i EXPLANATORY NOTE The Bill implements several measures contained in the 1998 Budget.

PART I—INCOME TAX ACT Under the Income Tax Act, the rate of personal income tax is reduced from 45 per cent to 42.75 per cent of basic federal tax for 1998 and to 40.5 per cent of basic federal tax for 1999 and subsequent years. The Government intends to provide, by regulation, that tax at the rate of 40.5 per cent is to be withheld at source from July 1, 1998 to the end of the year to reflect the reduction in the tax rate for the whole of 1998. The Fair Share Health Care Levy is adjusted to reflect the change in income tax rates. Amendments to sections 8 and 28 of the Act streamline the administra- tion of Ontario tax credits, by making Ontario requirements parallel to federal requirements.

PART II—CORPORATIONS TAX ACT Under the Corporations Tax Act , the small business deduction is increased in order to reduce the effective tax rate on small business from 9.5 per cent to 9 per cent, effective for taxation years ending on or after May 5, 1998, and to 8.5 per cent as of January 1, 1999. The small business deduction continues to increase an additional one-half per cent each January 1 until January 1, 2006. On that day, the deduc- tion increases by 0.75 per cent, resulting in an effective tax rate on small business of 4.75 per cent.

The small business deduction is pro- rated for taxation years that straddle the date on which the rate changes. The phasing out of the small business deduction on taxable incomes between $200,000 and $500,000 is adjusted to reflect the changes in the rate of the small business deduction. Adjustments are also made to the calculation of the tax credit in respect of manufacturing, process- ing, mining, farming, fishing and logging. The Bill implements the new refundable Ontario production services tax credit and the enhancements to the Ontario film and television tax credit that were announced in November, 1997.

The Ontario produc- tion services tax credit is effective November 1, 1997 for corporations performing production services work in Ontario and is also available in respect of domestic film and television productions that are not eligible for the Ontario film and television tax credit. The production caps and the annual limit on the amount of the Ontario film and television tax credit available for eligible Ontario productions are removed for productions for which principal photography com- menced after October 31, 1997.

Technical amendments and corrections are made relating to the follow- ing matters: the Ontario book publishing tax credit; the Ontario film and television tax credit; the Ontario computer animation and special effects tax credit; the Ontario new technology tax incentive; and the small business investment tax credit available to financial institutions. Technical amendments are also made to clause 62 (1) (

PARTIE I — LOI DE L’IMPÔT SUR LE REVENU Le taux d’imposition du revenu des particuliers prévu par la Loi de l’impôt sur le revenu passe de 45 pour cent de l’impôt fédéral de base à 42,75 pour cent pour 1998 et à 40,5 pour cent pour les années 1999 et suivantes. Le gouvernement a l’intention de prévoir, par règlement, que l’impôt retenu à la source du 1 er juillet 1998 à la fin de l’année le soit au taux de 40,5 pour cent de façon à donner suite à la réduction d’impôt prévue pour la totalité de 1998. L’impôt équitable pour soins de santé est rajusté en fonction des nouveaux taux d’imposition.

Les modifications apportées aux articles 8 et 28 de la Loi simplifient l’administration des crédits d’impôt de l’Ontario en alignant les exi- gences de la province sur celles du fédéral.

PARTIE II —

LOI SUR L’IMPOSITION DES CORPORATIONS Aux termes de la

Loi sur l’imposition des corporations , la déduction accordée aux petites entreprises est augmentée afin de réduire le taux d’imposition réel des petites entreprises, qui passe de 9,5 pour cent à 9 pour cent, pour les années d’imposition qui se terminent le 5 mai 1998 ou après cette date, et à 8,5 pour cent, à compter du 1 er janvier 1999. La déduction continue d’augmenter d’un demi pour cent le 1er janvier de chaque année jusqu’au 1 er janvier 2006. À cette date, elle augmente de 0,75 pour cent, ce qui ramène le taux d’imposition réel des petites entreprises à 4,75 pour cent.

Elle est calculée propor- tionnellement pour les années d’imposition qui chevauchent la date de modification du taux. L’élimination progressive de la déduction accordée aux petites entre- prises sur les revenus imposables compris entre 200 000 $ et 500 000 $ est modifiée pour tenir compte des modifications appor- tées au taux de la déduction. Est également modifié le calcul du crédit d’impôt à l’égard de la fabrication, de la transformation, de l’exploitation minière, de l’agriculture, de la pêche et de l’exploita- tion forestière.

Le projet de loi crée le crédit d’impôt de l’Ontario pour les services de production, qui est remboursable, et apporte au crédit d’impôt pour la production cinématographique et télévisuelle ontarienne les améliorations qui ont été annoncées au mois de novembre 1997.

Le crédit d’impôt de l’Ontario pour les services de production prend effet le 1 er novembre 1997 pour les corporations qui fournissent des services de production en Ontario et peut être demandé à l’égard de productions cinématographiques et télévisuelles ontariennes qui ne sont pas admissibles au crédit d’impôt pour la production cinémato- graphique et télévisuelle ontarienne.

