An Act to Amend the Real Property Tax Act Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, en- acts as follows: 1 Subsection 10(2) of the Real Property Tax Act,

chapter R-2 of the Revised Statutes, 1973, is re- pealed and the following is substituted: 10(2) If an amended assessment and tax notice that is issued on or after January 1, 2004, or an as- sessment and tax notice that is reissued on or after January 1, 2004, pertains to taxes imposed for the 2003 taxation year or any taxation year before the 2003 taxation year and if there are no tax arrears or penalties payable under this Act, a discount of the lesser of three per cent of those taxes and twenty dollars is allowed provided that those taxes are paid within forty-five days after the mailing of the amended assessment and tax notice or the assess- ment and tax notice that is reissued. 2 Subsection 12(9) of the French version of the Act is amended by striking out “mail” and substi- tuting “mais”.

chapitre R-2 des Lois révisées de 1973, est abrogé et remplacé par ce qui suit : 10(2) Si un avis d’évaluation et d’impôts modifié qui est délivré le 1er janvier 2004 ou après cette date ou si un avis d’évaluation et d’impôts qui est délivré à nouveau le 1er janvier 2004 ou après cette date se rapporte à des impôts levés pour l’année d’imposi- tion 2003 ou à toute année d’imposition avant l’an- née d’imposition 2003 et s’il n’y a aucun arriéré d’impôts ou aucune pénalité payable en application de la présente loi, une remise équivalant au moins élevé de trois pour cent de ces impôts et de vingt dollars est consentie pourvu que ces impôts soient payés dans les quarante-cinq jours après la mise à la poste de l’avis d’évaluation et d’impôts modifié ou de l’avis d’évaluation et d’impôts qui est délivré à nouveau. 2 Le paragraphe 12(9) de la version française de la Loi est modifié par la suppression de « mail » et son remplacement par «m a i s».

Section 19 of the Act is amended by adding af- ter subsection (1.2) the following: 19(1.3) A person may request a certificate re- ferred to in subsection (1) by using the computer program or other electronic means of the Province and the Minister may issue the certificate using the computer program or other electronic means. 19(1.4) A certificate issued by the Minister using the computer program or other electronic means of the Province is valid for all purposes. 4 Paragraph 26(

e) of the Act is repealed. Consequential Amendments 5(1) Subsection 3(3) of New Brunswick Regula- tion 84-210 under the Real Property Tax Act is amended (

a) by repealing paragraph (

j) and substitut- ing the following: (

j) the discount date, if applicable; (

b) by repealing paragraph (

u) and substitut- ing the following: (

u) the discounted amount payable, if applica- ble; 5(2) Subsection 5(1) of the Regulation is re- pealed. Commencement 6(1) Sections 1, 4 and 5 of this Act shall be deemed to have come into force on January 1, 2004. 6(2)

Modifications corrélatives 5(1) Le paragraphe 3(3) du Règlement du Nouveau-Brunswick 84-210 établi en vertu de la

a) par l’abrogation de l’alinéa j) et son rem- placement par ce qui suit :

j) la date de remise, s’il y a lieu;

b) par l’abrogation de l’alinéa u) et son rem- placement par ce qui suit :

u) le montant payable après remise, s’il y a lieu; 5(2) Le paragraphe 5(1) du Règlement est abrogé. Entrée en vigueur 6(1) Les articles 1, 4 et 5 de la présente loi sont réputés être entrés en vigueur le 1 er janvier 2004. 6(2) L’article 3 de la présente loi entre en vi- gueur à une date fixée par proclamation.

An Act to Amend the Real Property Tax Act Bill 67 EXPLANATORY NOTES

Section 1 The existing provision reads as follows: 10(2) Where there are no tax arrears or penalties payable un- der this Act, a discount not exceeding five per cent shall be al- lowed upon payment of the taxes in accordance with the regula- tions.

Section 2 A typographical error in the French version is corrected.

Section 3 New provisions.

Section 4 The amendment is consequential on the amendment made in

section 1 of this amending Act. The existing provision reads as follows: 26 The Lieutenant-Governor in Council may make regulations to give effect to this Act and, without restricting the generality of the foregoing, may make regulations … (

e) determining the discount under subsection 10(2);

Section 5 (1)(

a) and (

b) The amendments are consequential on the amendment made in

section 1 of this amending Act. The exist- ing provisions read as follows: 3(3) The assessment and tax notice referred to in subsection 7(2) of the Act shall contain the following information … (

j) the discount date; … (

u) the discounted amount payable;

(2) The existing provision reads as follows: 5(1) Where (

a) the total of any tax arrears and penalty under the Act is paid, and (

b) the taxes last imposed on real property, other than tax arrears, are paid within forty-five days after the mailing of NOTES EXPLICATIVES

Article 1 La disposition actuelle se lit comme suit : 10(2) Lorsqu’il n’y a aucun arriéré d’impôts ou aucune péna- lité payable en application de la présente loi, une remise de cinq pour cent au plus doit être consentie sur paiement des impôts conformément aux règlements.

Article 2 Correction d’une erreur typographique dans la version fran- çaise.

Article 3 Nouvelles dispositions.

Article 4 Modification corrélative à la modification faite à l’article 1 de la présente loi modificative. La disposition actuelle se lit comme suit : 26 Le lieutenant-gouverneur en conseil peut établir des règle- ments pour assurer l’exécution de la présente loi et notamment, sans restreindre la portée générale de ce qui précède, des règle- ments …

e) précisant quelle sera la remise prévue au paragraphe 10(2);

a) et

b) Modifications corrélatives à la modification faite à l’article 1 de la présente loi modificative. Les dispositions ac- tuelles se lisent comme suit : 3(3) L’avis d’évaluation et d’impôt visé au paragraphe 7(2) de la Loi doit contenir les renseignements suivants : …

j) la date de remise; …

u) le montant payable après remise;

(2) La disposition actuelle se lit comme suit : 5(1) Dans les cas où

a) la somme des arriérés d’impôt et de la pénalité visés par la loi est payée; et

b) les derniers impôts fonciers imposés, autres que les ar- riérés d’impôts, sont payés dans les quarante-cinq jours de la
