B.C. Reg. 337/2010 , deposited November 26, 2010, pursuant to the COMMERCIAL TRANSPORT ACT [Section 11] and the OFFENCE ACT [Section 132]. Order in Council 743/2010, approved and ordered November 25, 2010.

On the recommendation of the undersigned, the Lieutenant Governor, by and with the advice and consent of the Executive Council, orders that

(

a) the Commercial Transport Regulations, B.C. Reg. 30/78, are amended as set out in the attached

Schedule 1, and

(

b) the Violation Ticket Administration and Fines Regulation, B.C. Reg. 89/97, is amended as set out in the attached

Schedule 2.

Schedule 1

Section 1.01 of the Commercial Transport Regulations, B.C. Reg. 30/78, is amended by repealing the definition of " axle width " and substituting the following:

"axle track width" means the overall width of an axle across the outside faces of the tires measured at any point above the lowest point of the rim; .

Section 7.07 is amended

(

a) in subsection (1) (

a) by striking out " the distance across the outside of the tires on " and substituting " the axle track width of " each place it appears,

(

b) in subsection (1) (c), by striking out " January 1, 2008 " and substituting " January 1, 2010 ", and

(

c) in subsection (1) (

d) by striking out " December 31, 2007 " and substituting " December 31, 2009 ".

Section 7.20 (

b) is amended by adding " or tridem " after " tandem ".

Section 7.23 (3) (

i) is amended by striking out " axle width " and substituting " axle track width ".

Section 7.25 (

b) is amended by adding " subject to

section 7.07 (1) (c) " before " the axles ".

Section 7.26

(

a) is amended in subsection (1) by striking out " subsection (2) " and substituting " subsections (1.1) and (2) ", and

(

b) by adding the following subsection:

(1.1) A person must not, without a permit, drive or operate on a highway a logging truck if the gross vehicle weight of the truck exceeds 63 500 kg.

7 Appendices B and F are amended

(

a) by striking out " axle width " wherever it appears and substituting " axle track width ", and

(

b) by striking out " track width " wherever it appears and substituting " axle track width ".

8 Appendices D, E and G are amended by striking out " axle width " wherever it appears and substituting " axle track width ".

9 Appendix I is amended by striking out " track width " wherever it appears and substituting " axle track width ".

Schedule 2

1 Item 2 of

Schedule 1 of the Violation Ticket Administration and Fines Regulation, B.C. Reg. 89/97, is amended in Column 1 by striking out " A person appointed under the Inspectors Authorization Regulation, B.C. Reg. 372/92, as " and substituting " A person employed by the Ministry of Transportation and Infrastructure or the Ministry of Public Safety and Solicitor General as ".

2 Column 2 of

Schedule 2, under the heading Commercial Transportation Regulations, B.C. Reg. 30/78, is amended

(

a) opposite "

section 7.07 " in Column 1 by striking out " axle width " and substituting " axle track width ", and

(

b) opposite "

section 7.20 (b) " in Column 1 by adding " or tridem " after " tandem ".