Le plafonnement des budgets de production et le montant maximal annuel du crédit d’impôt pour la production cinématographique et télévisuelle ontarienne qui peut être demandé à l’égard des produc- tions ontariennes admissibles sont éliminés pour les productions dont les principaux travaux de prise de vues ont commencé après le 31 octobre 1997.

Des modifications et des corrections d’ordre technique sont appor- tées en ce qui concerne les questions suivantes : le crédit d’impôt de l’Ontario pour les maisons d’édition; le crédit d’impôt pour la pro- duction cinématographique et télévisuelle ontarienne; le crédit d’im- pôt de l’Ontario pour les effets spéciaux et l’animation informati- ques; le stimulant fiscal de l’Ontario pour les nouvelles technologies; et le crédit d’impôt à l’investissement dans les petites entreprises dont peuvent se prévaloir les institutions financières. Des modifica- tions d’ordre technique sont également apportées à l’alinéa 62

(1) c) de la Loi.

PART III—HIGHWAY TRAFFIC ACT The amendments to

section 53 of the Highway Traffic Act provide that, for the purpose of determining whether a person has committed a sub- sequent offence of driving while his or her licence is suspended, sus- pensions for certain driving-related criminal offences are considered separately from suspensions for other reasons. The amendments to sections 144 and 146 of the Highway Traffic Act increase the minimum fine from $60 to $150 for failing to obey a red or amber light.

PART IV—LAND TRANSFER TAX ACT The Land Transfer Tax Act now permits the refund of land transfer taxes payable on the purchase on or before March 31, 1998 of a newly-con- structed home by a first-time buyer. An amendment extends this dead- line to March 31, 1999. An amendment to

section 1 reinstates two provisions (formerly subsec- tions 18 (9) and (10)) relating to the calculation of the value of the consideration for specified transactions.

PART V—ONTARIO LOAN ACT, 1998 The Bill enacts the Ontario Loan Act, 1998 (set out in

Schedule A). That Act authorizes the borrowing of up to $4.6 billion, in total, for the Consolidated Revenue Fund. It is expected that the public capital markets, the international loan market and the Canada Pension Plan will be the principal sources of funds. The borrowing authority expires at the end of December 1999.

PART VI—ONTARIO LOTTERY CORPORATION ACT The Ontario Lottery Corporation Act now provides that the net profits of the Corporation may be appropriated by the Legislature for certain specified purposes. An amendment to the Act expands the list of purposes to include the provision of health care, the activities and objectives of charities and non-profit corporations and the funding of community activities and programs.

An amendment authorizes the Corporation to make payments from its revenues in accordance with agreements approved by the Minister of Finance for the distribution of proceeds of lottery schemes to or for the benefit of charitable organizations and non-profit corporations and for the support of other activities and programs for the people of Ontario. At least one-half of the Corporation’s net revenue from table gaming must be spent for these purposes. A further amendment will require the Corporation to include details of these payments in its annual report.

The provisions of the current Act relating to video lottery terminals are repealed.

PART VII—RETAIL SALES TAX ACT Amendments to sections 2.2, 2.3 and 2.5 of the Retail Sales Tax Act relate to a proposed agreement between the Ontario and federal govern- ments concerning the collection of tax from returning residents at the border. Under the agreement, Revenue Canada would collect tax on behalf of Ontario. The amendments will allow tax to be collected from returning residents on the same basis as tax is paid in Ontario. The current Act provides that 1-800 and 1-888 telephone service is exempt from tax. An amendment extends that exemption to 1-877

PARTIE III — CODE DE LA ROUTE Les modifications apportées à l’article 53 du Code de la route pré- voient que, dans le but de déterminer si une personne a commis une infraction subséquente pour avoir conduit un véhicule automobile alors que son permis de conduire est suspendu, les suspensions or- données pour certaines infractions criminelles associées à la con- duite automobile sont examinées séparément de celles ordonnées pour d’autres raisons. Les modifications apportées aux articles 144 et 146 du Code de la route font passer de 60 $ à 150 $ l’amende minimale imposée à quiconque n’observe pas un feu rouge ou jaune.

PARTIE IV —

LOI SUR LES DROITS DE CESSION IMMOBILIÈRE La

Loi sur les droits de cession immobilière permet présentement le remboursement des droits de cession immobilière à acquitter par les acquéreurs d’une première maison qui achètent un logement neuf au plus tard le 31 mars 1998. Une modification reporte la date limite au 31 mars 1999. Une modification apportée à l’article 1 rétablit deux dispositions (les anciens paragraphes 18 (9) et (10)) ayant trait au calcul de la valeur de la contrepartie pour des transactions précisées.

PARTIE V — LOI DE 1998 SUR LES EMPRUNTS DE L’ONTARIO Le projet de loi édicte la Loi de 1998 sur les emprunts de l’Ontario (qui figure à l’annexe A). Cette Loi autorise l’emprunt d’une somme maximale totale de 4,6 milliards de dollars pour le Trésor. Il est prévu que les fonds proviendront principalement des marchés finan- ciers publics, du marché international des prêts et du Régime de pensions du Canada. L’autorisation d’emprunter prend fin le 31 dé- cembre 1999.

