Attendu : WHEREAS Plazacorp Property Holdings Inc. has, by its petition, prayed that certain covenants and restrictions upon the title to certain lands in the City of Saint John be removed; que Plazacorp Property Holdings Inc. a demandé que soient éteints certains covenants et certaines restrictions rattachées à certains biens-fonds dans la Ville de Saint John; AND WHEREAS it is deemed expedient to grant the prayer in the said petition; qu’il est souhaitable d’accéder à cette demande; THEREFORE, Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as follows: Sa Majesté, sur l’avis et avec le consentement de l’As- semblée législative du Nouveau-Brunswick, édicte : 1 All covenants and restrictions of every nature and kind whatsoever imposed by The Eastern Trust Com- pany, Liquidator of Turnbull Real Estate Company, af- fecting lands situate in the City of Saint John which were conveyed by The Eastern Trust Company to the City of Saint John by deed dated the 25th day of July, 1956 and registered in the Saint John County Registry Office in Book at Pages 310-313 on the 6th day of August, 1956 as Number described as follows: 1 Tous les covenants et toutes les restrictions de quel- que nature que ce soit imposés par The Eastern Trust Company, à

titre de liquidateur de Turnbull Real Estate Company, rattachés à des biens-fonds situés dans la Ville de Saint John transférés par The Eastern Trust Company à la Ville de Saint John par acte de transfert passé le juillet et enregistré au Bureau d’enre- gistrement du Comté de Saint John le août dans le livre aux pages 310 à 313, sous le numé- ro et décrits comme suit : “ALL that certain lot, piece, part or parcel of land constituting the site for a proposed fire station situated on the eastern side of Millidge Avenue between Black St. and Woodward Ave. in Stanley Ward, Saint John, N.B.

Said lot is to contain 1.5 acres more or less, and is more particularly described as follows: TOUT le lot, le morceau, la

partie ou la parcelle de bien-fonds constituant le site d’un projet de caserne de pompiers situé sur le côté est de Millidge Avenue entre Black Street et Woodward Avenue, à Stanley Ward, Ville de Saint John, N.-B. Ce lot compte 1,5 acres, plus ou moins, et est plus particulièrement dé- 1 Beginning at a point on the eastern boundary of Milli- dge Ave. 128 feet, plus or minus, distant from the in- tersection of the center line of Black St. and the east- ern edge of Millidge Ave. Said point being designated as 0 + 00. This point is also the northwest corner of aforesaid lot.

Thence in a straight line bearing by the magnet A.D. S 11° 00’ W a distance of 60.6 feet to Station 0 + 60.6. Thence in a straight line bearing by the magnet S 3° 10’ W a distance of 50 feet to Sta- tion 1 + 10.6. Thence in a straight line bearing by the Magnet S 2° 30’ W a distance of 124.2 feet to Station 2 + 34.8. Thence in a straight line bearing by the Magnet S 2° 20’ W a distance of 93.5 feet to Station 3 + 28.3. This point constitutes the south west corner of the lot. Thence in a straight line bearing by the Magnet S 87° 40’ E a distance of 200 feet to Station 5 + 28.3.

This point designating the south east corner of said lot. Thence in a straight line bearing by the Magnet N 2° 20’ E a distance of 326.75 feet to Station 8 + 55.05. This point constituting the northeast corner of said lot. Thence in a straight line bearing by the Magnet N 87° 40’ W a distance of 189.1 feet to Sta- tion 10 + 44.15, said station being also the point of beginning or Station 0 + 00.

Ce point est aussi le coin nord-ouest dudit bien-fonds. Ensuite, en ligne droite en direction du relèvement par ai- mant A.D. S 11° 00’ O, une distance de 60,6 pieds à la Station 0 + 60,6. Ensuite, en ligne droite en direction du relèvement par aimant S 3° 10’ O, une distance de pieds à la Station 1 + 10,6.

Ensuite, en ligne droite en direction du relèvement par ai- mant S 2° 30’ O, une distance de 124,2 pieds à la Sta- tion 2 + 34,8. Ensuite, en ligne droite en direction du relèvement par aimant S 2° 20’ O, une distance de 93,5 pieds à la Station 3 + 28,3. Ce point désigne le coin sud-ouest dudit bien-fonds. Ensuite, en ligne droite en direction du relèvement par ai- mant S 87° 40’ E, une distance de pieds à la Sta- tion 5 + 28,3. Ce point désigne le coin sud-est dudit bien-fonds. Ensuite, en ligne droite en direction du re- lèvement par aimant N 2° 20’ E, une distance de 326,75 pieds à la Station 8 + 55,05.

Ce point dési- gne le coin nord-est dudit bien-fonds. Ensuite, en li- gne droite en direction du relèvement par aimant N 87° 40’ O, une distance de 189,1 pieds à la Station 10 + 44,15, cette station étant également le point de commencement ou la Station 0 + 00.

Le tout étant comme montré sur le plan ci-joint en rouge. are hereby extinguished and removed as they may affect lands vested in Plazacorp Property Holdings Inc. and identified as Parcel Identifier 55221717. sont par les présentes éteints et retirés dans la mesure où ils sont rattachés aux biens-fonds dévolus à Plazacorp Property Holdings Inc. et identifiés par le Numéro d’identification de parcelle 55221717.
