, effective on and after November 28, 2023, to approve amendments made by the Nova Scotia Crop and Livestock Insurance Commission to the Poultry Insurance Plan, N.S. Reg. 339/2007, made by the Commission and approved by the Governor in Council by Order in Council 2007-394 dated July 13, 2007, reflecting amendments to the Animal Health and Protection Regulations, in the manner set forth in

Schedule “A”, attached to and forming part of the report and recommendation.

Schedule “A” Nova Scotia Crop and Livestock Insurance Commission I certify that the Nova Scotia Crop and Livestock Insurance Commission, at a meeting held September 22, 2023, passed a motion to amend the Poultry Insurance Plan, N.S. Reg. 339/2007, approved by the Governor in Council by Order in Council 2007-394 dated July 13, 2007, in the manner set out in the attached. The amendments to the regulations referred to above are effective on and after the date they are approved by the Governor in Council. Chapter 113 of the Revised Statutes of Nova Scotia, 1989, the Crop and Livestock Insurance Act 1 Subsection 12(3) of the Poultry Insurance Plan, N.S. Reg. 339/2007, made by the Nova Scotia Crop and Livestock Insurance Commission and approved by the Governor in Council by Order in Council 2007-394 dated July 13, 2007, is repealed and the following subsection substituted:

(3) If the Commission consents in writing to the destruction of an insured broiler flock as a result of a designated peril, the amount of the loss is calculated by using the following formula: L = (P -

M) I in which L = the loss P = the guaranteed production for the flock M = the allowance for normal mortality reported by the Chicken Farmers of Nova Scotia I = the insurable value per bird established under

(1) On receiving notice of the presence of a disease in an insured flock other than a broiler flock under

Section 10, the Commission may consent in writing to the destruction of the flock.

(2) If the Commission consents in writing to the destruction of an insured flock other than a broiler flock under subsection (1) as the result of a designated peril, the amount of the loss must be calculated based on the week in the production cycle during which the flock is destroyed, in accordance with the

Schedule “A” Regulations Respecting a Prohibition on Winter Parking of Vehicles made by the Provincial Traffic Authority under subsection 202(1) of

Chapter 293 of the Revised Statutes of Nova Scotia, 1989, the Motor Vehicle Act Citation 1 These regulations may be cited as the Winter Parking Ban Regulations. Application 2 These regulations apply to any highway that is subject to the Public Highways Act. Limitation on parking 3 Notwithstanding that certain traffic signs have been erected which may permit motor vehicles to park or stand upon sections of highway during the hours stated thereon, an owner, driver or person having control or custody of any vehicle must not park the vehicle upon any highway in Appendix A or any highway in the communities listed in Appendix A (

a) between 1 a.m. and 6 a.m.; (

b) in a manner that hinders, inconveniences or prevents the removal of snow or ice from a highway unless the vehicle is attended by a person authorized to operate and capable of operating it on a highway; or (

c) from 1 hour after a snowstorm starts to 2 hours after the snowstorm stops. Determination of boundary 4 For the purposes of these regulations, the boundaries of a community are determined in accordance with the Geographical Names Program established by the Government of Nova Scotia. Exception 5

Section 3 does not apply to any of the following vehicles: (

a) a motor vehicle registered to a medical practitioner who is registered under the Medical Act if all of the following apply: (

i) the vehicle is parked reasonably near the medical practitioner’s office or residence, (ii) the vehicle is immediately available to the medical practitioner for professional calls; (

b) a motor vehicle parked by a medical practitioner who is registered under the Medical Act if all of the following apply: (

i) the medical practitioner is engaged in their occupation, (ii) the vehicle is parked in reasonable proximity to the location where the medical practitioner is engaged in their occupation; (

c) a motor vehicle registered to a police department, the Royal Canadian Mounted Police or the Canadian Forces; 695

d) a commercial vehicle parked by a driver for the purpose of loading or unloading merchandise; (

e) a motor vehicle registered to a public utility as defined in the Public Utilities Act that is parked reasonably near the residence of its driver and immediately available for emergency calls.