PARTIE VI —LOI SUR LA SOCIÉTÉ DES LOTERIES DE L’ONTARIO La

Loi sur la Société des loteries de l’Ontario prévoit présentement que les bénéfices nets de la Société peuvent être affectés par la Législature à certaines fins précisées. Une modification apportée à la Loi élargit la liste de ces fins de façon à inclure la fourniture de soins de santé, les activités et les objectifs d’organismes de bienfaisance et de personnes morales sans but lucratif et le financement des activités et des programmes communautaires.

Une modification autorise la Société à effectuer des paiements, pré- levés sur ses recettes, conformément à des ententes approuvées par le ministre des Finances en vue de la distribution du produit des loteries entre les organismes de bienfaisance et les personnes mo- rales sans but lucratif ou à leur profit ainsi que du soutien d’autres activités et programmes destinés à la population de l’Ontario. Au moins la moitié des recettes nettes de la Société qui découlent des jeux aux tables doivent être affectées à ces fins.

Une autre modifica- tion exige que la Société inclue des précisions sur ces paiements dans son rapport annuel. Les dispositions de la Loi actuelle en ce qui a trait aux appareils de loterie vidéo sont abrogées.

PARTIE VII —

LOI SUR LA TAXE DE VENTE AU DÉTAIL Les modifications apportées aux articles 2.2, 2.3 et 2.5 de la

Loi sur la taxe de vente au détail portent sur un éventuel accord entre le gouvernement de l’Ontario et le gouvernement fédéral concernant la perception à la frontière de la taxe auprès des résidents de retour. Aux termes de l’accord, Revenu Canada s’occuperait de percevoir la taxe pour le compte de l’Ontario. Les modifications permettent de percevoir la taxe auprès des résidents de retour de la même façon que celle-ci est payée en Ontario. La Loi actuelle prévoit que les services de téléphone 800 et 888 sont exonérés de la taxe. Est apportée une modification qui fait bénéficier

iii telephone service. Another amendment exempts from tax the 25 cent charge for local telephone calls made by depositing coins in pay tele- phones. Amendments clarify that the exemptions from tax in subsections 7 (1) and 9 (3) also apply to psychiatric facilities under the Mental Health Act. The amendment to subsection 9 (4) of the Act extends the exemption from tax in that provision to tangible personal property transferred from the Crown or a Crown agency to a municipality, public commis- sion or local board as the result of an amalgamation or restructuring pursuant to statute.

The current Act provides for a tax rebate to farmers for tangible per- sonal property purchased on or before March 31, 1998 that is being incorporated into a farm structure. An amendment extends the deadline to March 31, 1999.

PART VIII—TOBACCO TAX ACT The Tobacco Tax Act now permits the Minister of Finance to designate persons to collect taxes under the Act. The amendment enables the Minister to impose conditions relating to the designation, and to terminate a person’s designation if the person has not sold or delivered tobacco products for six consecutive months. le service de téléphone 877 de cette exonération. La modification apportée au paragraphe 9 (4) de la Loi fait en sorte que l’exonération de taxe prévue à cette disposition s’applique éga- lement aux biens meubles corporels qui sont transférés de la Cou- ronne ou d’un de ses organismes à une municipalité, à une commis- sion publique ou à un conseil local par suite d’une fusion ou d’une restructuration découlant d’une loi. La Loi actuelle prévoit le remboursement de la taxe que les agricul- teurs acquittent sur des biens meubles corporels achetés au plus tard le 31 mars 1998 et incorporés à des ouvrages agricoles. Une modi- fication reporte la date limite au 31 mars 1999.

PARTIE VIII — LOI DE LA TAXE SUR LE TABAC La Loi de la taxe sur le tabac autorise présentement le ministre des Finances à désigner des personnes pour percevoir les taxes visées par la Loi. La modification apportée permet au ministre d’assujettir la désignation à certaines conditions et de révoquer la désignation de quiconque n’a pas vendu ou livré des produits du tabac pendant six mois consécutifs.

PART I INCOME TAX ACT 1. Paragraph 6 of subsection 3 (1) of the Income Tax Act , as enacted by the Statutes of Ontario, 1997,

chapter 10,

section 1, is repealed and the following substituted: 6. For 1998, the additional income tax shall equal the aggregate of, i. 20 per cent of the amount, if any, by which the gross tax amount of the individual for the taxation year exceeds $4,057.50, and ii. 33 per cent of the amount, if any, by which the gross tax amount of Sa Majesté, sur l’avis et avec le consentement de l’Assemblée législative de la province de l’Ontario, édicte :

Clause 4 (5) (

t) of the Act, as enacted by the Statutes of Ontario, 1997,

chapter 10,

section 2, is repealed and the following substituted: (t) 42.75 per cent in respect of the 1998 taxation year; (u) 40.5 per cent in respect of the 1999 and subsequent taxation years. 3. Subsection 8 (18) of the Act, as amended by the Statutes of Ontario, 1993,

chapter 29,

section 2, is repealed and the following substi- tuted:

(18) The Provincial Minister may allow a deduction or an additional deduction under this

section to an individual for a taxation year after 1984, (

a) if the individual makes a claim to the Provincial Minister that he or she is entitled to the deduction or additional deduction in excess of the amount of any deduction previously allowed under this

section for the taxation year; (

b) if the claim for the deduction or addi- tional deduction is not made in connec- tion with or for the same taxation year as a remission referred to in subsection 28 (1) made under the Financial Administration Act (Canada); and (

c) if the Provincial Minister is satisfied that the individual is entitled to the deduction or additional deduction.

