Scots Bay Beach Designation

made under subsection 5(1) of the

Beaches Act

R.S.N.S. 1989, c. 32

O.I.C. 76-931 (August 3, 1976), N.S. Reg. 137/76

The Governor in Council on the report and recommendation of the Minister of Lands and

Forests dated the 17th day of June, A.D., 1976, and pursuant to subsection (1) of

Section 5 of

the Beaches Preservation and Protection Act ,

Chapter 6, Statutes of Nova Scotia, 1975, is

pleased to designate as a beach an area of land lying landward from the mean high water mark

of Scots Bay Beach, in the County of Kings, Province of Nova Scotia, as shown outlined in red

on the copy of Crown Land Records Office Plan No. E-5-59 marked

Schedule “B” and

described in

Schedule “A”, both attached to and forming part of the report and

recommendation.

Schedule “A”

All that certain area of land lying landward from the mean high water mark of Scots Bay Beach,

in the County of Kings, Province of Nova Scotia, as shown outlined in red on Plan No. E-5-59

filed in the Crown Land Records Office, Halifax and being more particularly described as

follows:

Beginning at iron post #1 situate near a wire fence along the mean high water mark of

Scotsman Bay;

From thence (by astronomic bearings) south eighty-one degrees forty-four minutes zero

seconds west, a distance of one thousand five hundred decimal twenty-eight feet to a calculated

point in the waters of Scotsman Bay;

Thence south eight degrees sixteen minutes twenty-two seconds east, a distance of seven

thousand eight hundred fifty-two decimal sixty feet to a calculated point in the waters of

Scotsman Bay;

Thence north eighty-one degrees forty-four minutes zero seconds east, a distance of one

thousand four hundred ninety-nine decimal seventy-two feet to iron post #2 placed at the mean

high water mark of Scotsman Bay;

Thence continuing north eighty-one degrees forty-four minutes zero seconds east, a distance of

two hundred seventy-six decimal fifteen feet to a calculated point;

Thence north seven degrees one minute thirty-eight seconds west, a distance of one thousand

two hundred fifty-four decimal zero three feet to a point;

Thence north seven degrees one minute zero seconds west, a distance of three thousand seven

hundred twenty feet to a point;

Thence north fourteen degrees forty-two minutes zero seconds west, a distance of two thousand

eight hundred ninety-eight feet to a point;

Thence south eighty-one degrees forty-four minutes zero seconds west, a distance of sixty feet

to the place of beginning.

Excepting and reserving from the above described area of land all the portion thereof lying

seaward from the mean high water mark.
