Definitions Définitions 1 The following

definitions apply in this Act. 1 Les définitions qui suivent s’appliquent à la présente loi. “additional medical goods or services” means medical goods or services that (

a) are prescribed by a medical practitioner or an oral and maxillofacial surgeon, (

b) may be provided in addition to funded surgical services, and (

c) are not entitled services as defined in the Medi‐ cal Services Payment Act or facility services. ( biens ou services médicaux additionnels) “facility services” means services related to the provi ‐ sion of a funded surgical service that are provided in a funded surgical facility and set out in an agreement ap ‐ proved by the Minister under

section 3. (services de l’établissement) “funded surgical facility” means a surgical facility at which a funded surgical service is provided with the ap ‐ proval of the Minister under

section 4. (établissement chirurgical financé) “funded surgical services” means surgical services that are entitled services as defined in the Medical Ser ‐ vices Payment Act , excluding minor surgical services prescribed by regulation. (services chirurgicaux finan ‐ cés) “Minister” means the Minister of Health and includes any person designated by the Minister to act on the Min ‐ ister’s behalf. (ministre) “non-medical goods or services” means non-medical goods or services that (

a) are not prescribed by a medical practitioner or an oral and maxillofacial surgeon, (

c) are not entitled services as defined in the Medi‐ cal Services Payment Act or facility services. ( biens ou services non médicaux) “operator” means an individual, corporation, unincor ‐ porated association, partnership or limited partnership that operates a surgical facility. (exploitant) “oral and maxillofacial surgeon” means a dental prac ‐ titioner whose name is entered in the specialists register and who is the holder of a specialist’s licence in oral and maxillofacial surgery issued pursuant to the New Bruns‐ wick Dental Act, 1985. (chirurgien buccal et maxillo- facial) “regional health authority” means a regional health authority as defined in the Regional Health Authorities Act. (régie régionale de la santé) “surgical facility” means a funded surgical facility and an unfunded surgical facility. (services chirurgicaux) “unfunded surgical facility” means a surgical facility at which an unfunded surgical service is provided with the approval of the Minister under

FUNDED SURGICAL FACILITIES ÉTABLISSEMENTS CHIRURGICAUX FINANCÉS Approval of proposed agreement Approbation de l’accord proposé 3(1) A regional health authority may enter into an agreement with a person to operate a funded surgical fa ‐ cility if the regional health authority provides the Minis ‐ ter with a copy of the proposed agreement and the Min ‐ ister approves the proposed agreement. 3(1) Une régie régionale de la santé qui souhaite con ‐ clure avec une personne un accord visant l’exploitation d’un établissement chirurgical financé fournit une copie de l’accord proposé au ministre aux fins d’approbation. 3(2) When considering the proposed agreement refer ‐ red to in subsection (1), the Minister shall take into ac ‐ count the following factors: 3(2) Lorsqu’il étudie l’accord proposé visé au paragra ‐ phe (1), le ministre tient compte des facteurs suivants : (

a) the need for the type of surgical service in the Province;

Approval of funded surgical facility Approbation d’un établissement chirurgical financé 4(1) A person may operate a funded surgical facility if the person makes an application to the Minister to oper ‐ ate the facility and the Minister approves the facility. 4(1) La personne qui souhaite exploiter un établisse ‐ ment chirurgical financé présente au ministre une de ‐ mande d’approbation de l’établissement concerné. 4(2) An application under subsection (1) shall include 4(2) La demande visée au paragraphe (1) renferme : (

Provision of additional and non-medical goods or services Fourniture de biens ou services additionnels et de biens ou services non médicaux 7(1) Subject to subsections (2) and (4), no person shall charge and collect from a patient who receives a funded surgical service at a funded surgical facility an amount for the provision of additional medical goods or services or non-medical goods or services. 7(1)

b) the patient receives a written statement signed by the person providing the funded surgical service that sets out

section 4 ter ‐ minates on the expiry of the agreement referred to in

Inspections Inspections 19(1) The Minister or a regional health authority may appoint in writing a person as an inspector for the pur ‐ pose of ensuring compliance with this Act and the regu ‐ lations, an agreement referred to in