(19) Where the Provincial Minister allows a deduction or an additional deduction under subsection (18), he or she shall apply the amount of the deduction or additional deduc- tion in the manner described in subsection (10). d’imposition sur 5 217,50 $. 7. a) le particulier fait au ministre provincial une demande dans laquelle il prétend avoir droit à la déduction ou à la dé- duction supplémentaire en sus du mon- tant de toute déduction déjà accordée pour l’année d’imposition en vertu du présent article;

b) la demande de déduction ou de déduc- tion supplémentaire n’est pas faite rela- tivement à la remise visée au paragra- phe 28 (1) accordée en vertu de la

Loi sur la gestion des finances publiques (Canada) ou pour la même année d’im- position que cette remise;

c) le ministre provincial est convaincu que le particulier a droit à la déduction ou à la déduction supplémentaire.

(19) S’il accorde une déduction ou une dé- duction supplémentaire en vertu du paragra- phe (18), le ministre provincial affecte le montant de la déduction ou de la déduction supplémentaire de la manière prévue au para- graphe (10). 3RÉDUCTION DES IMPÔTS Commence- ment 4. (1) Subsection 28 (2) of the Act is amended by striking out “when the claim is made more than three years after the end of the taxation year to which the claim relates” in the ninth, tenth and eleventh lines. (2) Subsection 28 (3) of the Act is repealed. 5.

(1) Subject to subsection (2), this

Part comes into force on the day this Act receives Royal Assent.

(2) Sections 1 and 2 shall be deemed to have come into force on January 1, 1998.

PART II CORPORATIONS TAX ACT 6. Subsection 11.1 (3) of the Corporations Tax Act, as enacted by the Statutes of Ontario, 1997,

chapter 43,

Schedule A,

section 6, is repealed. 7. The definition of “Ontario allocation factor” in subsection 12 (1) of the Act is amended by inserting after “section 13” in the eighth and ninth lines of clause (

a) and in the eighth line of clause (b) “or 13.1”. 8.

(1) Subclause 14 (5) (e) (

i) of the Act is amended by striking out “and” at the end of sub-subclause (

A) and by adding the follow- ing sub-subclause: (

C) under

section 13.1 in respect of an amount deducted under clause 11 (10) (

a) by the partnership as an Ontario new technol- ogy tax incentive, and . . . . .

(2) Subclause 14 (5) (e) (ii) of the Act, as amended by the Statutes of Ontario, 1992,

chapter 3,

section 5, is further amended by adding after “subsection 12 (13)” in the seventh line “or

section 11.1”. 9. (1) Subsection 35 (2) of the Act is amended by striking out “section 12 or 13 or both sections” in the 19th and 20th lines and substituting “any of sections 12, 13 and 13.1”. (2) Subsection 35 (3) of the Act is amended by striking out “section 12 or 13” in the fifth line of clause (c), in the fourth line of clause (

d) and in the third line of subclause (d) (ii) and substituting in each case “section 12, 13 or 13.1”. 4.

Le paragraphe 11.1 (3) de la

Loi sur l’imposition des corporations , tel qu’il est adopté par l’article 6 de l’annexe A du chapi- tre 43 des Lois de l’Ontario de 1997, est abro- gé.

La définition de «coefficent de réparti- tion de l’Ontario» au paragraphe 12 (1) de la Loi est modifiée par insertion de «ou 13.1» après «l’article 13» à la huitième ligne de l’alinéa a) et à la huitième ligne de l’alinéa b). 8.

(1) Le sous-alinéa 14 (5) e) (

i) de la Loi est modifié par adjonction du sous-sous- alinéa suivant : (

C) aux termes de l’article 13.1, à l’égard d’un montant que la société a déduit en vertu de l’alinéa 11

(10) a) au ti- tre du stimulant fiscal de l’Ontario pour les nouvelles technologies, . . . . .

(1.4) Despite clauses (1.1) (

d) to (j), if the taxation year begins on or before the Decem- ber 31 indicated in the applicable clause, the increase from the percentage set out in the preceding clause to the percentage set out in the applicable clause shall be prorated according to the number of days in the taxa- tion year that are after that December 31. 11. Subsection 41.1 (3) of the Act, as enacted by the Statutes of Ontario, 1994,

chapter 14,

section 15, is repealed and the following substituted:

(6.2) Despite subsections (4) to (6.1), a qualifying production company’s eligible credit for a taxation year in respect of an eligible Ontario production is nil if the com- pany claims a tax credit for any taxation year under

section 43.10 in respect of the produc- tion.

