Section 1 of the Clean Environment Act,

chapter C-6 of the Revised Statutes, 1973, is amended by adding the following definition in alphabetical order: 1 L’article 1 de la

h) if the Minister considers that the re- lease of a contaminant of concern into or on the environ- ment or any part of the environment has created an emergency situation or presents an imminent and signifi- cant threat or risk to human health or the environment. 5.24(5) Le Ministre peut prendre un arrêté en applica- tion de l’alinéa 5(1)

5.25(4) The Minister may approve a voluntary remedia- tion project if the application complies with the require- ments prescribed by regulation and the Minister considers that the proposed project will achieve remediation in ac- cordance with the standards and requirements prescribed by regulation. 5.25(4) Le Ministre peut approuver un projet d’assai- nissement volontaire si la demande rencontre les exi- gences réglementaires et qu’il estime que le projet va me- ner à bien l’assainissement conformément aux normes et exigences réglementaires. 5.25(5) An approval under subsection (4) may include any term or condition prescribed by regulation, including that the project comply with the standards and require- ments prescribed for the purposes of subsection (3). 5.25(5) L’agrément prévu au paragraphe (4) peut com- prendre les modalités ou les conditions réglementaires, notamment que le projet rencontre les normes et exigences réglementaires pour l’application du paragraphe (3). 5.25(6) When an approval under subsection (4) is in ef- fect, the Minister shall not issue an order under subsec- tion 5.24(2) with respect to the release that is the subject of the voluntary remediation project to the holder of the approval or to any other person named in the approval as a participant in the project. 5.25(6) Lorsque l’agrément prévu au paragraphe (4) est en vigueur, le Ministre ne peut émettre un arrêté en appli- cation du paragraphe 5.24(2) relativement à un déverse- ment visé par un projet d’assainissement volontaire au ti- tulaire de l’agrément ou à quiconque y est nommé à

g) or (

h) if the Minister considers that the release of a contaminant of concern into or on the environment or any part of the environment has created an emergency sit- uation or presents an imminent and significant threat or risk to human health or the environment. 5.25(7) Même si un agrément est en vigueur en appli- cation du paragraphe (4), le Ministre peut prendre un arrêté en application de l’alinéa 5(1)

partie de l’environnement a créé une situation d’urgence ou présente une menace imminente et importante ou pose un risque imminent et important pour la santé humaine ou pour l’environnement. 5.26(1) Two or more persons may enter into a respon- sibility agreement by which one of them assumes all re- sponsibility under this Act for all activities related to the clean-up, rehabilitation, remediation and restoration of a site affected by the release of a contaminant of concern. 5.26(1) Plusieurs personnes peuvent conclure une en- tente d’acceptation de responsabilités selon laquelle l’une d’entre elles assume la responsabilité en application de la présente loi des activités afférentes au nettoyage, à la ré- habilitation, à l’assainissement et à la remise en état d’un site qui est touché par le déversement d’un polluant pré- occupant. 5.26(2) A responsibility agreement shall be submitted to the Minister for approval and shall be in the form and con- tain those matters prescribed by regulation. 5.26(2) Une entente d’acceptation de responsabilités est soumise au Ministre pour son approbation et est établie selon la formule réglementaire et comprend les questions réglementaires. 5.26(3) The Minister may, in accordance with the reg- ulations, approve a responsibility agreement. 5.26(3) Le Ministre peut, en conformité avec les règle- ments, approuver une entente d’acceptation de responsa- bilités. 5.26(4) Despite any provision of this Act or the regula- tions, if, under an approved responsibility agreement, a person is not responsible for the activities related to the clean-up, rehabilitation, remediation and restoration of a site, that person is not a responsible party for the purposes of

section 5.24 with respect to the site and the release that are the subject of the agreement. 5.26(4)

5.26(5) A responsibility agreement comes into effect 5.26(5) Une entente d’acceptation de responsabilités en- tre en vigueur : (

a) when a remediation process completion certifi- cate is issued with respect to the site and the release that are the subject of the agreement, if the agreement has been approved by the Minister, or

a) ou bien quand un certificat d’achèvement du pro- cessus d’assainissement est délivré quant au site et au déversement visés par l’entente, si elle a été approuvée par le Ministre; (

b) when approved by the Minister, if a remediation process completion certificate was issued with respect to the site and the release that are the subject of the agreement before the agreement was approved.

b) ou bien quand elle est approuvée par le Ministre, si un certificat d’achèvement du processus d’assainis- sement a été délivré quant au site et au déversement visés par l’entente avant qu’elle ait été approuvée. 5.26(6) If, under an approved responsibility agreement, a person assumes responsibility for the activities related to the clean-up, rehabilitation, remediation and restoration of a site affected by the release of a contaminant of concern, that person may be issued an order under subsec- tion 5.24(2) with respect to that site despite that the person holds a certificate issued under

section 5.27 with respect to the site. 5.26(6) Si une personne assume dans le cadre d’une en- tente d’acceptation de responsabilités la responsabilité des activités afférentes au nettoyage, à la réhabilitation, à l’as- sainissement et à la remise en état d’un site touché par un déversement d’un polluant préoccupant, elle peut faire l’objet d’un arrêté en vertu du paragraphe 5.24(2) quant à ce site même si elle détient un certificat en vertu de l’ar- ticle 5.27 relativement à ce site. 5.27(1) The Minister may certify in writing that a person will not be issued an order under subsection 5.24(2) with respect to a site for a contaminant of concern that was re- leased before the certificate was issued. 5.27(1) Le Ministre peut certifier par écrit qu’une per- sonne ne fera pas l’objet d’un arrêté en application du pa- ragraphe 5.24(2) quant à un site pour ce qui est d’un pol- luant préoccupant qui a été déversé avant que le certificat ait été délivré. 5.27(2) The Minister shall not issue an order under sub-

section 5.24(2) to a person who holds a certificate under this

section if the release that would be the subject of the order occurred before the certificate was issued and at the site specified in the certificate. 5.27(2) Le Ministre ne peut émettre un arrêté en appli- cation du paragraphe 5.24(2) à une personne qui détient un certificat en application du présent

a) the site is the subject of a remediation process completion certificate; or

b) the Minister considers that issuing the certificate will improve the likelihood of the site being remediated in accordance with the standards and requirements pre- scribed by regulation or of being redeveloped.

section if the Minister is satisfied on reasonable grounds that the person to whom it may be issued did not, by act or omission, cause or contribute to the release of a contaminant of concern at the site to be specified in the certificate or cause or contribute to the effects of the re- lease of a contaminant of concern at that site. 5.27(4) Le Ministre peut seulement délivrer un certificat en vertu du présent

section if the Minister is satisfied on reasonable grounds of the following: 5.27(5) Le Ministre peut révoquer un certificat délivré en application du présent

a) the person to whom the certificate was issued ob- tained it through misrepresentation or fraud; or

b) the person to whom the certificate was issued caused or contributed to, by act or omission, the release of a contaminant of concern at the site specified in the certificate.

Section 30 applies with the necessary modifica- tions to a certificate issued under this section. 5.27(6) L’article 30 s’applique avec adaptations néces- saires à un certificat délivré en application du présent ar- ticle. 5.28(1) Subject to subsections (3) and (4), a person who has knowledge of the release or possible release of a con- taminant of concern into or on the environment or a part of the environment shall immediately report the release to the Minister in accordance with the regulations. 5.28(1)