(6) Subsection 43.5 (9) of the Act, as enacted by the Statutes of Ontario 1996,

a) certifying that the particular production is an eligible Ontario production for the purposes of this section; (

b) certifying the estimated amount of the corporation’s eligible credit for the production, for the purposes of this section; and (

c) if principal photography for the pro- duction commences before November 1, 1997, certifying the amount of the company’s Ontario film and television tax credit limit to be allocated to the particular production.

(7) Subsection 43.5 (11) of the Act, as re-en- acted by the Statutes of Ontario, 1997, chap- ter 43,

Schedule A,

section 19, is repealed and the following substituted:

(11) The Ontario film and television tax credit limit of a qualifying production com- pany and all corporations associated with the company in respect of eligible Ontario pro- ductions for which principal photography commences in a production year and before November 1, 1997 is the amount determined under the following rules: 1. The Ontario film and television tax credit limit in respect of all eligible Ontario productions for which princi- pal photography is commenced by the company or a corporation associated admissible éventuelle pour la production pour l’année d’imposition précédente.

(7) Le paragraphe 43.5 (11) de la Loi, tel qu’il est adopté de nouveau par l’article 19 de l’annexe A du

chapitre 43 des Lois de l’Onta- rio de 1997, est abrogé et remplacé par ce qui suit :

(1) A corporation that is a qualifying corporation for a taxation year and complies with the requirements of this

section may deduct from its tax otherwise payable under this Part for the taxation year, after making all deductions claimed under sections 39, 40, 41, 43 and 43.2 to 43.9 for the taxation year, an amount not exceeding the amount of its Ontario production services tax credit for the taxation year.

(2) A corporation that is a qualifying cor- poration for a taxation year and complies with the requirements of this

section may deduct from its tax otherwise payable for the year under Parts III and IV of the Act an amount not exceeding the amount by which its Ontario production services tax credit for the taxation year exceeds the maximum amount, if any, deductible by the corporation for the year under subsection (1).

(3) The amount of a qualifying corpor- ation’s Ontario production services tax credit for a taxation year is the sum of the corpor- ation’s eligible credits for the taxation year in respect of eligible productions. 4. Il ne s’agit pas, si les principaux tra- vaux de prise de vues commencent avant le 1 er novembre 1997, d’une pro- duction de variétés, d’une production éducative ou pédagogique ou d’une programmation produite sous forme de magazine. 5.

partie pour l’année, après avoir fait toutes les déductions qu’elle demande aux termes des articles 39, 40, 41, 43 et 43.2 à 43.9 pour l’année, un montant qui ne dépasse pas celui de son cré- dit d’impôt de l’Ontario pour les services de production pour l’année.

(2) La corporation qui est une corporation admissible pour une année d’imposition et qui satisfait aux exigences du présent

article peut déduire de son impôt payable par ail- leurs aux termes des parties III et IV de la Loi pour l’année un montant qui ne dépasse pas l’excédent de son crédit d’impôt de l’Ontario pour les services de production pour l’année sur le montant maximal éventuel qu’elle peut déduire pour l’année en vertu du paragraphe (1).

(3) Le montant du crédit d’impôt de l’On- tario pour les services de production d’une corporation admissible pour une année d’im- position est la somme de ses crédits autorisés concernant des productions admissibles pour l’année. (4) A qualifying corporation’s eligible credit for a taxation year in respect of an eligible production is 11 per cent of its qual- ifying Ontario labour expenditure in respect of the production for the taxation year.

(5) Despite subsection (4), a qualifying corporation’s eligible credit for a taxation year in respect of an eligible production is nil if the corporation claims a tax credit for any taxation year under

section 43.5 in respect of the production, unless no tax credit under sec- tion 43.5 in respect of the production is allowed.

(6) In order to be eligible to deduct or claim an amount in respect of an Ontario production services tax credit under this sec- tion with respect to a particular production, a qualifying corporation shall apply to the Ontario Film Development Corporation, or to another person designated by the Minister of Citizenship, Culture and Recreation, for certi- fication that the production is an eligible pro- duction for the purposes of this section.

(7) A qualifying corporation that applies for certification shall provide the information specified for the purposes of this

section by the Ontario Film Development Corporation or the person designated by the Minister of Citi- zenship, Culture and Recreation to the person who specified that it be provided.

(8) The Ontario Film Development Corpo- ration or the person designated by the Min- ister of Citizenship, Culture and Recreation shall issue to the qualifying corporation a cer- tificate and any amended certificates, (

a) if the particular production is an eligi- ble production for the purposes of this section; and (

b) if the qualifying corporation, (

i) has not claimed a tax credit in respect of the production under

section 43.5, or (ii) has claimed a tax credit in respect of the production under

section 43.5 which was not allowed on assessment or reassessment by the Minister, and the corporation has not objected to the assessment or reassessment on the issue of the disallowance of the tax credit

article à l’égard d’une pro- duction donnée, une corporation admissible demande à la Société de développement de l’industrie cinématographique ontarienne ou à la personne que désigne le ministre des Affaires civiques, de la Culture et des Loisirs un certificat attestant que la production est une production admissible aux fins du présent article.

(7) La corporation admissible qui demande un certificat fournit, à la personne qui les demande, les renseignements que la Société de développement de l’industrie cinématogra- phique ontarienne ou la personne que désigne le ministre des Affaires civiques, de la Cul- ture et des Loisirs précise aux fins du présent article.

(8) La Société de développement de l’in- dustrie cinématographique ontarienne ou la personne que désigne le ministre des Affaires civiques, de la Culture et des Loisirs délivre à la corporation admissible un certificat et tout certificat modifié :

a) d’une part, si la production donnée est une production admissible aux fins du présent article;

b) d’autre part, si la corporation admissi- ble : (

i) soit n’a pas demandé de crédit d’impôt à l’égard de la production en vertu de l’article 43.5, (ii) soit a demandé, en vertu de l’arti- cle 43.5, un crédit d’impôt à l’égard de la production qui ne lui a pas été accordé par suite d’une cotisation ou d’une nouvelle coti- sation établie par le ministre et à laquelle la corporation n’a pas présenté d’opposition fondée sur Crédit autorisé Exception Demande de certificat Idem Certificat Corporations Tax Act

(9) Each certificate issued under subsec- tion (8) must certify that the particular pro- duction is an eligible production for the pur- poses of this

section and certify the estimated amount of the corporation’s eligible credit for the production for the purposes of this sec- tion.

(10) In order to deduct or claim an amount under this

section for a taxation year in respect of a particular production, a qualify- ing corporation must deliver to the Minister with its return for the taxation year the certifi- cate most recently issued in respect of the production or a certified copy of the certifi- cate.

(11) A qualifying corporation shall be deemed to pay on account of its tax payable under this Act for a taxation year an amount claimed by the corporation not exceeding the amount, if any, by which the corporation’s Ontario production services tax credit for the taxation year exceeds the maximum amount, if any, deductible by the corporation under subsections (1) and (2) in determining its tax payable under this Act for the taxation year.

(12) A qualifying corporation shall be deemed to make the payment referred to in subsection (11) and the Minister shall be deemed to apply the deemed payment on the day on or before which the corporation would be required under clause 78 (2) (

b) to pay any balance of tax payable for the taxation year.

(13) A certificate or amended certificate issued under subsection (8) may be revoked, (

a) if an omission or incorrect statement was made for the purpose of obtaining the certificate; (

b) if the production is not an eligible pro- duction; (

c) if the corporation to which the certifi- cate is issued is not a qualifying corpo- ration; or (

d) if a certificate in respect of the produc- tion is issued to the corporation under subsection 43.5 (9).

(14) A certificate that is revoked shall be deemed never to have been issued.

(15) This

(9) Chaque certificat délivré aux termes du paragraphe (8) atteste que la production don- née est une production admissible aux fins du présent

article et précise le montant estimatif du crédit autorisé de la corporation à l’égard de la production aux fins du présent article.

(10) Pour pouvoir déduire ou demander un montant aux termes du présent

article pour une année d’imposition à l’égard d’une pro- duction donnée, une corporation admissible doit remettre au ministre, avec sa déclaration pour l’année, le plus récent certificat qui a été délivré à l’égard de la production ou sa copie certifiée conforme.

(11) Une corporation admissible est répu- tée payer au

titre de son impôt payable aux termes de la présente loi pour une année d’imposition un montant qu’elle demande et qui ne dépasse pas l’excédent éventuel de son crédit d’impôt de l’Ontario pour les services de production pour l’année sur le montant maximal éventuel qu’elle peut déduire en vertu des paragraphes (1) et (2) lors de la détermination de son impôt payable aux termes de la présente loi pour l’année.

(12) Une corporation admissible est répu- tée effectuer le paiement visé au paragraphe (11) et le ministre est réputé l’affecter le jour auquel, au plus tard, la corporation est tenue aux termes de l’alinéa 78

(2) b) de verser le solde éventuel de son impôt payable pour l’année d’imposition.

(13) Un certificat ou un certificat modifié délivré aux termes du paragraphe (8) peut être révoqué si, selon le cas :

a) une omission ou une affirmation inexacte a été faite en vue de l’obtenir;

b) la production n’est pas une production admissible;

c) la corporation à laquelle le certificat est délivré n’est pas une corporation admissible;

d) un certificat concernant la production est délivré à la corporation aux termes du paragraphe 43.5 (9).

(14) Le certificat qui est révoqué est réputé ne jamais avoir été délivré.

(15) Le présent

article s’applique à l’égard des dépenses de main-d’œuvre admissibles en Ontario engagées après le 31 octobre 1997. (2) Where it is established to the satisfac- tion of the Minister that land is being acquired by a person for the purpose of replacing land that was taken from the person under statutory authority, that was sold by the person to a person by whom notice of an intention to take the land under statutory authority was given, or that was sold by the person to a person having the power to take the land under statutory authority, and it is reasonable to assume in the case where the land is sold that, had the land not been sold, it would have been taken under statutory authority by the person to whom it is sold, the value of the consideration for the land being acquired shall be reduced by an amount equal to the compensation or proceeds of sale rea- sonably attributable to the land that was taken or sold.

(3) Where a person entitled to the lease- hold interest in land acquires the freehold interest therein, the value of the consideration for the conveyance to the person of the free- hold interest may be reduced by the amount of the value of the consideration for the con- veyance by which the person acquired the leasehold interest if the value of that consid- eration was determined under clause (

c) of the definition of “value of the consideration” in subsection (1) and tax was computed and paid with respect to the value of that consid- eration so determined, but the reduction shall not exceed the value of the consideration for the conveyance of the freehold interest. 30.

(1) Subsection 9.2 (2) of the Act, as re- enacted by the Statutes of Ontario, 1997,

section 17, is amended, (

a) by striking out “March 31, 1998” in the seventh line and substituting “March 31, 1999”; and (

(3) Si la personne qui a droit à la tenure à bail d’un bien-fonds en acquiert la franche tenure, la valeur de la contrepartie qu’elle verse pour la cession de la franche tenure peut être réduite du montant de la valeur de la contrepartie qu’elle a versée pour la cession de la tenure à bail, à condition que la valeur de cette dernière contrepartie ait été fixée aux termes de l’alinéa c) de la définition de «va- leur de la contrepartie» qui figure au paragra- phe (1) et que des droits aient été calculés et acquittés à l’égard de la valeur de la contre-

partie ainsi fixée. Toutefois, le montant de cette réduction ne doit pas être supérieur à celui de la contrepartie versée pour la cession de la franche tenure. 30.

(1) Le paragraphe 9.2 (2) de la Loi, tel qu’il est adopté de nouveau par l’article 17 du

section 6, are repealed and the following substituted:

(2) A person does not contravene subsec- tion (1), (

a) if the person sells a lottery ticket to a person relying on documentation of a prescribed type; and (

b) if there is no apparent reason to doubt the authenticity of the documentation or to doubt that it was issued to the person producing it.

(2) Subsection 8.1 (7) of the Act, as enacted by the Statutes of Ontario, 1996,

chapter 26,

section 6, is repealed. 36.

(1) Subsection 8.2 (1) of the Act, as enacted by the Statutes of Ontario, 1996,

chapter 26,

section 6, is amended by striking out “or (2)” in the second line.

(2) Subsection 8.2 (2) of the Act, as enacted by the Statutes of Ontario, 1996,

chapter 26,

section 6, is amended by striking out “8.1 (3) or (6)” in the second line and substituting “8.1 (6)”.

Section 8.3 of the Act, as enacted by the Statutes of Ontario, 1996,

chapter 26,

section 6, is repealed and the following substituted:

chapitre 26 des Lois de l’Ontario de 1996, sont abrogées. 35.

(1) Le paragraphe 8.1 (2) de la Loi, tel qu’il est adopté de nouveau par l’article 6 du

chapitre 26 des Lois de l’Ontario de 1996, et les paragraphes (3) à (5), tels qu’ils sont adoptés par l’article 6 du

chapitre 26 des Lois de l’Ontario de 1996, sont abrogés et rempla- cés par ce qui suit :

(2) Nul ne contrevient au paragraphe (1) si :

a) d’une part, il vend un billet de loterie à une personne sur la foi de documents d’un type prescrit;

b) d’autre part, il n’y a aucun motif apparent de douter de l’authenticité des documents ni de douter qu’ils ont été délivrés à la personne qui les produit.

(2) Le paragraphe 8.1 (7) de la Loi, tel qu’il est adopté par l’article 6 du

chapitre 26 des Lois de l’Ontario de 1996, est abrogé. 36.

(1) Le paragraphe 8.2 (1) de la Loi, tel qu’il est adopté par l’article 6 du

chapitre 26 des Lois de l’Ontario de 1996, est modifié par suppression de «ou (2)» à la deuxième ligne.

(2) Le paragraphe 8.2 (2) de la Loi, tel qu’il est adopté par l’article 6 du

chapitre 26 des Lois de l’Ontario de 1996, est modifié par substitution de «8.1 (6)» à «8.1 (3) ou (6)» à la deuxième ligne. 37. L’article 8.3 de la Loi, tel qu’il est adopté par l’article 6 du

(1) The Corporation may make the fol- lowing payments from its revenues: 1. Payments for prizes. 2. Payments for the operating expenses of the Corporation. 3. Payments made under agreements approved by the Minister of Finance for the distribution by the Corporation of proceeds of lottery schemes, i. to or for the benefit of charitable organizations and non-profit cor- porations, or ii. for the support of other activities and programs for the benefit of the people of Ontario.

(2) An agreement referred to in paragraph 3 of subsection (1) shall provide that, in each fiscal year of Ontario, the Corporation shall use at least one-half of the net revenue it receives during the year from the table gam- ing activities described in subsection (4) to make payments described in paragraph 3 of subsection (1).

(3) If, in any fiscal year of Ontario, one- half of the net revenue that the Corporation receives from the table gaming activities described in subsection (4) exceeds the total of the payments described in paragraph 3 of subsection (1) made by the Corporation in the fiscal year, the Corporation shall, in the fol- lowing fiscal year, pay the excess to or among the organizations, corporations, activi- ties and programs described in paragraph 3 of subsection (1) in such amounts as the Min- ister of Finance directs, and shall not expend the excess for any other purpose.

(4) For the purposes of subsections (2) and (3), the Minister responsible for the adminis- tration of this Act may, by regulation, (

a) prescribe the activities that constitute table gaming; and (

b) prescribe the classes of persons or en- tities whose table gaming activities are to be considered in calculating the net revenue of the Corporation received from table gaming activities.

Section 9 of the Act, as amended by the Statutes of Ontario, 1996,

chapter 26,

section 6, is repealed and the following substituted: 9.

(1) The net profits of the Corporation, after payments referred to in

section 8.3, shall be paid into the Consolidated Revenue Fund at such times and in such manner as the Min- ister of Finance may direct and are available 8.3

(3) Si, au cours d’un exercice de l’Ontario, la moitié des recettes nettes que la Société tire des activités de jeu aux tables visées au paragraphe (4) dépasse le montant total des paiements visés à la disposition 3 du paragra- phe (1) qu’elle a effectués au cours de l’exer- cice, la Société, au cours de l’exercice sui- vant, distribue l’excédent entre les orga- nismes, personnes morales, activités et pro- grammes visés à la disposition 3 du paragra- phe (1) ou à leur profit selon les montants qu’ordonne le ministre des Finances et ne doit l’affecter à aucune autre fin.

(4) Pour l’application des paragraphes (2) et (3), le ministre responsable de l’application de la présente loi peut, par règlement :

a) prescrire les activités qui constituent des jeux aux tables;

b) prescrire les catégories de personnes ou entités dont les activités de jeu aux ta- bles doivent être prises en compte dans le calcul des recettes nettes que la So- ciété tire de telles activités. 38. L’article 9 de la Loi, tel qu’il est modi- fié par l’article 6 du

chapitre 26 des Lois de l’Ontario de 1996, est abrogé et remplacé par ce qui suit : 9.

(2) The net profits of the Corporation paid into the Consolidated Revenue Fund in a fis- cal year of Ontario under subsection (1) and not appropriated in the fiscal year for one or more of the purposes set out in that subsec- tion shall be applied to, and accounted for in the Public Accounts of Ontario as part of, the money appropriated by the Legislature in the fiscal year for the operation of hospitals. 39. Subsection 10 (1) of the Act is amended by striking out “Treasurer of Ontario” in the second and third lines and substituting “Min- ister of Finance”. 40. Subsection 12 (1) of the Act is repealed and the following substituted:

(1) The Corporation shall make a report annually to the Minister upon the affairs of the Corporation.

(1.1) The report must set out all payments made by the Corporation under any agree- ment referred to in paragraph 3 of

section 8.3 and the amount of net revenue that the Cor- poration received from the table gaming activities described in subsection 8.3 (4).

(1.2) The Minister shall submit the report to the Lieutenant Governor in Council and shall then lay the report before the Assembly if it is in session or, if not, at the next session. 41. This

(1) The definition of “returning resi- dent” in subsection 2.2 (1) of the Retail Sales Tax Act, as enacted by the Statutes of Ontario, 1997,

chapter 10,

section 31, is amended by striking out the portion after subclause (b) (iii) and substituting the following: but does not include the holder of a certifi- cate of Indian status issued by the Govern- ment of Canada who provides a declaration that the specified tangible personal prop- erty is being imported for use or consump- tion on a reserve (as defined by the Indian Act (Canada)) by an Indian, a band or the council of a band (as those terms are defined by that Act).

(2) The definition of “specified tangible personal property” in subsection 2.2 (1) of the Act, as enacted by the Statutes of Ontario, 1997,

chapter 10,

section 31, is repealed and the following substituted: “specified tangible personal property” means tangible personal property (including such tangible personal property as the Minister may prescribe to be specified tangible per- sonal property) other than, (

a) vehicles, as defined by the Minister, (

b) tangible personal property that, if pur- chased in Ontario by the returning resi- dent, would be exempt from tax under this Act, or (

chapitre 10 des Lois de l’Ontario de 1997, est abrogée et remplacée par ce qui suit : «bien meuble corporel précisé» Bien meuble corporel (y compris celui que le ministre prescrit comme bien meuble corporel pré- cisé) autre que, selon le cas :

a) les véhicules, au sens que le ministre donne à ce terme;

b) les biens meubles corporels qui, s’ils étaient achetés en Ontario par le rési- dent de retour, seraient exonérés de la taxe aux termes de la présente loi;

c) les biens meubles corporels que le mi- nistre prescrit comme n’étant pas des biens meubles corporels précisés. («specified tangible personal property»)

Les paragraphes 2.3 (6) et (7) de la Loi, tels qu’ils sont adoptés par l’article 31 du

chapitre 10 des Lois de l’Ontario de 1997, sont abrogés et remplacés par ce qui suit :

The Ontario Cancer Treatment and Research Foundation, ii. a hospital approved as a public hospital under the Public Hospi- tals Act, iii. a hospital approved or established as a community psychiatric hospi- tal under the Community Psychi- atric Hospitals Act, iv. a facility approved or established as a psychiatric facility under the Mental Health Act. 46. (1) Subsection 9 (3) of the Act, as enacted by the Statutes of Ontario, 1997,
